{"id":62404,"date":"2010-05-19T00:00:00","date_gmt":"2010-05-18T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/vimla-bai-vs-nirmala-bai-on-19-may-2010"},"modified":"2019-01-23T00:39:14","modified_gmt":"2019-01-22T19:09:14","slug":"vimla-bai-vs-nirmala-bai-on-19-may-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/vimla-bai-vs-nirmala-bai-on-19-may-2010","title":{"rendered":"Vimla Bai vs Nirmala Bai on 19 May, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Madhya Pradesh High Court<\/div>\n<div class=\"doc_title\">Vimla Bai vs Nirmala Bai on 19 May, 2010<\/div>\n<pre>                           W.P.No.6702\/2010\n\n   Vimla Bai &amp; others                               Nirmala Bai &amp; others\n\n\n\n\n19.5.2010\n       Shri T.S.Ruprah, learned Senior Advocate with Shri Harmeet\nRuprah, counsel for petitioners.\n       This petition is directed against an order dated 8.4.2010 by the\nCivil Judge Class-I, Narsinghpur in civil suit no.20-A\/2005, by which\nan application filed by the petitioners under Order 18 Rule 17 C.P.C.,\nwas rejected.\n       Shri Ruprah, learned Senior Advocate for petitioners submitted\nthat earlier same application was filed by the petitioners which was\nrejected by the trial Court by order dated 22.7.2003, against which\npetitioners herein filed a petition before this Court, which was\nregistered as W.P.No.27721\/2003 and by order dated 15.12.2003\nAnnexure P-1,          the writ petition was allowed with following\ndirections :-\n                        \"Petitioners have filed this petition\n                challenging the order dt.22.7.2003, by which the\n                trial Court has rejected the application filed by\n                petitioners under Order 7 Rule 14(3) of C.P.C.\n                The aforesaid application has been rejected on\n                the ground that plaintiff has not filed aforesaid\n                documents along with the plaint and there is no\n                explanation for delay.\n\n                          From the perusal of order it appears that\n                the aforesaid documents were relied upon by the\n                plaintiff and defendants previous to this date has\n                already got inspected these documents. Though\n                there is delay in filing aforesaid documents, but\n                the trial has not commenced and both the\n                parties have not adduced any of the evidence.\n                The aforesaid document relates to payment of\n                rent alleged to be signed by defendants, (which\n                is disputed before me) and it has to be\n                considered by the trial Court. As the aforesaid\n                documents are necessary for the just decision of\n                the case, but the aforesaid prayer has been\n                made by the petitioners after a delay, in the\n                circumstances, the application deserves to be\n                allowed on costs.\n\n                         Considering the aforesaid, this petition is\n                allowed. The order dt.22.7.2003 passed by the\n                trial Court is set aside and the application filed by\n                the petitioners under Order 7 Rule 14(3) of\n                C.P.C., is allowed, subject to payment of costs of\n                           W.P.No.6702\/2010\n\n     Vimla Bai &amp; others                      Nirmala Bai &amp; others\n\n\n\n\n               Rs.1,000\/- (Rupees one thousand) by the\n               petitioners, payable before the next date of\n               hearing.\"\n\n        It is submitted by the petitioners that the cost was required to\nbe deposited before the trial Court on or before 20th January, 2004,\nwhich was the date fixed after the date of passing of order dated\n15.12.2003 by this Court, but due to inadvertence the cost could not\nbe deposited. However it was deposited on 2.5.2005. As the cost\nwas not deposited as fixed by this Court, petitioners herein moved\nanother application under Order 18 Rule 17 C.P.C., for production of\nsame documents, which were earlier produced by the petitioners by\nan application, which was rejected on 22.7.2003 by the trial Court.\nThe trial Court rejected the application only on the ground that earlier\nsimilar application was rejected and the cost, as directed by this Court\nwas not deposited by the petitioners. Hence the second application\nfiled for production of same documents was not maintainable and\naccordingly it was rejected.\n        Learned counsel for petitioners submitted that due to mistake\non the part of petitioners the cost could not be deposited. However it\nhas already been deposited on 2.5.2005, so time period be extended\nfor deposit of cost and the documents filed by the petitioners may be\nreceived in evidence.\n        Considering the short contention made by Shri Ruprah, learned\nSenior Advocate, we find it appropriate to dispose of the matter. In\nthe opinion of this Court it is not necessary to keep this matter\npending as the suit is pending since 25 years and it was also stated\nby Shri Ruprah that after 15.12.2003 till 2010 the matter remained\npending before the trial Court for consideration on various\ninterlocutory applications.\n        In view of aforesaid, this petition is finally disposed of with\nfollowing directions :-\n1.      Petitioners are directed to pay further cost of Rs.1,000\/-\n                            W.P.No.6702\/2010\n\n      Vimla Bai &amp; others                      Nirmala Bai &amp; others\n\n\n\n\n(Rupees one thousand only) to the respondents, which shall be paid<\/pre>\n<p>to the respondents on or before the next date fixed in the trial Court.\n<\/p>\n<p>2.       On deposit of aforesaid additional cost, the trial Court shall<br \/>\nreceive the documents produced by the petitioners, stated to be the<br \/>\nsame documents for which an application was rejected by the trial<br \/>\ncourt by order dated 22.7.2003.\n<\/p>\n<p>3.       The trial Court after receiving the documents in evidence shall<br \/>\nextend an opportunity to the other side for production of documents<br \/>\nand thereafter shall proceed, in accordance with law.\n<\/p>\n<p>4.
