Justice S.SIRI JAGAN\n\n Dated :02\/07\/2008\n\n O R D E R\n                       S.SIRI JAGAN, J\n                ==================\n                W.P (C) .No. 18974 of 2008\n                ==================\n           Dated this the 2nd day of July, 2008.\n\n                      J U D G M E N T\n<\/pre>\n<p>     The petitioner obtained recognition from the NCTE for<\/p>\n<p>starting of TTC course in their institute by Ext.P2 order of<\/p>\n<p>the 1st respondent. Based on the same, the petitioner, by<\/p>\n<p>Ext.P3 letter, requested the respondents 2 and 3 to include<\/p>\n<p>the petitioner&#8217;s institute also in the list of institutes in the<\/p>\n<p>State to which admissions have to be made in the merit<\/p>\n<p>quota and to allot students in the merit seats for the year<\/p>\n<p>2008-2009.     Despite, Ext.P4 reminder, the petitioner&#8217;s<\/p>\n<p>request is not being considered is the contention raised by<\/p>\n<p>the petitioner. According to the petitioner, once the NCTE<\/p>\n<p>grants recognition, the respondents 2 to 5 cannot refuse to<\/p>\n<p>include the petitioner&#8217;s institute for the purpose of<\/p>\n<p>allotment of students in merit quota.           Therefore, the<\/p>\n<p>petitioner seeks the following reliefs:<\/p>\n<blockquote><p>          &#8220;a) issue a writ of mandamus, or any other writ,<br \/>\n     order or direction directing the respondents 2 to 4<\/p>\n<p><span class=\"hidden_text\">W.P (C) .No. 18974 of 2008       &#8211; 2 &#8211;<\/span><\/p>\n<p>     include the name of the Petitioner Institute in the list of<br \/>\n     Teacher&#8217;s Training Institutes of Kerala State.\n<\/p><\/blockquote>\n<blockquote><p>             b)    issue a writ of mandamus or any other<br \/>\n     appropriate writ order or directing the respondents 2 to 4<br \/>\n     to allot students in the government quota to the petitioner<br \/>\n     Institute for the academic year 2008-2009.&#8221;<\/p><\/blockquote>\n<p>     2. The learned Government Pleader opposes the<\/p>\n<p>prayers. According to him, if now the petitioner&#8217;s institute<\/p>\n<p>is included in the list it would cause difficulties for the<\/p>\n<p>Government as well as the students.\n<\/p>\n<p>     3. I have considered the rival contentions in detail.<\/p>\n<p>     4. It is not because of any fault on the part of the<\/p>\n<p>petitioner that their institute has not been included in the<\/p>\n<p>list.   By Ext.P5 judgment, based on the Supreme Court<\/p>\n<p>decision in <a href=\"\/doc\/1036462\/\">State of Maharashtra v. Sant Dnyaneshwar<\/p>\n<p>Shikshan Shastra Mahavidyalaya and Others<\/a> 2006(9)<\/p>\n<p>SCC 1, this Court directed the Government to include<\/p>\n<p>similar institutes in the list of institutes for allotment of<\/p>\n<p>students in the merit quota and to allot students pursuant<\/p>\n<p>there to. Therefore, I am satisfied that the petitioner is also<\/p>\n<p>entitled to similar reliefs.\n<\/p>\n<p><span class=\"hidden_text\">W.P (C) .No. 18974 of 2008     &#8211; 3 &#8211;<\/span><\/p>\n<p>      5.    Accordingly, I direct the respondents to grant<\/p>\n<p>approval to the petitioner&#8217;s institute pursuant to the<\/p>\n<p>recognition granted by the NCTE to conduct the course,<\/p>\n<p>during this academic year itself and to include them in the<\/p>\n<p>list of institutes for allotment of students in the merit quota.<\/p>\n<p>Consequently, the concerned Deputy Director shall allot<\/p>\n<p>students in merit quota for admission to the petitioner&#8217;s<\/p>\n<p>institute also from this academic year itself in accordance<\/p>\n<p>with the option made by the students.
