The\n\n :,j'msved  'V Commissioner for Workmexfs\n\n   Ciii\ufb02adurga claiming compensation. He\n\n     and as also Dr.Venkatashiva Raddy, the\n\n.   . 3 .  Surgeon.\n\n'  The respondents resisted the claim and examined<\/pre>\n
Vj  tsitness. It was contended by the respondents that in the<\/p>\n
3 sbsence of any complaint was and in View of the discrepancy in<\/p>\n

the description of the name of the ciaimant as ‘1’. Gnanaprakash
\nalias Prakash, there was doubt in the version of the <\/p>\n
xeganding otzcunence of the accident.<\/p>\n
4. Upon consideration of the    <\/p>\n
oral and documentary, the   <\/p>\n
accident arose out of and du1:’i;\u00a3g__the  of  *’<\/p>\n
Having regard to the evklence of
\nthat there was 35-4%;  due the injury
\nsu\ufb02ered by the claimant    Commissioner
\nasaessed the lossfof   the wages
\nearned by the?  per month and
\nhaving   found to be 35 years at
\nthe time of  the relevant factor, the<\/p>\n
amount ; ei’  was determined at Rs.1,05,755\/ ~.<\/p>\n
      the appellant-Insurance Company is<\/p>\n
  appeal.\n<\/p>\n

  'm renewed, the nature of disability sujtfered by<\/p>\n
  Vthe\ufb01claimant as a result of the compression fractun: of T–11<\/p>\n
 t. bm will certainly a\ufb01ect him in continuing his duty as a<\/p>\n
driver e\ufb01icicntly. Therefore, in the facts and circumstances of
\nthe case, the loss of earning capacity assessed V. <\/p>\n
Commissioner at 35% deserves to be reduced to  't -.   <\/p>\n
