     The questions involved in this Writ Petition are the<\/p>\n
following :\n<\/p>\n<\/p>\n
     (i)   Whether      the      District       Educational     Officer has<\/p>\n
           jurisdiction to exercise the power under Rule 7 of<\/p>\n
           Chapter III of the Kerala Education Rules ?<\/p>\n<\/blockquote>\n
     (ii)  Whether a punishment of censure could be imposed<\/p>\n
           on a Manager invoking jurisdiction under Rule 7 of<\/p>\n
           Chapter III of the Kerala Education Rules ?<\/p>\n<\/blockquote>\n
     (iii) Whether the penalty of censure could be imposed on<\/p>\n
           a Manager by exercising jurisdiction under Rule 65 of<\/p>\n
           Chapter XIVA of the Kerala Education Rules ?<\/p>\n<\/blockquote>\n
     (iv) Whether a punishment of censure could be imposed<\/p>\n
           on the Manager without affording an opportunity of<\/p>\n
           being heard ?<\/p><\/blockquote>\n

      2.   The petitioner is the Manager of the St.Thomas High<\/p>\n
School, Punnakkode. One Shibu Samuel filed an application to<\/p>\n
the Headmaster of St.Thomas High School, he being the Public<\/p>\n
Information Officer under the provisions of the Right to<\/p>\n
Information Act. It would appear that some of the informations<\/p>\n
sought for could not be given by the Public Information Officer<\/p>\n
(Headmaster). The Headmaster requested the Manager to give<\/p>\n
the necessary information. The Manager replied and provided<\/p>\n
the available information according to him.            Exhibit P8<\/p>\n
application dated 14.10.2009 was submitted by Shibu Samuel to<\/p>\n
the Public Information Officer, Office of the District Educational<\/p>\n
Officer, Kottarakara requesting to furnish certain information<\/p>\n
under the Right to Information Act. The District Educational<\/p>\n
Officer directed the Headmaster of the school and the Manager<\/p>\n
to furnish the information. The Headmaster submitted certain<\/p>\n
information on 28.1.2010. As per Exhibit P1 dated 19.2.2010,<\/p>\n
the District Educational Officer informed the Headmaster as well<\/p>\n
as the Manager that the information supplied was not<\/p>\n
satisfactory. The District Educational Officer directed the<\/p>\n
Manager and the Headmaster to give correct answers for<\/p>\n

question Nos.2 and 3. It would appear that on 22.2.2010, as per<\/p>\n
Exhibit P2, the Manager informed the District Educational<\/p>\n
Officer that he had directed the Headmaster to give the<\/p>\n
information.   On 20.2.2010, the Headmaster sent Exhibit P3<\/p>\n
letter to the Manager requesting him to furnish the necessary<\/p>\n
details. On 22.2.2010, as per Exhibit P4, the Manager sent reply<\/p>\n
to the Headmaster giving certain details.\n<\/p>\n<\/p>\n
     3.    The District Educational Officer, who is also the<\/p>\n
appellate authority, under the Right to Information Act, passed<\/p>\n
Exhibit P7 order dated 3.6.2010 imposing a penalty of censure<\/p>\n
on the Manager as well as the Headmaster, exercising the power<\/p>\n
under Rule 7(2) of Chapter III and Rule 65 of Chapter XIVA of<\/p>\n
the Kerala Education Rules and under Section 20 of the Right to<\/p>\n
Information Act.     No notice was issued by the District<\/p>\n
Educational Officer to the Manager before passing Exhibit P7<\/p>\n
order.   This Writ Petition is filed by the Manager to quash<\/p>\n
Exhibit P7 order.\n<\/p>\n<\/p>\n
     4.    Rule 7 of Chapter III KER provides for taking action<\/p>\n

against the Manager or educational agency in the event of<\/p>\n
mismanagement etc. Sub Rule I of Rule 7 reads as follows :<\/p>\n
                 “(1) In the event of mismanagement,<\/p>\n
           malpractice, corruption or maladministration,<\/p>\n
           gross negligence of duty, or disobedience of<\/p>\n
           Departmental instruction on the part of the<\/p>\n
           Manager [or denial of appointment to a<\/p>\n
           qualified thrown out teacher who has a rightful<\/p>\n
           claim for reappointment by virtue of his\/her<\/p>\n
           holding the post earlier or denial of promotion<\/p>\n
           to a teacher who is rightful claimant for<\/p>\n
           promotion by the Manager] [or conviction of<\/p>\n
           the Manager for an offence involving moral<\/p>\n
           turpitude] it shall be open to the Director, after<\/p>\n
           giving the Manager a reasonable opportunity to<\/p>\n
           show cause against the action proposed to be<\/p>\n
           taken and after due enquiry, to declare him<\/p>\n
           unfit to hold the office of Manager in the school<\/p>\n
           or in any other aided school and to require the<\/p>\n
           educational Agency to appoint a suitable<\/p>\n
           person as Manager.”\n<\/p><\/blockquote>\n
\n<\/blockquote>\n
Action proposed to be taken under Rule 7 is to declare the<\/p>\n

