Matter \u00a0 was \u00a0 heard \u00a0 partly \u00a0 through \u00a0 videoconference \u00a0 (VC) \u00a0 on\u00a0<br \/>\n05.08.2010.\u00a0Appellant\u00a0was\u00a0present\u00a0at\u00a0NIC\u00a0VC\u00a0facility\u00a0at\u00a0Indore,\u00a0while\u00a0the\u00a0<br \/>\nrespondents\u00a0 \u2015 \u00a0represented\u00a0by\u00a0Ms.Renu\u00a0Jain,\u00a0Deputy\u00a0Secretary\u00a0&amp;\u00a0CPIO \u00a0<br \/>\n\u2015\u00a0were\u00a0present\u00a0at\u00a0Commission&#8217;s\u00a0office\u00a0at\u00a0New\u00a0Delhi.\n<\/p>\n<p>3.      Respondents\u00a0pointed\u00a0out\u00a0that\u00a0the\u00a0appellant&#8217;s\u00a0RTI\u00adapplication\u00a0dated\u00a0<br \/>\n07.10.2009\u00a0was\u00a0not\u00a0so\u00a0much\u00a0a\u00a0request\u00a0for\u00a0identifiable\u00a0information\u00a0within\u00a0<br \/>\nthe \u00a0 meaning \u00a0 of \u00a0 Section \u00a0 2(f), \u00a0 but \u00a0 a \u00a0 series \u00a0 of \u00a0 queries \u00a0 regarding\u00a0<br \/>\ninterpretation\u00a0of\u00a0various\u00a0terms\u00a0and\u00a0expressions.\u00a0\u00a0Most\u00a0queries\u00a0begin\u00a0with\u00a0<br \/>\n&#8220;what \u00a0 does \u00a0 the \u00a0 term \u00a0 &#8230;&#8230;&#8230;&#8230;&#8230;.. \u00a0 is \u00a0 construed \u00a0 by \u00a0 the \u00a0 department..&#8221; \u00a0<br \/>\ndemanding \u00a0 that \u00a0 the \u00a0 public \u00a0 authority, \u00a0 viz. \u00a0 Department \u00a0 of \u00a0 Expenditure\u00a0<br \/>\nexplain \u00a0it\u00a0to\u00a0him\u00a0&#8216;through \u00a0one\u00a0or\u00a0two \u00a0examples&#8217;. \u00a0 \u00a0There \u00a0were \u00a0hosts \u00a0of\u00a0<br \/>\nother \u00a0 queries \u00a0 focused \u00a0 on \u00a0 obtaining \u00a0 more \u00a0 such \u00a0 interpretations. \u00a0 \u00a0 There\u00a0<br \/>\nwere \u00a0 queries \u00a0 which \u00a0 were \u00a0 unrelated \u00a0 to \u00a0 the \u00a0 Department \u00a0 of \u00a0 Expenditure,\u00a0<br \/>\nsuch\u00a0as\u00a0those\u00a0about\u00a0the\u00a0Cadre\u00a0of\u00a0Inspectors\u00a0of\u00a0Central\u00a0Excise\u00a0and\u00a0the\u00a0<br \/>\nACP \u00a0Schemes \u00a0for \u00a0financial \u00a0upgradation. \u00a0 \u00a0They \u00a0argued \u00a0that \u00a0appellant&#8217;s\u00a0<br \/>\nqueries \u00a0 were \u00a0 intended \u00a0 to \u00a0 establish \u00a0 an \u00a0 open\u00adended \u00a0 dialogue \u00a0 about\u00a0<\/p>\n<p>CIC_AT_A_2010_000273_M_39944.doc\u00a0<br \/>\n                                                                        Page\u00a01\u00a0of\u00a03<br \/>\n meanings, \u00a0 interpretations, \u00a0 reasons, \u00a0 etc., \u00a0 which \u00a0 he \u00a0 was \u00a0 not \u00a0 entitled \u00a0 to\u00a0<br \/>\nseek\u00a0under\u00a0the\u00a0RTI\u00a0Act.\n<\/p>\n<p>4.    Appellant \u00a0 pointed \u00a0 out \u00a0 that \u00a0 he \u00a0 had \u00a0 asked \u00a0 for \u00a0 inspection \u00a0 of \u00a0 File\u00a0<br \/>\nNo.1\/1\/2008\u00adIC,\u00a0in\u00a0which,\u00a0he\u00a0believed,\u00a0the\u00a0issues\u00a0which\u00a0he\u00a0had\u00a0raised\u00a0in\u00a0<br \/>\nhis\u00a0RTI\u00adapplication\u00a0were\u00a0dealt\u00adwith.\n<\/p>\n<p>5.     