The matters are listed in orders list. With consent
\nof learned eounsei appearing for parties, matters are<\/p>\n
taken up far \ufb01nal disposal.\n<\/p>\n
2. In M.F.A. Nos.4941\/200′?’ to 4945\/2007, claim
\npetitions of claimants have been dismissed on the
\nground that claimants apart from producing Wound
\nCerti\ufb01cate have not examined the Doctor. The Tribunal<\/p>\n
has relied on the judgment of this Court reported in ER<\/p>\n
2006 KAR 1803 wherein, this Court has held that if
\ninjuries su\ufb01ered are very minor or trivial by any
\nstandard, the eiaims petitions are liable to be dismissed.\n<\/p>\n
The Txibunal has not held that injuries suffered by
\nappe\ufb02antgliii\/aforesaid appeals are trivial in nature and
\nvery minor. The Tribunal has met a\u00e9verted to nature of
\ninjuries with reference to Medical Certi\ufb01cate produced
\nby eiaimants.\n<\/p>\n
3. The Tribunal, on peruse} of Wound Certi\ufb01cates<\/p>\n
produced in aforesaid claims has held that injuries<\/p>\n
aw  L\u00bb 1<\/p>\n

suffered by claimants are simple in nature. They carmot
\nbe termed as trivial or very minor in nature. The
\nTribunal has met takezl note of mental shock su\ufb01ezed by
\nclaimants after the accident. ‘\u00a3’h.eref0re, taking imo
\nconsideration nature of injuries, pain arid suffering and
\nmental shock and probable medical expenditure, a sum
\nof Rs.10,000\/- each is awarded as Gem asatiorz in<\/p>\n
aforesaid claims.\n<\/p>\n
4. I11 M.F.A.Nos. $942\/2007, 4933\/2007,<\/p>\n
4935\/2007, 4:33′;\/2007, 4939\/2007 and 4940\/2007, it
\nis the gievance of claimants they are inadequately
\ncompensated.\n<\/p>\n
5. The claimant iJ:1’MV(.”1 N0. 1052\/ 1998 (appellant
\n$12 M.F.A. N0.4933\/2007 had su\ufb01ere\u00e9 swelling on right
\nhand and ten\u00e9emess ever left; hand, swelling over
\ndorsum, tenderness over right side of neck, right hip
\njoint, parital regon, right am} left leg respectively. The
\nTribunal, has awarded cempensation of Rs.2,(}GO\/-.\n<\/p>\n

6. The eiaimant in MVC No. 1953\/2009 (apmllant
\nin M.F’.A. No\/1936 \/2007 had suffered fOHOWii}1g injuries:\n<\/p>\n
(1) laeerated injury on left side of temporal
\nregen extending to back of left ear, semi
\noircuiar measuring 2 cm. — 1 \u00a3311., wound red
\nin colour and one sutured;\n<\/p>\n
(ii) the second injury is tenderness over the
\nheel;\n<\/p>\n
(iii) Abrasion over left knee joint;\n<\/p>\n
{iv} Tendemess over stema region.\n<\/p>\n
The Tribunal, has awai\ufb01ed a compensation of
\nRs.2,9GO\/~–. Considering nature of the injuries, pain and
\nsuffering and mental shock, compensation is enhanced<\/p>\n
to Rs. 15,0%l~.\n<\/p>\n
7. The claimant in MVC 140.1054\/I998 {appellant
\nin M.F’.A. No.4939\/2037′) had suffered following
\ninjuries:\n<\/p>\n
(1) tenderness and sweliing over right elbow;\n<\/p>\n
  \/\\.,. \u00a3’V”‘~””*\u00a2 in ‘” 5<\/p>\n
(ii) tenderness an\u00e9 sweliing over right {high on
\ntempera} aspect.\n<\/p>\n
The Tritmnal, has awarded a compensation of<\/p>\n
Rs.2,{){)O\/–. The same is enhanee\u00e9 to Rs.10,000I-.\n<\/p>\n
8. The claimant in MVC No. iO60\/ 1998 (appellant
\nin M.F’.A. 190.4935\/2907) had su\ufb01’eI’ed laeerated injury
\nmeasuring 3cm X ism, red in eelour, one sutured
\nwound and abrasions. Considering nature 01′ injuries<\/p>\n
suffereti by claimant, Tribunal has awarded<\/p>\n
compensation of Rs.2,000\/-. The same is enhanced to<\/p>\n
Rs. 10,000\/-.\n<\/p>\n
9. The claime\ufb01t in MVC No.1066\/ 1998 (appellant
\nin M.F’.A. No.4940\/2007) had su\ufb01ezed following
\ninjuries:\n<\/p>\n
(i) linear laeerated injury ever right \ufb01enta}<\/p>\n
regen measuring 5 cm X 3 cm red in colour,
