{"id":62330,"date":"2011-03-09T00:00:00","date_gmt":"2011-03-08T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/quazi-bahabuddin-vs-dr-harisingh-gour-vishwavidyala-on-9-march-2011"},"modified":"2019-02-25T00:29:12","modified_gmt":"2019-02-24T18:59:12","slug":"quazi-bahabuddin-vs-dr-harisingh-gour-vishwavidyala-on-9-march-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/quazi-bahabuddin-vs-dr-harisingh-gour-vishwavidyala-on-9-march-2011","title":{"rendered":"Quazi Bahabuddin vs Dr. Harisingh Gour Vishwavidyala on 9 March, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Madhya Pradesh High Court<\/div>\n<div class=\"doc_title\">Quazi Bahabuddin vs Dr. Harisingh Gour Vishwavidyala on 9 March, 2011<\/div>\n<pre>                         W.P.No.16281\/2010\n\n\n Quazi Bahabuddin                Dr.Hari Singh Gour and Ors.\n\n\n\n\n9.3.2011\n       Shri Ajay Mishra, the learned Senior Advocate with Shri Khalid\nNoor Fakhruddin, counsel for the petitioner.\n       Shri Shobha Menon, the learned Senior Advocate with Shri\nRahul Choubey, Counsel for respondents.<\/pre>\n<p>       The petitioner has sought following reliefs:<br \/>\n       &#8220;(I)    To quash impugned order Annex.P\/1 dated<br \/>\n       23.09.2010 in which petitioner is at Sl.No.3.\n<\/p>\n<p>       (ii)    To hold that action of respondents 1,2 and 3 against<br \/>\n       petitioner is arbitrary, unjust, mala fide and against the law.\n<\/p>\n<p>       (iii)   That punishment given for misconduct be set<br \/>\n       aside\/quashed as it is very excessive also.\n<\/p>\n<p>       (iv)    That, petitioner be permitted to complete his MCA<br \/>\n       and appear in examinations.\n<\/p>\n<p>       (v)     That, special exams be taken of petitioner as next III<br \/>\n       semester is started by respondents.\n<\/p>\n<p>       (vi)    That, expenses of litigation and damage not less<br \/>\n       than 25 lakhs be given to petitioner for spoiling his career<br \/>\n       and putting stigma on him.\n<\/p>\n<p>       (vii)   That, action be taken against respondents for illegal<br \/>\n       acts; an enquiry be conducted against respondents.\n<\/p>\n<p>       (viii) Hon&#8217;ble Court may kindly grant any other relief in<br \/>\n       favour of petitioner which it seems fit and proper as per the<br \/>\n       facts and circumstances of the case together cost of the<br \/>\n       petition.&#8221;\n<\/p>\n<p>       The petitioner has challenged order Annexure P\/1 dated<br \/>\n23.9.2010 by which the petitioner&#8217;s examination of MCA 2nd Semester<br \/>\nof 2009-10 was cancelled and the petitioner was debarred for three<br \/>\nyears to appear in all the examinations conducted by the University;<br \/>\nand also he was made ineligible to appear in any examination of the<br \/>\nUniversity for next three years.\n<\/p>\n<p>       The return has been filed in the case.\n<\/p>\n<p>       The learned counsel for the petitioner at the outset submitted<br \/>\nthat the petitioner&#8217;s appeal (Annexure P\/5) is pending before the Vice-<br \/>\nChancellor of the respondent-University and the petitioner be<br \/>\npermitted to withdraw this petition and to press his appeal before the<br \/>\nVice Chancellor. Though it is stated by the respondents that this<br \/>\npetition was attested by the Notary on 22nd October, 2010 while the<br \/>\nappeal Annexure P\/5 was filed on 23.10.2010 and filing of the<br \/>\n                        W.P.No.16281\/2010<\/p>\n<p> Quazi Bahabuddin               Dr.Hari Singh Gour and Ors.\n<\/p>\n<p>aforesaid appeal itself is in doubt, but the fact is not disputed that<br \/>\nagainst the order Annexure P\/1, an appeal is provided to the Vice-<br \/>\nChancellor of the University.\n<\/p>\n<p>      In view of the aforesaid, prayer made by the petitioner is<br \/>\nallowed and the petitioner is permitted to withdraw this petition with<br \/>\nliberty to press appeal (Annexure P\/5) before the Vice-Chancellor of<br \/>\nthe respondents-University.\n<\/p>\n<p>      On filing an application for early hearing of the aforesaid appeal<br \/>\n(Annexure P\/5), the Vice-Chancellor shall consider and decide the<br \/>\naforesaid appeal expeditiously.\n<\/p>\n<p>      At this stage, it is submitted by the petitioner that some more<br \/>\ngrounds are available to the petitioner for assailing the order<br \/>\nAnnexure P\/1. So within a week from today, the petitioner be<br \/>\npermitted to submit some more grounds before the Vice-Chancellor in<br \/>\ncontinuation to earlier appeal Annexure P\/5.\n<\/p>\n<p>      The aforesaid prayer is opposed by Smt.