During\u00a0hearing,\u00a0respondents\u00a0stated\u00a0that\u00a0the\u00a0impression\u00a0about\u00a0the\u00a0<br \/>\nrelationship \u00a0 between \u00a0 the \u00a0 above\u00admentioned \u00a0 file \u00a0 and \u00a0 appellant&#8217;s \u00a0 RTI\u00ad<br \/>\nqueries, \u00a0was \u00a0entirely \u00a0erroneous. \u00a0 \u00a0The\u00a0above \u00a0file\u00a0was \u00a0one\u00a0in\u00a0which\u00a0the\u00a0<br \/>\nDepartment\u00a0processed\u00a0a\u00a0number\u00a0of\u00a0different\u00a0matters\u00a0\/\u00a0issues\u00a0and\u00a0there\u00a0<br \/>\nwas \u00a0no\u00a0reason\u00a0why \u00a0appellant\u00a0should\u00a0be\u00a0allowed \u00a0to\u00a0fish\u00a0for\u00a0information\u00a0<br \/>\nwhich,\u00a0the\u00a0Department\u00a0knows,\u00a0was\u00a0not\u00a0in\u00a0its\u00a0control,\u00a0not\u00a0even\u00a0in\u00a0the\u00a0file\u00a0<br \/>\nappellant\u00a0had\u00a0mentioned.\n<\/p>\n<p>6.      This\u00a0is\u00a0not\u00a0the\u00a0only\u00a0employee\u00a0of\u00a0the\u00a0government,\u00a0who\u00a0in\u00a0the\u00a0wake\u00a0<br \/>\nof \u00a0 the \u00a0 Sixth \u00a0 Pay \u00a0 Commission, \u00a0 has \u00a0 come \u00a0 up \u00a0 with \u00a0 a \u00a0 host \u00a0 of \u00a0 queries\u00a0<br \/>\nregarding\u00a0meanings\u00a0and\u00a0interpretations\u00a0of\u00a0the\u00a0CPC&#8217;s\u00a0report\u00a0as\u00a0well\u00a0as\u00a0the\u00a0<br \/>\nactions \u00a0taken\u00a0by\u00a0the\u00a0Department \u00a0of\u00a0Expenditure. \u00a0 \u00a0In\u00a0all\u00a0these\u00a0cases,\u00a0it\u00a0<br \/>\nwas\u00a0the\u00a0position\u00a0taken\u00a0by\u00a0the\u00a0Department\u00a0that\u00a0whatever\u00a0decisions\u00a0were\u00a0<br \/>\ntaken,\u00a0following\u00a0the\u00a0CPC\u00a0recommendation,\u00a0were\u00a0all\u00a0in\u00a0the\u00a0public\u00a0domain,\u00a0<br \/>\nput\u00a0on\u00a0the\u00a0websites\u00a0from\u00a0time\u00a0to\u00a0time,\u00a0as\u00a0well\u00a0as\u00a0in\u00a0the\u00a0departmental\u00a0files\u00a0<br \/>\nin\u00a0which\u00a0the\u00a0specific\u00a0queries\u00a0or\u00a0issues\u00a0were\u00a0dealt\u00adwith\u00a0and\u00a0then\u00a0returned\u00a0<br \/>\nto\u00a0those\u00a0Departments.\u00a0 \u00a0The\u00a0Department\u00a0of\u00a0Expenditure\u00a0is\u00a0disinclined\u00a0to\u00a0<br \/>\nbe\u00a0made\u00a0answerable\u00a0under\u00a0RTI\u00a0Act\u00a0about\u00a0meanings\u00a0and\u00a0interpretations\u00a0<br \/>\nof \u00a0 words \u00a0 and \u00a0 expressions \u00a0 used \u00a0 in \u00a0 the \u00a0 CPC \u00a0 report \u00a0 or \u00a0 the \u00a0 documents\u00a0<br \/>\nbrought\u00a0out\u00a0by\u00a0the\u00a0Department.\u00a0\u00a0It\u00a0is\u00a0their\u00a0contention\u00a0that\u00a0they\u00a0could\u00a0not\u00a0<br \/>\nbe \u00a0 asked \u00a0 to \u00a0 interpret \u00a0 these \u00a0 documents \u00a0 for \u00a0 the \u00a0 convenience \u00a0 of \u00a0 the\u00a0<br \/>\nemployees\u00a0who\u00a0use\u00a0the\u00a0RTI\u00adroute.\n<\/p>\n<p>7.      It \u00a0 has \u00a0 been \u00a0 the \u00a0 consistent \u00a0 position \u00a0 of \u00a0 this \u00a0 Commission \u00a0 that \u00a0 an\u00a0<br \/>\napplicant\u00a0for\u00a0information\u00a0can\u00a0seek\u00a0only\u00a0such\u00a0material\u00a0which\u00a0answers\u00a0the\u00a0<br \/>\ndefinition\u00a0of\u00a0&#8216;information&#8217;\u00a0under\u00a0Section\u00a02(f)\u00a0of\u00a0the\u00a0RTI\u00a0Act.