Bajaj, Advocate for the appellant.<\/p>\n<p>Rakesh Kumar Garg, J.(Oral)<\/p>\n<p>             This appeal has been filed by the owner of the offending<\/p>\n<p>vehicle challenging the impugned award whereby claimant-respondent<\/p>\n<p>No.1 has been awarded compensation on account of death of Ms. Kavita<\/p>\n<p>@ Soni in a motor vehicular accident caused due to rash and negligent<\/p>\n<p>driving of the offending vehicle by respondent No.4.<\/p>\n<p>             Along with this appeal, an application has been filed seeking<\/p>\n<p>exemption from deposit of Rs.25,000\/-          which is a pre-requisite for<\/p>\n<p>maintaining an appeal on the ground that award has already been satisfied<\/p>\n<p>in favour of the claimant.\n<\/p>\n<p>            It is well settled that right of appeal is a statutory right and the<\/p>\n<p>same can be availed in accordance with the provisions of law.<\/p>\n<p>             Section 173 of the Motor Vehicles Act, 1988 (hereinafter<\/p>\n<p>referred to as &#8220;the Act&#8221;) which regulates the filing of appeal challenging<\/p>\n<p>the award passed by the Motor Accident Claims Tribunal reads as follows:<\/p>\n<blockquote><p>                   &#8220;Appeals:- (1) Subject to the provisions of sub-sec.(2),<\/p>\n<p>                   any person aggrieve by an award of a Claims Tribunal<\/p>\n<p>                   may, within ninety days from the date of the award,<br \/>\n<span class=\"hidden_text\"> FAO No.5191 of 2009(O&amp;M)                                 2<\/span><\/p>\n<p>                  prefer an appeal to the High Court:\n<\/p><\/blockquote>\n<blockquote><p>                  Provided that no appeal by the person who is required<\/p>\n<p>                  to pay any amount in terms of such award shall be<\/p>\n<p>                  entertained by the High Court unless he has deposited<\/p>\n<p>                  with it twenty-five thousand rupees or fifty per cent of the<\/p>\n<p>                  amount so awarded, whichever is less, in the manner<\/p>\n<p>                  directed by the High Court.\n<\/p><\/blockquote>\n<blockquote><p>                  Provided further that the High Court may entertain the<\/p>\n<p>                  appeal after the expiry of the said period of ninety days,<\/p>\n<p>                  if it is satisfied that the appellant was prevented by<\/p>\n<p>                  sufficient cause from preferring the appeal in time.<\/p>\n<p>                  (2) No appeal shall lie against any award of a Claims<\/p>\n<p>                  Tribunal, if the amount in dispute in the appeal is less<\/p>\n<p>                  than ten thousand rupees.&#8221;<\/p><\/blockquote>\n<p>            Thus, deposit of an amount of Rs.25,000\/- or 50% of the<\/p>\n<p>amount so awarded, whichever is less, is a pre-requisite for filing of the<\/p>\n<p>appeal. There is no provision under the Act under which exemption from<\/p>\n<p>making the deposit under First Proviso to Section 173(1) of the Act can be<\/p>\n<p>granted. A Division Bench of this Court in the case of Harbans Lal and<\/p>\n<p>another v. Nazar Singh and others 2002 ACJ 1827 has held as under:-<\/p>\n<blockquote><p>                  &#8220;Moreover, the appellants have not deposited the<\/p>\n<p>                  statutory amount as required under Section 173(1) of the<\/p>\n<p>                  Motor Vehicles Act, 1988 (hereinafter referred to as &#8216;the<\/p>\n<p>                  Act&#8217;). They have moved an application for exempting<\/p>\n<p>                  them from depositing the amount. No provision of the<\/p>\n<p>                  Act has been shown to us by which the court could grant<\/p>\n<p>                  such an exemption. This appeal also deserves to be<br \/>\n<span class=\"hidden_text\"> FAO No.5191 of 2009(O&amp;M)                                 3<\/span><\/p>\n<p>                  dismissed on this count. It may be noted that in the<\/p>\n<p>                  application, there is no request for postponing the date<\/p>\n<p>                  of the depositing of the amount.&#8221;<\/p><\/blockquote>\n<p>            In the case of <a href=\"\/doc\/1975761\/\">Sohan Singh v. Kushla Devi and others AIR<\/a><\/p>\n<p>1996 Punjab and Haryana, 256, this Court has held as under:<\/p>\n<blockquote><p>                  &#8220;On a plan reading of the proviso to Section 173(1), any<\/p>\n<p>                  person who is required to pay any amount under an<\/p>\n<p>                  award passed by the Claims Tribunal, prefers an appeal,<\/p>\n<p>                  his appeal can be entertained by the High Court only if<\/p>\n<p>                  he makes deposit of a specific amount as required by<\/p>\n<p>                  the said proviso and he cannot claim exemption from<\/p>\n<p>                  making the deposit on the ground that a co-respondent<\/p>\n<p>                  before the Tribunal has filed an appeal and has made<\/p>\n<p>                  the requisite deposit. It is a different thing that the High<\/p>\n<p>                  Court will not order the disbursement of the entire<\/p>\n<p>                  amount deposited by different parties under the proviso<\/p>\n<p>                  to section 173(1)&#8221;.<\/p><\/blockquote>\n<p>            In view of the aforesaid Division Bench judgments&#8217; of this<\/p>\n<p>Court, the argument of the learned counsel for the appellant that in this<\/p>\n<p>case the claim of the claimant-respondents has been satisfied, and<\/p>\n<p>therefore, there is no need to deposit the amount of Rs.25,000\/- as<\/p>\n<p>envisaged under the Act, is not sustainable.
