JUSTICE BIRENDRA PRASAD VERMA\n\n                 ORAL ORDER<\/pre>\n<p>                 (Per: HONOURABLE THE CHIEF JUSTICE)<\/p>\n<p>3   30-08-2011                  Feeling aggrieved by the judgment and order dated<br \/>\n                 5th April 2011 passed by the learned single Judge in above CWJC<br \/>\n                 No. 14218 of 2005 the petitioner has preferred the present Appeal<br \/>\n                 under Clause 10 of the Letters Patent.\n<\/p>\n<p>                                The claim of the appellant for compassionate<br \/>\n                 employment has been rejected by the learned single Judge on the<br \/>\n                 ground that she, at the time of making application, was not<br \/>\n                 qualified for employment under the State Government. Therefore,<br \/>\n                 the present Appeal.\n<\/p>\n<p>                                It appears that the husband of the appellant was<br \/>\n                 employed as a peon in the Energy Department of the State<br \/>\n                 Government. While serving as a peon he passed away in 2002.<br \/>\n                 The appellant&#8217;s application for compassionate employment was<br \/>\n<span class=\"hidden_text\"> 2           Patna High Court LPA No.1109 of 2011 (3) dt.30-08-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                                  2\/2<\/span><\/p>\n<p>                       not considered for want of requisite qualification.\n<\/p>\n<p>                                      Learned advocate Mr. Sanjeev Nikesh appearing for<br \/>\n                       the appellant, has relied upon the Government Circular dated 18 th<br \/>\n                       December 2008 indicating that the Maha Dalits may be appointed<br \/>\n                       on compassionate employment even though they are not qualified,<br \/>\n                       on condition that they would acquire the requisite qualification<br \/>\n                       within two years. Mr. Sanjeev Nikesh has submitted that the<br \/>\n                       petitioner is a Maha Dalit; she, therefore, should be granted the<br \/>\n                       benefit of 2008 Circular.\n<\/p>\n<p>                                      We are unable to agree with learned Advocate Mr.<br \/>\n                       Sanjeev     Nikesh.       2008      Circular   does   not   contemplate<br \/>\n                       reconsideration of the cases decided. It is now nearly ten years<br \/>\n                       since the death of the appellant&#8217;s husband.\n<\/p>\n<p>                                      No case for interference is made out. The appeal is<br \/>\n                       dismissed in limine.\n<\/p>\n<p>                                                    (R.M.
