No. 44 of 2009\n                 ---------------------------------------------------\n             Dated this the 21st day of January, 2009.\n\n                                     ORDER\n<\/pre>\n<p>           Petition for anticipatory bail.\n<\/p>\n<p>           2. The alleged offences are under Sections                   143,<\/p>\n<p>147, 148, 447, 341, 323, 326 and 149 of IPC. According to<\/p>\n<p>prosecution,   petitioners (A1 to A3) in furtherance of common<\/p>\n<p>intention assaulted de facto complainant and caused fracture to<\/p>\n<p>the nasal bone and other injuries.\n<\/p>\n<p>           3. Learned counsel for                 petitioners submitted that<\/p>\n<p>petitioners have not committed any offence, as alleged. There<\/p>\n<p>was a push and pull and, in the meantime, de facto complainant<\/p>\n<p>had fallen down and sustained fracture to nasal bone.                      The<\/p>\n<p>incident happened because of some other reason. De facto<\/p>\n<p>complainant was constructing a commercial flat in the adjacent<\/p>\n<p>building where piling was going on and as a result,                   the small<\/p>\n<p>house of petitioner          collapsed. In spite of this, de facto<\/p>\n<p>complainant    continued         the work and though representations<\/p>\n<p>were made by petitioner before the authorities nobody heeded<\/p>\n<p>to the grievances.\n<\/p>\n<p><span class=\"hidden_text\">[B.A.No.44\/09]                    2<\/span><\/p>\n<p>      The de facto complainant approached this Court for police<\/p>\n<p>protection, which was denied by making certain observations<\/p>\n<p>against de facto complainant stating that he may move the civil<\/p>\n<p>court, if so advised.     He    did not move the civil court but<\/p>\n<p>continued with the piling work so as to create problem to the<\/p>\n<p>peaceful living of petitioners     in the partly destructed house.<\/p>\n<p>Because of this, there was some altercation and an unfortunate<\/p>\n<p>incident happened. The charge-sheet has already been filed and<\/p>\n<p>if petitioners surrender before Magistrate Court it is likely that<\/p>\n<p>they will be remanded and hence this petition.<\/p>\n<p>            4. Learned Public Prosecutor submitted that 4th<\/p>\n<p>petitioner is not an accused in this case.    The other petitioners<\/p>\n<p>are accused nos.1 to 3. Charge-sheet has already been laid and<\/p>\n<p>police does not require petitioners for investigation.     He also<\/p>\n<p>submitted that he has no objection in granting anticipatory bail to<\/p>\n<p>petitioners in the peculiar facts and circumstances of the case.<\/p>\n<p>      On hearing both sides, I am satisfied that anticipatory bail<\/p>\n<p>can be granted to petitioners on conditions. Hence, the following<\/p>\n<p>order is passed:\n<\/p>\n<blockquote><p>     1) The prayer for anticipatory bail by 4th petitioner is<\/p>\n<p>          rejected as infructuous.<\/p>\n<blockquote><p><span class=\"hidden_text\">[B.A.No.44\/09]                       3<\/span><\/p>\n<\/blockquote>\n<blockquote><p>     2) Petitioners      1 to 3 shall surrender before the<\/p>\n<p>         Magistrate Court concerned and they shall be<\/p>\n<p>         released on bail in the event of their arrest on their<\/p>\n<p>         executing bond for Rs.10,000\/- each with two solvent<\/p>\n<p>         sureties each for the like to the satisfaction of learned<\/p>\n<p>         Magistrate on the following conditions:<\/p>\n<\/blockquote>\n<blockquote><p>              i) Petitioners shall not commit any offence<\/p>\n<p>                while on bail and in case of breach of this<\/p>\n<p>                condition, bail is liable to be cancelled.<\/p>\n<\/blockquote>\n<\/blockquote>\n<blockquote><p>      Petition is allowed.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                                              K.
