Justice V.RAMKUMAR\n\n Dated :21\/12\/2010\n\n O R D E R\n                          V.RAMKUMAR, J.\n                      -------------------------------\n               Bail Application No.7944 of 2010\n           ------------------------------------------------------\n          Dated this the 21st day of December, 2010\n\n                                 ORDER\n<\/pre>\n<p>     Petitioners, who are accused Nos.1 and 3 in Crime<\/p>\n<p>No.1149\/2010 of Kunnikode Police Station for offences punishable<\/p>\n<p>under Sections 143, 147, 148, 452, 294(b), 506(ii) 354, 323 and<\/p>\n<p>427 read with Section 149 I.P.C., seek anticipatory bail.<\/p>\n<p>     2.     The learned Public Prosecutor opposed the application.<\/p>\n<p>     3.    After evaluating the factors and parameters             which<\/p>\n<p>are to be taken into consideration in the light of paragraph 122<\/p>\n<p>of the verdict      dated     2-12-2010        of the Apex Court      in<\/p>\n<p><a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of Maharashtra and<\/p>\n<p>Others<\/a> (2010(4) KLT 930), I am of the view that anticipatory<\/p>\n<p>bail cannot be granted in a case of this nature, since the<\/p>\n<p>investigating officer has not had the advantage of interrogating<\/p>\n<p>the petitioners.    But at the same time, I am inclined to permit<\/p>\n<p>the petitioners to surrender before the Investigating Officer for<\/p>\n<p>the purpose of interrogation and then to have their application<\/p>\n<p>for bail allowed      by the Magistrate or the Court              having<\/p>\n<p>jurisdiction.   Accordingly, the petitioners shall surrender before<\/p>\n<p><span class=\"hidden_text\">B.A.No.7944\/2010                2<\/span><\/p>\n<p>the investigating officer on 30.12.2010 or on 31.12.2010 for<\/p>\n<p>the purpose of interrogation and       recovery of incriminating<\/p>\n<p>material, if any. In case the investigating officer is of the view<\/p>\n<p>that   having regard to the facts of the case        arrest of the<\/p>\n<p>petitioners    is imperative he shall record his reasons for the<\/p>\n<p>arrest in the case diary as insisted in paragraph 129           of<\/p>\n<p>Siddharam Satlingappa Mhetre&#8217;s case (supra).                  The<\/p>\n<p>petitioners shall thereafter be produced before the Magistrate or<\/p>\n<p>the Court concerned and permitted to file an application for<\/p>\n<p>regular bail.      In case the interrogation of the petitioners is<\/p>\n<p>without arresting them, the petitioners shall thereafter appear<\/p>\n<p>before the Magistrate or the Court concerned        and apply for<\/p>\n<p>regular bail. The Magistrate or the Court on being satisfied that<\/p>\n<p>the petitioners have been interrogated by the police shall, after<\/p>\n<p>hearing the prosecution as well, release the petitioners on bail.<\/p>\n<p>      4. In case the petitioners while surrendering before the<\/p>\n<p>Investigating Officer have    deprived   the investigating officer<\/p>\n<p>sufficient time for interrogation, the officer shall complete the<\/p>\n<p><span class=\"hidden_text\">B.A.No.7944\/2010                 3<\/span><\/p>\n<p>interrogation   even if it is beyond the time limit fixed as above<\/p>\n<p>and submit a report to that effect        to the Magistrate or the<\/p>\n<p>Court concerned. Likewise, the Magistrate or the Court also will<\/p>\n<p>not be bound by the time limit fixed as above if sufficient time<\/p>\n<p>was not available after the production or appearance of the<\/p>\n<p>petitioners.\n<\/p>\n<p>      5.    The release of the petitioners shall be on each the<\/p>\n<p>petitioners executing a bond for Rs.15,000\/- (Rupees        fifteen<\/p>\n<p>thousand only) with two solvent sureties each for the like amount<\/p>\n<p>to the satisfaction of the Court concerned and subject to the<\/p>\n<p>following conditions:-\n<\/p>\n<blockquote><p>        1.    The petitioners    shall report before the<\/p>\n<p>              Investigating Officer between 9 a.m. and<\/p>\n<p>              11 a.m. on all Wednesdays.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>        2.     The petitioners shall make themselves<\/p>\n<p>              available    for   interrogation  including<\/p>\n<p>              custodial   interrogation  as   and   when<\/p>\n<p>              required by the Investigating Officer.<\/p>\n<p><span class=\"hidden_text\">B.A.No.7944\/2010                 4<\/span><\/p>\n<\/blockquote>\n<blockquote><p>        3.    Petitioners shall not influence or intimidate<\/p>\n<p>              the prosecution witnesses nor shall they<\/p>\n<p>              attempt to tamper with the evidence for<\/p>\n<p>              the prosecution.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>        4.    Petitioners shall not commit any offence<\/p>\n<p>              while on bail.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>         5.
