H.L.JANI, APP for Respondent(s) : 1, \nMR.\nPRATIK JASANI for Respondent(s) :\n2, \n========================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/10\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>The<br \/>\n\tpresent Application has been filed by the Applicant under Section<br \/>\n\t482 of the Criminal Procedure Code for the prayer to quash and set<br \/>\n\taside the criminal complaint being I-CR No. 21 of 2008 registered<br \/>\n\twith Patdi Police Station, Taluka, Dhangdhara, District<br \/>\n\tSurendranagar as well as charge sheet filed in the said criminal<br \/>\n\tcomplaint, on the grounds stated in the Application.\n<\/p>\n<p>Heard<br \/>\n\tlearned Advocate Mr. Y.J.Patel for the Applicant and learned<br \/>\n\tAdvocate Mr. Pratik Jasani for Respondent No.2-Original Complainant<br \/>\n\tas well as learned APP Mr. H.L.Jani for the Respondent &#8211;<br \/>\n\tState.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate Mr. Patel for the Applicant has stated that an affidavit is<br \/>\n\tfiled by Respondent No.2 &#8211; Original Complainant which is at<br \/>\n\tAnnexure-B stating that they have arrived at a settlement and the<br \/>\n\tcomplainant does not want to proceed further with the complaint,<br \/>\n\twhich is confirmed by learned Advocate Mr. Jasani.\n<\/p>\n<p>Therefore,<br \/>\n\tin view of this submission and having regard to the facts and<br \/>\n\tcircumstances, when the parties have amicably arrived at an amicable<br \/>\n\tsettlement, which is reduced to writing, and when it is specifically<br \/>\n\tstated that the complainant does not want to proceed further with<br \/>\n\tthe complaint, the present Application deserves to be allowed.\n<\/p>\n<p>It<br \/>\n\tis required to be mentioned that the Hon&#8217;ble Apex Court in a<br \/>\n\tjudgment in case of  <a href=\"\/doc\/1936939\/\">Jagdish<br \/>\n\tChanana and Others v. State of Haryana and Another,<\/a> (2008) 15 SCC<br \/>\n\t704 has<br \/>\n\tclearly observed in a complaint regarding similar office that where<br \/>\n\tthe dispute is purely of a personal nature and when it has been<br \/>\n\tsettled between the parties, the FIR could be quashed as it might be<br \/>\n\totherwise a futile exercise.\n<\/p>\n<p>\tTherefore,<br \/>\n\thaving regard to the aforesaid facts and circumstances and having<br \/>\n\tregard to the guidelines laid down by the Hon&#8217;ble Apex Court with<br \/>\n\tregard to the approach to be adopted, the present Application<br \/>\n\tdeserves to be allowed and accordingly stands allowed.\n<\/p>\n<p>The<br \/>\n\tprayer in terms of paragraph 14(A) is granted.   Criminal<br \/>\n\tcomplaint being I-CR No. 21 of 2008 registered with Patdi Police<br \/>\n\tStation, Taluka, Dhangdhara, District Surendranagar as well<br \/>\n\tas charge sheet filed in the said criminal complaint is hereby<br \/>\n\tquashed and set aside.\n<\/p>\n<p>\tRule is<br \/>\n\tmade absolute.
