SAHAI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate<\/a>\n: 20\/01\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.L.DAVE)<\/p>\n<p>\tHeard<br \/>\nlearned advocate Ms.Karuna Rahevar for the  applicant and learned<br \/>\nadvocate Ms.Amruta Ajmera for respondents Nos.1, 2 and 3.\n<\/p>\n<p>2.\tMs.Rahevar<br \/>\nstates that as per the order passed by this Court on 10.12.2010, the<br \/>\nawarded amount with cost and interest has been deposited with the<br \/>\nTribunal.  In that view of the matter, the ad-interim relief granted<br \/>\nearlier by this Court is made as interim relief till final disposal<br \/>\nof the appeal, subject to the following directions:\n<\/p>\n<p>3.\tIt<br \/>\nis indicated that an amount of Rs.14,62,000\/- is awarded by the<br \/>\nTribunal, out of which, the applicant-appellant challenges by way of<br \/>\nthis appeal,  an amount of Rs.7,35,984\/- only.  Considering the<br \/>\ninterest accrued on the awarded amount and the cost, the appellant<br \/>\nhas deposited Rs.18,27,621\/-. Out of that, an amount of Rs.9,00,000\/-<br \/>\nshall be placed in cumulative term deposit in any Nationalised Bank<br \/>\nin the name of the Nazir of the Court for a period of five years<br \/>\ninitially, and shall be renewed from time to time for a period of one<br \/>\nyear till the disposal of the appeal or till any order that may be<br \/>\npassed by this Court.\n<\/p>\n<p>\tOut<br \/>\nof the remaining amount, an amount of Rs.3,00,000\/- shall be placed<br \/>\nin term deposit with any Nationalised Bank in the name of claimant<br \/>\nVasantiben Bharatbhai Patel for a period of five years initially, to<br \/>\nbe renewed from time to time  till the disposal of the appeal or any<br \/>\norder that may be passed by this Court.  The periodical interest that<br \/>\nshall accrue thereon shall be paid to claimant Vasantiben Bharatbhai<br \/>\nPatel.  The Fixed Deposit receipts shall be kept in custody of the<br \/>\nNazir of the Court.\n<\/p>\n<p>\tAn<br \/>\namount of Rs.1,50,000\/- shall be placed in the names of claimant<br \/>\nKetulkumar Bharatbhai Patel and Krupal Bharatbhai Patel each, in term<br \/>\ndeposit with any Nationalised Bank for a period of five years<br \/>\ninitially for a period of five years, to be renewed from time to time<br \/>\ntill the final disposal of the appeal or any other order that may be<br \/>\npassed by this Court.  The periodical interest shall accrue thereon<br \/>\nshall be paid to them.  The Fixed Deposit receipts shall be kept in<br \/>\ncustody of Nazir of the Court.\n<\/p>\n<p>\tThe<br \/>\namount remaining thereafter from the amount deposited by the<br \/>\napplicant-appellant, after deducting the Court fees etc., shall be<br \/>\npaid to the three claimants in the ratio of 2:1:1 respectively.\n<\/p>\n<p>\tThe<br \/>\napplication is allowed in terms above. Rule is made absolute<br \/>\naccordingly.
