GOVERNMENT PLEADER for\nRespondent(s) : 1, \nNOTICE SERVED for Respondent(s) :\n2, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE K.M.THAKER\n\t\t\n\t\n\n \n\nDate\n: 27\/08\/2008 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>\tThis<br \/>\npetition is preferred with a prayer to direct the respondents to pay<br \/>\nwages and other benefits to the petitioner from the date of the award<br \/>\ntill the actual reinstatement came to be effected i.e. till<br \/>\n28.4.2005. The petitioner has also claimed interest at the rate of<br \/>\n12%.\n<\/p>\n<p>\tThe<br \/>\npetitioner seeks to rely upon the judgment and order dated 25.7.2005<br \/>\npassed by this court (Coram: Hon&#8217;ble Mr. Justice K.S.Jhaveri) in<br \/>\nspecial civil application No.533 of 2000 wherein, the court has<br \/>\nobserved that:-\n<\/p>\n<p>\u00fdS6.0\t\t.\n<\/p>\n<p>. . . . The respondent shall be given the benefit of continuity of<br \/>\nservice on 30.09.1985 as directed by this court and shall be given<br \/>\nall benefits from the date of the publication of the award till he is<br \/>\nreinstated in service. The said benefits to be paid within a period<br \/>\nof three months from the receipt of writ of this order. Rule is made<br \/>\nabsolute to the aforesaid extent with no order as to costs.\u00fd\u00fd<\/p>\n<p>\tIt<br \/>\nis, on the basis of the said observations, that the petitioner has<br \/>\nraised his claim for payment of wages and other benefits until the<br \/>\ndate of his reinstatement i.e. the benefit of wages, etc., for the<br \/>\n\u00fdSpost award\u00fd\u00fd period.\n<\/p>\n<p>\tIt<br \/>\nis incomprehensible as to on what basis the petitioner is claiming<br \/>\nthe payment with interest at the rate of 12%. On one hand, the<br \/>\npetitioner is raising his claim on the observations made in July,<br \/>\n2005 by this court in the aforesaid order which does not contain any<br \/>\ndirection as regards interest and yet  the petitioner claims interest<br \/>\nat the rate of 12% as well as the payment of wages for post award<br \/>\nperiod.\n<\/p>\n<p>\tIt<br \/>\nappears that the petitioner made claim for the said amount and<br \/>\nbenefits before the competent authority. The concerned authority<br \/>\nappears to have given reply by its communication dated 28.4.2008.<br \/>\nHowever, the petitioner, despite the communication dated 28.4.2008<br \/>\nseeks to allege on the basis of the communication dated 28.11.2005<br \/>\nthat his claim has been rejected and he has not been paid any amount<br \/>\nor benefit for the post award period until he was actually<br \/>\nreinstated.\n<\/p>\n<p>\tIt<br \/>\nis pertinent to note that the petitioner is referring to the<br \/>\ncommunication dated 28.11.2005, however, the petitioner is<br \/>\noverlooking the communication dated 28.4.2008 wherein, it is<br \/>\nmentioned and clarified that the payment of wages and other benefits<br \/>\nas were required to be paid in view of the judgment dated 25.7.2005<br \/>\nof this court for the period from 30.9.1985 to 28.4.2005 have been<br \/>\npaid to the petitioner. The said communication dated 28.4.2008 gives<br \/>\nout that the petitioner has been paid all benefits which were payable<br \/>\nfor the period from 30.9.1985 to 28.4.2005.\n<\/p>\n<p>\tUnder<br \/>\nthe circumstances, there does not appear to be any basis for<br \/>\npetitioner&#8217;s claim and\/or any justification to grant direction to the<br \/>\nrespondents as prayed for in present petition. However, if the<br \/>\npetitioner has any grievance regarding any alleged short payment,<br \/>\nthen, the petitioner may make necessary representation to the<br \/>\nconcerned authority, who may look into the representation of the<br \/>\npetitioner.\n<\/p>\n<p>\tAt<br \/>\nthis stage, Mr. Chaudhari for the petitioner submits that the<br \/>\npetitioner may be permitted to approach the labour court under<br \/>\nsection 33-C(2) for his claim. If even after the communication dated<br \/>\n28.4.2008, there is at all any claim then the petitioner may pursue<br \/>\nthe remedy available to him in accordance with law. However, present<br \/>\npetition for such claim, more particularly, after communication dated<br \/>\n28.4.2008, does not deserve to be entertained. Hence, present<br \/>\npetition is dismissed. Notice discharged.