\u00a0\u00a0Explanations,\u00a0<\/p>\n<p>CIC_AT_A_2010_000273_M_39944.doc\u00a0<br \/>\n                                                                             Page\u00a02\u00a0of\u00a03<br \/>\n reasons,\u00a0interpretations\u00a0and\u00a0so\u00a0on,\u00a0did\u00a0not\u00a0qualify\u00a0to\u00a0be\u00a0information\u00a0under\u00a0<br \/>\nSection\u00a02(f).\u00a0The\u00a0High\u00a0Court\u00a0of\u00a0Bombay\u00a0at\u00a0Goa,\u00a0through\u00a0its\u00a0order\u00a0dated\u00a0<br \/>\n03.04.2008 \u00a0 in \u00a0 Dr.Celsa \u00a0 Pinto \u00a0 Vs. \u00a0 Goa \u00a0 State \u00a0 Information \u00a0 Commission\u00a0<br \/>\n(W.P.No.419\u00a0of\u00a02007)\u00a0has\u00a0upheld\u00a0this\u00a0position.\n<\/p>\n<p>8.     As\u00a0the\u00a0queries\u00a0of\u00a0the\u00a0appellant\u00a0lie\u00a0beyond\u00a0the\u00a0scope\u00a0of\u00a0Section\u00a02(f),\u00a0<br \/>\nthe \u00a0 public \u00a0 authority, \u00a0 viz. \u00a0 the \u00a0 Department \u00a0 of \u00a0 Expenditure \u00a0 cannot \u00a0 be\u00a0<br \/>\nobligated\u00a0to\u00a0answer\u00a0the\u00a0same.\n<\/p>\n<p>9.      In\u00a0the\u00a0matter\u00a0of\u00a0appellant&#8217;s\u00a0request\u00a0for\u00a0file\u00adnotings\u00a0from\u00a0the\u00a0File\u00a0No.\u00a0<br \/>\n1\/1\/2008\u00adIC,\u00a0I\u00a0find\u00a0that\u00a0it\u00a0was\u00a0not\u00a0mentioned\u00a0in\u00a0Appellate\u00a0Authority&#8217;s\u00a0order\u00a0<br \/>\ndated\u00a011.01.2010. \u00a0 \u00a0Given \u00a0what \u00a0the\u00a0respondents \u00a0have\u00a0stated \u00a0about\u00a0the\u00a0<br \/>\ncontents \u00a0 of \u00a0 this \u00a0 file, \u00a0 I \u00a0 am \u00a0 unable \u00a0 to \u00a0 comprehend \u00a0 the \u00a0 keenness \u00a0 of \u00a0 the\u00a0<br \/>\nappellant\u00a0to\u00a0access\u00a0it.\u00a0 \u00a0Nevertheless,\u00a0considering\u00a0his\u00a0anxiety\u00a0about\u00a0this\u00a0<br \/>\nparticular\u00a0file,\u00a0Appellate\u00a0Authority\u00a0is\u00a0requested\u00a0to\u00a0have\u00a0a\u00a0fresh\u00a0look\u00a0at\u00a0this\u00a0<br \/>\nand \u00a0 to \u00a0 take \u00a0 a \u00a0 decision \u00a0 on \u00a0 whether \u00a0 this \u00a0 could \u00a0 be \u00a0 disclosed. \u00a0 \u00a0 In \u00a0 case\u00a0<br \/>\nAppellate\u00a0Authority\u00a0decides\u00a0against\u00a0disclosure\u00a0of\u00a0this\u00a0item\u00a0of\u00a0information,\u00a0<br \/>\nshe\u00a0may\u00a0record\u00a0the\u00a0reasons\u00a0and\u00a0communicate\u00a0it\u00a0to\u00a0the\u00a0appellant\u00a0within\u00a0<br \/>\ntwo\u00a0weeks\u00a0of\u00a0the\u00a0receipt\u00a0of\u00a0this\u00a0order.\u00a0\u00a0In\u00a0case\u00a0a\u00a0decision\u00a0is\u00a0made\u00a0to\u00a0allow\u00a0<br \/>\naccess \u00a0 to \u00a0 the \u00a0 appellant \u00a0 to \u00a0 the \u00a0 requested \u00a0 information, \u00a0 it \u00a0 may \u00a0 be\u00a0<br \/>\ncommunicated\u00a0to\u00a0him\u00a0within\u00a0two\u00a0weeks\u00a0of\u00a0the\u00a0receipt\u00a0of\u00a0this\u00a0order.\u00a0\u00a0\n<\/p>\n<p>10.
