It is also submitted that in case<br \/>\n\tof shop holders, this Court (Coram:A.S. Dave,J.) in Special Civil<br \/>\n\tApplication No. 13974 of 2007 directed for consideration of their<br \/>\n\tclaim in the shopping centre, which is to be constructed by the<br \/>\n\tMunicipality and therefore, it has been submitted that the present<br \/>\n\tpetitioners may be given same treatment as have been given to the<br \/>\n\tperson, who had shops in the vegetable market. It was also submitted<br \/>\n\tthat the petitioners are ready to pay price by submitting their<br \/>\n\toffer for shops in the said shopping centre.\n<\/p>\n<p>The<br \/>\n\tlearned Counsel for the petitioners submitted that factum of filing<br \/>\n\tof Civil Suit before the Civil Court at Chotila has been mentioned<br \/>\n\tin the petition. It was mentioned by the learned Counsel for the<br \/>\n\tpetitioners that if this Court entertains the petition, the<br \/>\n\tpetitioners shall withdraw the Civil Suit. But thereafter, the<br \/>\n\tlearned Counsel by relying upon the statement made in the petition<br \/>\n\tsubmitted that the declaration is made in the petition at paragraph<br \/>\n\tNo. 4, that the petitioners also undertakes to withdraw the<br \/>\n\taforesaid Regular Civil Suit filed by them, if required. He<br \/>\n\tsubmitted that though there is alternative<br \/>\n\tprayer made in the petition for allotment of the suitable space,<br \/>\n\twhich as per the affidavit in reply of the respondent-Municipality,<br \/>\n\tcan be considered, the petitioners are not desirous to have<br \/>\n\tthe alternative space, but are only desirous to have<br \/>\n\tclaim in the shopping centre. Therefore, this Court may consider the<br \/>\n\tmatter accordingly. It was also submitted that the petitioners now<br \/>\n\tis not desirous to withdraw the Civil Suit, which is preferred by<br \/>\n\tthem. Hence, this Court may consider the matter accordingly.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tVyas learned Counsel for the respondent-Municipality submitted inter<br \/>\n\talia  that the suit is preferred for the same relief and the other<br \/>\n\tshop holders in the vegetable market were also there, who have not<br \/>\n\tpreferred petition. He submitted that shop holders having vegetable<br \/>\n\tmarket are differently situated than the petitioners. So far as the<br \/>\n\tallotment of the alternative<br \/>\n\tspace of Oata is concerned, he submitted that in paragraph No. 13 of<br \/>\n\tthe affidavit in reply, the alternative place is already available<br \/>\n\tin new vegetable market, which is located, at approximately 500<br \/>\n\tmeter away from the old market. Therefore, if the petitioners<br \/>\n\tapplies for allotment of Oata\/space, the matter can be considered in<br \/>\n\taccordance with law, including by inviting competitive bidding. He<br \/>\n\ttherefore, submitted that the Municipality is not in a position to<br \/>\n\tgive the same treatment to the petitioners as were<br \/>\n\tgiven to the shop holders.\n<\/p>\n<p>It<br \/>\n\tappears that the conduct on the part of the petitioners appear to be<br \/>\n\tof testing the Court, once before the Civil Court by preferring<br \/>\n\tCivil Suit in which, no relief is granted, and the second is by<br \/>\n\tfiling present petitions wherein the statement made is of<br \/>\n\tundertaking to withdraw the Civil Suit. This Court by relying upon<br \/>\n\tthe said statement issued notice vide order dated 30.1.2008, and it<br \/>\n\tappears that when this Court prima facie expressed<br \/>\n\tthe view before dictation of the order, the petitioners have shown<br \/>\n\tnon-willingness to abide by the statement of withdrawal of the suit.<br \/>\n\tThe aforesaid conduct on the part of the petitioners if encouraged,<br \/>\n\twould result into misuse of the process of law by testing the Court<br \/>\n\tbefore different forum. The litigant, who has already resorted to<br \/>\n\tone remedy normally can not simultaneously<br \/>\n\tresort to other remedy for the same cause, unless proceedings are<br \/>\n\tterminated before the at least one forum. Further, if the litigant<br \/>\n\thas declared before the Court that he undertakes to withdraw the<br \/>\n\tearlier proceedings, cannot be permitted to back out at the later<br \/>\n\tstage from such declaration, more particularly after this Court<br \/>\n\thaving entertained the<br \/>\n\tmatter. If such is permitted, it would be misused of the process of<br \/>\n\tlaw, and also would leave room for taking undue benefits of the<br \/>\n\tsituation, which cannot be countenanced.\n<\/p>\n<p>Apart<br \/>\n\tfrom the above, even on merits, except receipt shown<br \/>\n\tfor charging certain amount for utilisation of Oata, there is no<br \/>\n\tother material. No vested rights can be read in favour of the<br \/>\n\tpetitioners on the ground as sought to be canvassed. Merely because,<br \/>\n\tthe petitioners were alloted Oata during particular period in the<br \/>\n\told market, would not give right to the petitioners to claim<br \/>\n\talternative shops in the<br \/>\n\tshopping centre, which is to be constructed by Municipality.<br \/>\n\tFurther, in any case the Municipality has already declared before<br \/>\n\tthis Court for considering their case, if applied for allotment of<br \/>\n\tthe space in the new vegetable market. The petitioners who were<br \/>\n\toccupying Oata cannot be said as similarly situated with those<br \/>\n\tpersons, who had already shops in the vegetable market. Therefore,<br \/>\n\tthe ground of discrimination or parity as sought to be canvassed<br \/>\n\tcannot be accepted. As the petitioners declared before the Court,<br \/>\n\talternative prayer<br \/>\n\tis not pressed and the only initial prayer is pressed, which if<br \/>\n\tconsidered in view of the observations made hereinabove, cannot be<br \/>\n\taccepted, since the petitioners are not similarly situated, nor such<br \/>\n\tright can be claimed by the petitioners.
