It is further averred that on<br \/>\n\t7.8.2010, in the morning, Alpa told the petitioner that she wanted<br \/>\n\tto go to Surendranagar city to purchase clothes and other articles.<br \/>\n\tShe, therefore, left her home in the morning for going to<br \/>\n\tSurendranagar. It is further averred that till late night of<br \/>\n\t7.8.2010, his daughter Alpa did not return back at home and,<br \/>\n\ttherefore, he started inquiry with his relatives, but she could not<br \/>\n\tbe found. It is further averred that his son-in-law Arvind informed<br \/>\n\tthat Rajesh Babulal Shingana, respondent No.3 had abducted his<br \/>\n\tdaughter with the help of respondents No.4 to 7. It is his<br \/>\n\tapprehension that his daughter might have been illegally confined by<br \/>\n\trespondent No.3. It is also asserted that his daughter has no affair<br \/>\n\twith respondent No.3, but before two years, respondent No.3 had come<br \/>\n\tto his home with his son-in-law and, therefore, he acquainted with<br \/>\n\this daughter Alpa. Respondent No.3 has also stayed at his residence<br \/>\n\twith his son-in-law. It is also emphasized that respondent No.3<br \/>\n\tmight have compelled his daughter to marry with him against her wish<br \/>\n\tand she might have been illegally confined by respondent No.3 in<br \/>\n\tcollusion with respondents No.4 to 7. It is also averred in the<br \/>\n\tpetition that respondent No.3 to 7 are highhanded persons and they<br \/>\n\tare criminal minded and, therefore, his daughter may be tortured or<br \/>\n\tassaulted by respondent No.3 and, therefore, she is not safe.<br \/>\n\tTherefore, it is necessary to produce the corpus &#8211; Alpa before<br \/>\n\tthis Court with the help of police authorities. It is also<br \/>\n\temphasized that the petitioner had sent complaint by registered post<br \/>\n\tin the City police station, Surendranagar to respondent No.2 along<br \/>\n\twith a copy to the District Superintendent of Police, Surendranagar.<br \/>\n\tHowever, till today, police have not taken any appropriate steps for<br \/>\n\tthe same. In sum and substance, the averment is made in the petition<br \/>\n\tthat the daughter Alpa is in illegal detention of respondent No.3<br \/>\n\tand, therefore, prayed for the relief, to which reference has been<br \/>\n\tmade in the earlier paragraph of this order.\n<\/p>\n<p>This<br \/>\n\tCourt vide order dated 20.09.2010 issued notice to respondents No.1,<br \/>\n\t2 and 3, which was made returnable on 04.10.2010, on condition that<br \/>\n\tthe petitioner shall deposit Rs.5000\/- as cost  with the Registry of<br \/>\n\tthis Court within three days. It was also directed to respondent<br \/>\n\tNo.2 to produce the corpus &#8211; Alpa, daughter of the petitioner,<br \/>\n\twho is allegedly in illegal detention of respondent No.3, before<br \/>\n\tthis Court  on the returnable date.\n<\/p>\n<p>Mr.L.B.Dabhi,<br \/>\n\tlearned APP for respondent &#8211; State of Gujarat states that<br \/>\n\tpursuant to the aforesaid direction, Ms.J.N.Sukhanandi, PSI,<br \/>\n\tSurendranagar city police station has traced out the corpus  and<br \/>\n\tproduced the corpus &#8211; Alpa before this Court. Corpus &#8211;<br \/>\n\tAlpa is also accompanied by respondent No.3 &#8211; Rajesh Babulal<br \/>\n\tShingana.\n<\/p>\n<p>We<br \/>\n\thave ascertained her wish and willingness and also inquired whether<br \/>\n\tshe is in illegal detention of respondent No.3 or not. In reply to<br \/>\n\tthe same, she has in unequivocal terms stated before us that she has<br \/>\n\tlawfully performed marriage with respondent No.3 on 8.6.2010 at<br \/>\n\tRajkot and the said marriage is also registered before the Registrar<br \/>\n\tof Marriage, Rajkot. She further states that at present she is happy<br \/>\n\tin her matrimonial life with respondent No.3. Her husband has also<br \/>\n\taccompanied her, who is personally present before the Court. She is<br \/>\n\tresiding with him and she continues to reside with him.\n<\/p>\n<p>So<br \/>\n\tfar as her age is concerned, her date of birth is 7.10.1988.<br \/>\n\tTherefore, she is aged about 22 years, which is also not disputed by<br \/>\n\tthe petitioner.\n<\/p>\n<p>In<br \/>\n\tGian Devi vs. The  Superintendent,<br \/>\n\tNari Niketan, Delhi and others, (1976) 3 SCC 234,<br \/>\n\tSupreme<br \/>\n\tCourt has ruled out that the girl having crossed 18 years of age, is<br \/>\n\tsui juris and hence no fetters can be placed upon her choice of the<br \/>\n\tperson with whom she is to<br \/>\n\tstay.\n<\/p>\n<p>\tIn<br \/>\n\tview of this, since the corpus &#8211; Alpa is sui juris and, hence,<br \/>\n\tno fetters can be placed upon her choice of the person with whom she<br \/>\n\tis to stay.\n<\/p>\n<p>\tIn<br \/>\n\tview of the aforesaid circumstances and more particularly the<br \/>\n\tstatement made by corpus &#8211; Alpa Merambhai Valaniya, it cannot<br \/>\n\tbe said that she is in illegal detention of respondent No.3, as she<br \/>\n\tis lawfully wedded wife of respondent No.3 and she wants to continue<br \/>\n\tto reside with. Since she is sui juris, we permit her to go with the<br \/>\n\tperson of her choice.\n<\/p>\n<p>\tSeen<br \/>\n\tin the above context, the instant petition seeking writ of Habeas<br \/>\n\tCorpus, lacks merit and deserves to be rejected.\n<\/p>\n<p>\tAt<br \/>\n\tthis stage, Mr.A.B.Gateshaniya, learned advocate for the petitioner,<br \/>\n\tupon instructions from the petitioner, who is personally present<br \/>\n\tbefore this Court, does not press this petition and seeks leave to<br \/>\n\twithdraw the same.\n<\/p>\n<p>\tMr.L.B.Dabhi,<br \/>\n\tlearned APP, for respondent No.1 and Mr.Pravin Gondaliya, learned<br \/>\n\tadvocate for respondent No.3, have no objection, if the leave as<br \/>\n\tprayed for is granted.\n<\/p>\n<p>\tHence,<br \/>\n\tthe petition stands rejected as it is not pressed and withdrawn.\n<\/p>\n<p>\tThis<br \/>\n\tCourt has issued notice on condition that the petitioner shall<br \/>\n\tdeposit an amount of Rs.5000\/- with the Registry of this Court.  As<br \/>\n\tper the averment made in the petition, the petitioner was very well<br \/>\n\taware about the relationship between her daughter and respondent<br \/>\n\tNo.3 through his son-in-law Arvind.
