RAVIKUMAR, J.\n                 ----------------------------------------\n                  WP (C) NO. 16933 of 2010\n                 ----------------------------------------\n             Dated this the 1st day of June, 2010\n\n                        J U D G M E N T\n<\/pre>\n<p>     The petitioner is a High School Assistant in Social<\/p>\n<p>Science,      presently            working         at    S.N.D.P.H.S.S.,<\/p>\n<p>Udayamperoor.       As per Exhibit P1 the petitioner was<\/p>\n<p>ordered to be transferred and posted to S.N.D.P.H.S.S.,<\/p>\n<p>Adimaly.    This writ petition has been filed challenging<\/p>\n<p>Exhibit P1 order of transfer.\n<\/p>\n<p>     2. Essentially, the contention of the petitioner is that<\/p>\n<p>Exhibit P1 order has been issued in violation of Rule 10 of<\/p>\n<p>Chapter XIV A of the Kerala Education Rules. According to<\/p>\n<p>the petitioner, it is the violation of the seniority norms that<\/p>\n<p>resulted in his transfer.        A scrupulous adherence to the<\/p>\n<p>norms of transfer as provided under Rule 10 would have<\/p>\n<p>avoided the    transfer of the petitioner.                 It is further<\/p>\n<p>contended that the norms of transfer have been violated<\/p>\n<p>solely for the purpose of favouring the 3rd respondent.<\/p>\n<p>     3. A perusal of Rule 10 of Chapter XIV A would reveal<\/p>\n<p>WP (C) NO. 16933 of 2010<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>that, the order of transfer passed by the Educational Agency<\/p>\n<p>is appealable before the Director of Public Instructions in<\/p>\n<p>terms of sub rule 5 thereunder. Since Exhibit P1 order is<\/p>\n<p>appealable in terms of Sub rule 5 of Rule 10 of Chapter XIV<\/p>\n<p>A, without making any observation as to the merits of the<\/p>\n<p>contentions of the petitioner this writ petition is disposed of<\/p>\n<p>granting liberty to the petitioner to avail the remedy<\/p>\n<p>available under Sub rule 5 of Rule 10 of Chapter XIV A. In<\/p>\n<p>case the petitioner files an appeal as provided thereunder,<\/p>\n<p>to the concerned appellate authority under the Rule, within<\/p>\n<p>a period of one week from today the same shall be<\/p>\n<p>considered and appropriate orders shall be passed there on<\/p>\n<p>expeditiously, within a period of six weeks with notice to the<\/p>\n<p>petitioner and respondent nos. 2 and 4.<\/p>\n<p>       This writ petition is disposed of, accordingly.<\/p>\n<p>                                           C.T.
