PUBLIC PROSECUTOR\nfor\nApplicant(s) : 1, \nMR SHAKEEL A QURESHI for Respondent(s) : 1 -\n5. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE AKIL KURESHI\n\t\t\n\t\n\n \n\nDate\n: 07\/10\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.0\t\tState has preferred<br \/>\nthis revision application against an order dated 27.07.2009, passed<br \/>\nby the learned 3rd Additional Sessions Judge, Surat, below<br \/>\napplication Exhibit-44 in Sessions Case Nos.7 and 143 of 2005.\n<\/p>\n<p>2.0\t\tBriefly stated<br \/>\nfacts are as follows:\n<\/p>\n<p>2.1\t\tRespondents are<br \/>\noriginal accused.  Against them above-mentioned Sessions cases are<br \/>\ngoing on. The charge framed is one punishable under Sections 306,<br \/>\n342, 330, 201 read with Sections 120(B) and 34 of the Indian Penal<br \/>\nCode.  In the said trial, the State filed application Exhibit-44,<br \/>\nseeking to add charge under Section 302 of the Indian Penal Code.<br \/>\nThe Session Court was requested to alter the charge, accordingly.  At<br \/>\none stage, such request was granted, by an order dated 30.11.2006.<br \/>\nThat order was challenged by the accused before the High Court. The<br \/>\nlearned Single Judge, by an order dated 05.05.2009, passed in<br \/>\nCriminal Miscellaneous Application No. 807 of 2006, challenging the<br \/>\norder of the Sessions Court, remanded the proceedings for fresh<br \/>\nconsideration, in accordance with law, without being influenced by<br \/>\nthe said order.\n<\/p>\n<p>2.2\t\tIn the second<br \/>\nround, by the impugned order dated 27.07.2009, the Sessions Court<br \/>\nrejected the said application and, thus, maintained the charge<br \/>\nframed, previously.\n<\/p>\n<p>3.0\t\tI have heard<br \/>\nlearned Advocates appearing for the parties and perused the documents<br \/>\non record.\n<\/p>\n<p>3.1\t\tSubstantial trial<br \/>\nis already conducted, depositions of witnesses are recorded.  The<br \/>\ncase of the prosecution is that the deceased Shantilal @ Utamji died<br \/>\ndue to asphyxia(Strangulation).  The deceased was employed in the<br \/>\nestablishment of the accused. For some alleged irregularity in the<br \/>\naccounts, he was detained, abused and tortured for over two days.<br \/>\nHis family members were not alleged to visit him.  Ultimately, he was<br \/>\nbrought to a hospital and was abandoned, and was found dead.\n<\/p>\n<p>3.2\t\tAbove allegations<br \/>\nare required to be established on record, with respect to which I<br \/>\nexpress absolutely no opinion.  However, above allegations have made<br \/>\non the basis of other evidences sought to be produced on record,<br \/>\nwhich would suggest that, as per the medical evidence there were<br \/>\ninjury marks on several parts of the body of the deceased. These<br \/>\ninjuries were found ante-mortem. Certain internal injuries were also<br \/>\nnoticed during post-mortem.  It is, however, true that the cause of<br \/>\ndeath, as opined by the Doctor, is due to suffocation due to<br \/>\nstrangulation.  Whether the deceased hanged himself or whether he was<br \/>\nstrangulated is a question, which the Sessions Court shall have to<br \/>\ndecide, while conducting the trial.  At this stage, it cannot be<br \/>\nconclusively held that, there is no case for proceeding against the<br \/>\naccused under Section 302 of the Indian Penal Code. I have noticed<br \/>\nthat majority of the witnesses have turned hostile.  However, there<br \/>\nare certain circumstantial factors, which need to be taken into<br \/>\naccount, before coming to the final conclusion.  In other words, upon<br \/>\nalteration of the charge, as I propose, there shall be further<br \/>\nexamination of the witnesses.  They shall also be re-examined, if so<br \/>\ndesired, by the accused.\n<\/p>\n<p>3.3\t\tAt this stage,<br \/>\nhowever, the application of the State for alteration of charge, could<br \/>\nnot be and should not be disallowed.\n<\/p>\n<p>4.0\t\tIn<br \/>\nthe result, the impugned order 27.07.2009, passed by the learned 3rd<br \/>\nAdditional Sessions Judge, Surat, below application Exhibit-44 in<br \/>\nSessions Case Nos.7 and 143 of 2005, is QUASHED.  The<br \/>\nlearned trial Judge shall frame the charge under Section 302 or, in<br \/>\nthe alternative, under Section 306 of the Indian Penal Code and<br \/>\nshall, thereafter, take further steps, under the provisions of Code<br \/>\nof Criminal Procedure. The other charges shall STAND.\n<\/p>\n<p>4.1\t\tI<br \/>\nhave expressed no opinion, whatsoever on the evidence on record or<br \/>\nculpability of the accused, which shall be judged by the trial Court,<br \/>\non the basis of the evidence that may come on record.