Manager unfit to hold the office of the Manager and to require<\/p>\n
the educational agency to appoint a suitable person as the<\/p>\n
Manager. A punishment of censure is outside the scope of Rule 7<\/p>\n
of Chapter III. The power under Rule 7 of Chapter III can be<\/p>\n
exercised only by the Director, going by the Rule. As per G.O.<\/p>\n
(P) No.52\/80 G.Edn. dated 7.5.1980, the powers of the Director<\/p>\n
under Rule 7 are delegated to the Deputy Director of Education<\/p>\n
as well.  The District Educational Officer is not an authority<\/p>\n
under Rule 7 of Chapter III. Therefore, the District Educational<\/p>\n
Officer was not justified in invoking the power under Rule 7 of<\/p>\n
Chapter III of Kerala Education Rules. Rule 7 provides for a<\/p>\n
reasonable opportunity to show cause against the action<\/p>\n
proposed to be taken. The District Educational Officer has not<\/p>\n
afforded an opportunity of being heard to the Manager. On that<\/p>\n
ground also, it is to be held that Exhibit P7 order, to that extent,<\/p>\n
is unsustainable.\n<\/p>\n<\/p>\n
     5.    The next question to be considered is whether a<\/p>\n
punishment of censure could be imposed on the Manager under<\/p>\n
Rule 65 of Chapter XIVA of the Kerala Education Rules. Rule 65<\/p>\n

of Chapter XIVA provides that the penalties mentioned therein<\/p>\n
may be imposed upon teachers of aided schools. One of the<\/p>\n
penalties in Rule 65 is censure. Rule 65 does not indicate that<\/p>\n
the penalty can be imposed under that Rule on the Manager.<\/p>\n
The jurisdiction under Rule 65 could not be exercised to impose<\/p>\n
a penalty on the Manager. Therefore, Exhibit P7 order imposing<\/p>\n
the penalty on the Manager, exercising jurisdiction under Rule<\/p>\n
65 of Chapter XIV A, is unsustainable.\n<\/p>\n<\/p>\n
     6.    Note 2 under Rule 65 of Chapter XIV A provides that<\/p>\n
no punishment shall be imposed without giving the person<\/p>\n
affected an opportunity to show cause against the action<\/p>\n
proposed to be taken. In the present case, the DEO has not<\/p>\n
given any such opportunity to the Manager. Therefore, Exhibit<\/p>\n
P7, to that extent also, is unsustainable.\n<\/p>\n<\/p>\n
     7.    The next question to be considered is whether Exhibit<\/p>\n
P7 is valid under Section 20 of the Right to Information Act. The<\/p>\n
penalty to be imposed under Section 20 of the Right to<\/p>\n
Information Act is Rs.250\/- for each day till the information is<\/p>\n

furnished. However, the total amount of such penalty shall not<\/p>\n
exceed 25,000\/- rupees. The authority under Section 20,<\/p>\n
exercising powers under Sub Section (2) of Section 20 would<\/p>\n
request for disciplinary action under the service rules.     The<\/p>\n
proviso to Sub Section (1) of Section 20 mandates that a<\/p>\n
reasonable opportunity of being heard should be given to the<\/p>\n
person concerned before any penalty imposed on him. Since the<\/p>\n
penalty contemplated under Section 20 of the Right to<\/p>\n
Information Act was not imposed and since no opportunity of<\/p>\n
being heard was given to the petitioner, Exhibit P7 order, to the<\/p>\n
extent to which the District Educational Officer exercised the<\/p>\n
power under Section 20 of the Right to Information Act, is bad.<\/p>\n
For the aforesaid reasons, Exhibit P7 is quashed. The District<\/p>\n
Educational Officer shall dispose of the matter afresh, confining<\/p>\n
the exercise of his power to Section 20 of the Right to<\/p>\n
Information Act, after affording an opportunity of being heard to<\/p>\n
the petitioner.    Since the District Educational Officer can<\/p>\n
exercise jurisdiction under Rule 65 of Chapter XIV A against the<\/p>\n
Headmaster, it is made clear that as against the Headmaster, the<\/p>\n
District Educational Officer would be competent to proceed<\/p>\n

under that Rule as well. Since Exhibit P7 is quashed on the<\/p>\n
ground that no opportunity of being heard was afforded to any of<\/p>\n
the parties, the District Educational Officer shall issue notice to<\/p>\n
the Manager and the Headmaster before passing any order<\/p>\n
against them.\n<\/p>\n<\/p>\n
     The Writ Petition is allowed as above.\n<\/p>\n<\/p>\n
