Mr. K.L.Pandya,<br \/>\nlearned APP waives service of Rule on behalf of the respondent.\n<\/p>\n<p>2.\tThis is an application<br \/>\nfor anticipatory bail under Section 438 of the Code of Criminal<br \/>\nProcedure in connection with the FIR bearing CR No. I-18 of<br \/>\n2011 registered with  Gandhigram Police Station, for the offences<br \/>\npunishable under Sections 406, 420 and 120(B) of the IPC.\n<\/p>\n<p>3.<br \/>\nHeard Mr.A.M.Dagli, learned counsel for the applicant. Mr.Dagli has<br \/>\nsubmitted that investigation<br \/>\nis over and charge sheet is filed.\n<\/p>\n<p> It is further submitted that person in whose account amount was<br \/>\ndeposited had committed suicide and even after investigation is over,<br \/>\nno other material is surfaced<br \/>\nlinking the applicant with the crime alleged or he has not received<br \/>\nany monetary benefit.  It is further submitted that considering the<br \/>\nnature of allegations and role attributed to the applicant, by<br \/>\nimposing suitable conditions,  the applicant may be enlarged on bail.\n<\/p>\n<p>4.\tHeard<br \/>\nMr. K.L.Pandya, learned APP for the respondent State. Mr.Pandya has<br \/>\nvehemently opposed the present application.\n<\/p>\n<p>5.\tHaving heard learned<br \/>\ncounsel for the parties and perusing the record of the case and<br \/>\ntaking into consideration the facts of the case, I am inclined to<br \/>\ngrant anticipatory bail to the applicant. This Court has also taken<br \/>\ninto consideration the law laid down by the Apex Court in the case of<br \/>\n<a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of Maharashtra &amp; Ors.,<\/a><br \/>\nreported in (2011) 1 SCC 694, wherein the Apex Court reiterated<br \/>\nthe law laid down by the Constitutional Bench in the case of Shri<br \/>\nGurubaksh Singh Sibbia &amp; Ors., reported in (1980) 2 SCC 565.\n<\/p>\n<p>6.\tThe application is<br \/>\nallowed. The applicant is granted anticipatory bail in the event of<br \/>\nhis arrest in connection with CR No. I-18 of 2011 registered<br \/>\nwith  Gandhigram Police Station for the offences as alleged in FIR on<br \/>\nhis executing a bond of Rs.10,000\/- [Rupees Ten thousand only] with<br \/>\none surety of the like amount on the following conditions that he<br \/>\nshall:\n<\/p>\n<p>[a]\tco-operate with the<br \/>\ninvestigation and make himself available for interrogation whenever<br \/>\nand wherever required.\n<\/p>\n<p>[b]\tshall remain present<br \/>\nat the concerned Police Station on 30.9.2011 at 11.00 AM ;\n<\/p>\n<p>[c]\tshall not hamper the<br \/>\ninvestigation in any manner nor shall directly or indirectly make any<br \/>\ninducement, threat or promise to any person acquainted with the facts<br \/>\nof the case so as to dissuade him from disclosing such facts to the<br \/>\nCourt or to any police officer;\n<\/p>\n<p>[d]\tat the time of<br \/>\nexecution of bond, furnish him residential address to the<br \/>\ninvestigating officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>[e]\tnot leave State of<br \/>\nGujarat without the permission of the Court and, if holding a<br \/>\npassport, he shall surrender the same before the Trial Court within a<br \/>\nweek;\n<\/p>\n<p>[f]\tnot obstruct or hamper<br \/>\nthe police investigation and not play mischief with the evidence<br \/>\ncollected or yet to be collected by the police;\n<\/p>\n<p>7.\tIt would be open to the<br \/>\nInvestigating Officer to file an application for remand if he<br \/>\nconsiders it proper and just; and the competent Court would decide it<br \/>\non merits.\n<\/p>\n<p>8.\tAt the trial, the Trial<br \/>\nCourt shall not be influenced by the observations of preliminary<br \/>\nnature, qua the evidence at this stage, made by this Court while<br \/>\nenlarging the applicant on bail.\n<\/p>\n<p>9.\tThe applicant is<br \/>\npermitted to obtain regular bail as per the established provision of<br \/>\nlaw, within suitable time.\n<\/p>\n<p>10.\tRule made absolute.\n<\/p>\n<p>Direct service is permitted.\n<\/p>\n<p>   (Z.K.SAIYED, J.)<\/p>\n<p>kks<\/p>\n<p>&gt;
