APP (DB) No.619 of 2010\n                                       ASHOK SHARMA\n                                          Versus\n                                      STATE OF BIHAR\n                                       -----------\n<\/pre>\n<pre>6.   23-Aug-10                Heard.\n\n                                  The         appellant     Ashok        Sharma           was\n\n<\/pre>\n<p>                 convicted for an offence under Section 302 and 141<\/p>\n<p>                 of     the        IPC         and     Section         3(2)(v)of          the<\/p>\n<p>                 SC\/ST(Prevention             of     Atrocities)Act.         The   counsel<\/p>\n<p>                 for the appellant submits that the case of this<\/p>\n<p>                 appellant has been discussed by the trial court at<\/p>\n<p>                 para-49      of        the     judgement       and     he     has     been<\/p>\n<p>                 identified by P.W.7 Niraj Singh and Muni Rajwansh.<\/p>\n<p>                 None of the witnesses have alleged any overt-act<\/p>\n<p>                 against      him       except       his    identification           as    an<\/p>\n<p>                 member      of     unlawful         assembly    at     the    place       of<\/p>\n<p>                 occurrence. Counsel for the appellant submits that<\/p>\n<p>                 the    case of the appellant is identical                           to the<\/p>\n<p>                 case of Babloo Sharma and Chandeshwar Singh who<\/p>\n<p>                 has been granted bail on this ground.<\/p>\n<p>                                  During the pendency of this appeal, let<\/p>\n<p>                 the appellant, namely, Ashok Sharma be released on<\/p>\n<p>                 bail on furnishing bail bond of Rs.10,000\/-(ten<\/p>\n<p>                 thousand) with two sureties of the like amount<\/p>\n<p>                 each   to    the       satisfaction       of    Sri    Vijai      Prakash<\/p>\n<p>                 Mishra, Ist Additional Sessions Judge, Patna in<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>        Sessions Trial No.2 of 1999.
