(ORAL)\n<\/pre>\n<p>             This appeal has been filed against the order of the ld.<\/p>\n<p>Lower Appellate Court reversing that of the Trial Court and<\/p>\n<p>thereby dismissing the suit of the appellant for declaration that<\/p>\n<p>the adverse remarks recorded by Superintendent of Police,<\/p>\n<p>Yamunanagar for a period of 7 months i.e. 26.07.2005 to<\/p>\n<p>31.03.2006 be expunged.          The appellant had challenged the<\/p>\n<p>following adverse remarks:\n<\/p>\n<p>i)     Disciple              :      Most Indiscipline<\/p>\n<p>ii)    Integrity             :      Doubtful<\/p>\n<p>iii)   Reliability           :      Un-reliable, leak out the secrecy<br \/>\n                                    of the Police Department<br \/>\n<span class=\"hidden_text\"> RSA No.4310 of 2009                                   -2-<\/span><\/p>\n<p>iv)   Moral Character      :    Doubtful<\/p>\n<p>v)    General Remarks      :     Most corrupt Head Constable,<br \/>\n                                mixed up with criminals collects<br \/>\n                                money from the smugglers of<br \/>\n                                illegal   wine,    wine   vendors,<br \/>\n                                smugglers of poppy husk and<br \/>\n                                from     criminal,    who    were<br \/>\n                                operating the satta in the area of<br \/>\n                                City Yamunanagar. Also collects<br \/>\n                                money. He wants his posting in<br \/>\n                                Police Station, Yamunanagar. He<br \/>\n                                is not fit for any key of post in<br \/>\n                                the Police Station.\n<\/p>\n<p>           Learned Trial Court held that no material was shown in<\/p>\n<p>the Court to justify the adverse remarks and consequently<\/p>\n<p>decreed the suit. In appeal, the ld. Lower Appellate Court took<\/p>\n<p>into consideration the fact that the representation of the<\/p>\n<p>appellant against the said remarks has been dismissed by the<\/p>\n<p>Deputy Inspector General of Police, Ambala Range after giving<\/p>\n<p>him opportunity of hearing.    Ld. Appellate Court also held that<\/p>\n<p>the jurisdiction of the Civil court in such matters is very limited<\/p>\n<p>and further that the Court was not entitled to substitute his own<\/p>\n<p>opinion for that of the competent authority.        The following<\/p>\n<p>questions have been proposed:\n<\/p>\n<blockquote><p>           1.Whether the ld. Trial Court was justified in quashing<\/p>\n<p>             the adverse remarks especially in the circumstances<\/p>\n<p>             when all authorities under whom the plaintiff-<\/p>\n<p>             appellant was working, appeared as witnesses and<\/p>\n<p>             testified that work and conduct of the plaintiff-<\/p>\n<p>             appellant was good and he has performed his duties<\/p>\n<p>             most honestly and diligently and there was no<\/p>\n<p>             material at all with the Superintendent of Police who<br \/>\n<span class=\"hidden_text\"> RSA No.4310 of 2009                                         -3-<\/span><\/p>\n<p>               had recorded adverse remarks in the confidential<\/p>\n<p>               report    of   the   period    from    26.07.2005        to<\/p>\n<p>               31.03.2006?\n<\/p><\/blockquote>\n<blockquote><p>             2.Whether    recording    adverse    remarks     regarding<\/p>\n<p>               honesty and integrity       without any material or<\/p>\n<p>               justification is liable to be sustained?<\/p>\n<\/blockquote>\n<blockquote><p>             3.Whether the approach of the ld. Appellate Court to<\/p>\n<p>               set aside the well reasoned judgment of the ld. Trial<\/p>\n<p>               Court on this ground alone that the Court should not<\/p>\n<p>               interfere in the administrative matters, is justified?<\/p>\n<p>             In my opinion, question No.3 is the seminal question.<\/p>\n<\/blockquote>\n<p>Ld. Lower Appellate Court has rightly held that what the Civil<\/p>\n<p>Court exercises is power of judicial review that is to see whether<\/p>\n<p>the administrative action complained of is based on extraneous<\/p>\n<p>consideration, is discriminatory or is ex facie arbitrary. Beyond<\/p>\n<p>that the Court has no jurisdiction to act as an Appellate Court. In<\/p>\n<p>the present case, no such findings about the action of the<\/p>\n<p>Superintendent of Police or IG have been recorded by the Trial<\/p>\n<p>Court. Consequently, the approach of the ld.
