Magistrate,       Thiruvananthapuram       filed<\/p>\n
Crl.A.278\/2002   and   Crl.A.279\/2002     before<\/p>\n
second     Additional       Sessions      Court,<\/p>\n
Thiruvananthapuram.    Petitioner filed Exts.P2<\/p>\n
to P4 applications in the appeal to receive<\/p>\n
additional evidence, for     a direction to the<\/p>\n
complainant to produce his passport and also to<\/p>\n
examine additional witness.     When the learned<\/p>\n
Sessions Judge did not dispose those petitions,<\/p>\n
petitioner  filed    W.P.(C)15437\/2006   for   a<\/p>\n
direction to the Sessions Court to dispose<\/p>\n
W.P.(C)13180\/2009            2<\/span><\/p>\n
those     applications.     That   Writ  Petition   was<\/p>\n
disposed       under Ext.P5   judgment  on   26.8.2008,<\/p>\n
directing the Sessions Judge to dispose of the<\/p>\n
appeals as expeditiously as possible making it<\/p>\n
clear that before disposing the appeal the Sessions<\/p>\n
Judge     shall   consider all  pending   petitions  on<\/p>\n
merits and appropriate decision shall be taken on<\/p>\n
such petitions and      if the learned Judge feels that<\/p>\n
all petitions deserve to be allowed further action<\/p>\n
shall be taken before the appeal is disposed of.<\/p>\n
Thereafter petitioner again filed Exts.P6 to P8<\/p>\n
applications in the appeals which are also pending.<\/p>\n
This petition is filed under Article 227 of the<\/p>\n
Constitution of India to command the Additional<\/p>\n
Sessions       Judge to  consider  and  dispose     the<\/p>\n
applications before the     criminal appeals are taken<\/p>\n
up for hearing.\n<\/p>\n
       2.Learned counsel appearing for petitioner was<\/p>\n
heard.\n<\/p>\n
     3.    The argument of the learned counsel is that<\/p>\n

in the light of the directions given in Ext.P5,<\/p>\n
learned Sessions Judge is bound to hear the pending<\/p>\n
petitions before hearing the appeals and learned<\/p>\n
Sessions Judge is not justified in compelling the<\/p>\n
petitioner to argue the appeal before arguing the<\/p>\n
petitions and therefore necessary directions are to<\/p>\n
be issued.\n<\/p>\n
         4.     Ext.P5 judgment of this court establish<\/p>\n
that the said contention was already taken note of<\/p>\n
by this court and necessary directions were given.<\/p>\n
As is clear from Ext.P5, the said Writ Petition was<\/p>\n
also filed for a direction to the Sessions Judge to<\/p>\n
dispose of the petitions before hearing the appeal.<\/p>\n
The judgment of this court shows that respondents<\/p>\n
opposed that plea and contended that the two tier<\/p>\n
hearing      of   the  appeal  and  petitions  is  not<\/p>\n
necessary and after hearing the appeals and         the<\/p>\n
court can dispose the petitions as well as the<\/p>\n
appeals.         Learned  single  Judge  accepted  that<\/p>\n
submission and in paragraph 3 of the judgment<\/p>\n
W.P.(C)13180\/2009            4<\/span><\/p>\n
directed the Sessions Judge to dispose the appeals<\/p>\n
making it clear that while hearing the appeals all<\/p>\n
the petitions filed by the appellant are also to be<\/p>\n
heard and those petitions are also to be disposed<\/p>\n
before disposing the appeals.       It is clear that<\/p>\n
what was intended by this court is that the appeals<\/p>\n
as well as all pending petitions are to be heard.<\/p>\n
If on such hearing, learned Sessions Judge finds<\/p>\n
that any of those petitions are to be allowed,<\/p>\n
namely whether any additional evidence is to be let<\/p>\n
in or any additional document is to be summoned,<\/p>\n
then orders are to be passed to that effect and the<\/p>\n
judgment      in  the  appeal is  to  be  passed  only<\/p>\n
thereafter.       On the other hand, after hearing the<\/p>\n
appeals and the petitions, learned Sessions Judge<\/p>\n
finds that the applications are not to be allowed,<\/p>\n
then the learned Sessions Judge is competent to<\/p>\n
dismiss those applications and thereafter pronounce<\/p>\n
the judgment in the appeals.      In such circumstance<\/p>\n
I find no necessity to give any further direction.<\/p>\n
