             This order will dispose of Civil Writ Petition Nos.16231 of<\/p>\n
2008 (Sawarn Singh and another                 Vs.    State of Haryana and<\/p>\n
others), and 20161 of 2008 (Karnail Singh Vs. State of Haryana<\/p>\n
and others). The issue raised in both the writ petitions is common<\/p>\n
and is concerning the recognition of a qualification acquired by<\/p>\n
person while serving in the Army. The facts are being taken from Civil<\/p>\n
Writ Petition No.16231 of 2008.\n<\/p>\n
             Petitioner No.1 joined the Army service after passing
\n CIVIL WRIT PETITION NO.16231 OF 2008                        :{ 2 }:\n<\/p>\n
matriculation examination, whereas petitioner No.2 was graduate<\/p>\n
when he joined the service. Subsequently, petitioner No.1 passed<\/p>\n
Intermediate Examination from the Board of High School and<\/p>\n
Intermediate Education (U.P.) and passed Bachelor of Commerce<\/p>\n
from Bundelkhand University in 1995. He has also completed one<\/p>\n
year degree course of Bachelor of Physical Education from<\/p>\n
Amarawati University. In November, 2004, he has passed Certificate<\/p>\n
in Teaching from Army Education Cops Training College & Centre<\/p>\n
Panchmarhi (M.P.). As per the petitioners, this certificate is equated<\/p>\n
with J.B.T.Course. Similarly, petitioner No.2 has also passed this<\/p>\n
Certificate in Teaching from AEC Training College & Centre,<\/p>\n
Panchmarhi on 28.2.2006. After discharge from Army, both the<\/p>\n
petitioners applied for post of J.B.T.Teacher in the State of Haryana.<\/p>\n
The petitioners were called for interview. They, however, were not<\/p>\n
selected on the ground that the petitioners did not possess the<\/p>\n
requisite valid qualification. Claiming that the teaching training<\/p>\n
certificate has been equated with J.B.T., the petitioners have filed<\/p>\n
this writ petition seeking their appointment after consideration and<\/p>\n
selection.\n<\/p>\n
             In the reply filed by the Commission, it is pointed out that<\/p>\n
the petitioners have done three months course at Army Education<\/p>\n
Corps Training College and Centre and the Primary Education<\/p>\n
Department of Haryana has not recognised this course equivalent to<\/p>\n
two years D.Ed.Course of Haryana State. The petitioners have<\/p>\n
accordingly been held ineligible for appointment. Similar is the stand<\/p>\n
taken by the State.\n<\/p>\n
             The counsel for the petitioners has made detailed
\n CIVIL WRIT PETITION NO.16231 OF 2008                       :{ 3 }:\n<\/p>\n
submissions and would vehemently argue that the degree\/certificate<\/p>\n
possessed by the petitioners have already been equated with the<\/p>\n
J.B.T. and hence the action of the respondents in not considering the<\/p>\n
petitioners as eligible is not justified. Mr.Rathee, on the other hand,<\/p>\n
would draw my attention to order passed in CWP 8882 of 1997,<\/p>\n
decided on 8.7.1997, copy of which is annexed with the reply as<\/p>\n
Annexure R-2. In view of the detailed discussion concerning the<\/p>\n
similar certificates, the submissions made by the counsel for the<\/p>\n
petitioners would not need any elaborate discussion. This issue has<\/p>\n
been duly considered by Division Bench of this court in CWP<\/p>\n
No.8882 of 1997 titled as Azad Singh & others Vs. State of Haryana<\/p>\n
& others and it has been held that the petitioners possessing similar<\/p>\n
certificates are not entitled to be considered for recruitment as J.B.T.<\/p>\n
Teachers. The decision of the Board in this regard was found to be<\/p>\n
not suffering from any error of law. The relevant observations of the<\/p>\n
Court are as under:-\n<\/p>\n
           “A look at the certificate issued in favour of petitioner-<\/p>\n
           Azad Singh shows that he had undergone training for a<\/p>\n
           short period of three months. At present the duration of<\/p>\n
           the JBT Diploma Course is two years. Earlier the duration<\/p>\n
           of this course was one year. Thus, there cannot be any<\/p>\n
           justification to treat the training course undergone by the<\/p>\n
           petitioners as equivalent to JBT Diploma. In any case, it is<\/p>\n
           not the function of the court to declare a particular<\/p>\n
           qualification as recognized even though the employer has<\/p>\n
           not taken such a decision. This issue has been<\/p>\n
           considered in Director, AIIMS & others V. Dr.Nikhil
\n CIVIL WRIT PETITION NO.16231 OF 2008                               :{ 4 }:\n<\/p>\n
           Tandon & others: (1996) 7 SCC 741. While accepting the<\/p>\n
           appeal filed by the employer on the issue of recognition of<\/p>\n
           qualification, the Supreme Court observed:-<\/p>\n<\/blockquote>\n
                 “The two years training at the Cambridge University<\/p>\n
                 undergone by the respondent while working for his<\/p>\n
                 Ph.D.cannot       be       treated     as     a    qualification<\/p>\n
                 recognized as equivalent to DM. Schedule 1 to the<\/p>\n
                 AIIMS      Recruitment        Rules         speaks     of        DM<\/p>\n
                 qualification    or    a    qualification     recognized          as<\/p>\n
                 equivalent thereto. It is not mere equivalence that is<\/p>\n
                 enough. It must also be recognized as equivalent.<\/p>\n
                 Recognized evide3ntly means recognized by the<\/p>\n
                 Institute or at least by the Medical Council of India.<\/p>\n
                 Admittedly,     neither      has      recognized      the        said<\/p>\n
                 research      work\/training     for     two    years        in    the<\/p>\n
                 Cambridge University as equivalent to DM.”<\/p>\n<\/blockquote>\n
<\/blockquote>\n
           The ratio of the judgment of the Supreme Court in the<\/p>\n
           afore mentioned case is directly attracted in the instant<\/p>\n
           case.”<\/p>\n
           In view of the law laid down by the Division Bench of this<\/p>\n
court in identical situation which is supported by the judgment of the<\/p>\n
Hon’ble Supreme Court, no case for interference in the writ petitions<\/p>\n
is made out.\n<\/p>\n
           The writ petitions are accordingly dismissed.<\/p>\n
