Justice K.T.SANKARAN\n\n Dated :23\/05\/2007\n\n O R D E R\n                H.L.DATTU, C.J.   &amp;   K.T.SANKARAN, J.\n\n                ------------------------------------------\n\n                            W.A.No. 1149 of 2007\n\n                ------------------------------------------\n\n                 Dated, this the  23rd day of May,  2007\n\n\n                               JUDGMENT\n<\/pre>\n<p>H.L.Dattu, C.J.\n<\/p>\n<p>      This   writ   appeal   arises   out   of   an   order   passed   by   the<\/p>\n<p>learned   Single   Judge   in   W.P.(C)   No.6727   of   2007   dated   27th<\/p>\n<p>March, 2007.   By the impugned order, the learned Single Judge<\/p>\n<p>has   taken   note   of   the   representation   made   by   the   petitioner<\/p>\n<p>before the District Collector and thereafter  observed that if there<\/p>\n<p>is any dispute with regard to the title to the property in dispute,<\/p>\n<p>the parties shall approach  the civil court.\n<\/p>\n<p>      2.     Learned   counsel   appearing   for   the   appellant   would<\/p>\n<p>submit before us that he would be satisfied if,   for the present a<\/p>\n<p>direction is issued to the District Collector, Kasaragod to consider<\/p>\n<p>the  representation  of  the  petitioner  (Ext.P3)  as  expeditiously  as<\/p>\n<p>possible and in accordance with law and also if  liberty is granted<\/p>\n<p>to  the   appellant  to   engage  the   services  of   a  learned  counsel  to<\/p>\n<p>argue its case before the District Collector.\n<\/p>\n<p>      3.   In our view, the request of the learned counsel for the<\/p>\n<p>appellant is not only reasonable but also very fair.   Therefore, if<\/p>\n<p>such a permission is granted no prejudice would be caused to the<\/p>\n<p><span class=\"hidden_text\">W.A.No.1149\/2007                        2<\/span><\/p>\n<p>respondents.     Accordingly   the   following:     The   writ   appeal   is<\/p>\n<p>disposed   of.       A   direction   is   issued   to   the   District   Collector,<\/p>\n<p>Kasaragod to consider the representation said to have been filed<\/p>\n<p>by   the   appellant     as   expeditiously   as   possible   and   at   any   rate<\/p>\n<p>within one month from the date of receipt of a certified copy of<\/p>\n<p>the order passed by us.  The appellant shall produce the certified<\/p>\n<p>copy of the order passed by us before the District Collector within<\/p>\n<p>15   days&#8217;   time   from   today.     The   appellant   is   also   permitted   to<\/p>\n<p>engage the services of a learned counsel to argue its case before<\/p>\n<p>the District Collector.\n<\/p>\n<p>       This order of ours shall not be treated as a precedent in any<\/p>\n<p>other case.
