It is the case of the petitioners that\n\npetitioner No.1 and the grand father7of&quot;jjetitionersu \n\n2.[b) were brothers. T o substantiate the same, the\n\n petitioriers have produced the record of rights for the year\n\n  &quot;;1,_V9&#039;f.2,\u00a3-}&#039;;30 to 1938-39. It is their further contention that\n\n&quot;the name of Bhirnanna @\u00a7Bhima and Navalappa, the\n\n \n\n\n\n4\nfather of petitioner No.1 was shown as Kabjedars in the\n\nvillage register maintained by the Revenue Authorities in\nForm No.7. After the death of Navalappa, petitioner. No.1\n\nhad succeeded to his estate and he was in  of\n\nthe land bearing Survey No.12 \/ 2 to an   \n\n38 guntas and after the death of  l\n\n2(a) and 203) being grari-d_ childien ;o&#039;i&quot;\n\nsueceeded to the estate of to e2%tent of 04\nacres 08 guntas in  is contended that\ndue to famine, the  to abandon\ntheir land     manual labour to\n for several years.\nHowever, it  that they found that their\n\nnames  in the record of rights and the\n\n A&#039; Gove-r.nrri&#039;ent   as the holder, which, according to\n\n  is illegal and the petitioners are deprived of\n\ntheir&#039;iAlands&#039;ft)ly&#039; virtue of such entries having been made.\n\n&quot;._ThC petitioners had made representations to the\n\n&quot;\u00abl.j&#039;u.risdiCtiona1 Tahsildar in this regard. Since there was no\n\n3\n\n \n\n\n\n5\n\naction, the petitioners had made further representations,\nthere was no response from the Tahsildar and it is in this\n\nbackground, that the petitioners are before this count,\n\n3.
