M. SAHAI)<\/p>\n<p>\t\tWe<\/a><br \/>\nhave heard Mr. H. S. Munshaw, learned counsel appearing for the<br \/>\nappellant.\n<\/p>\n<p>2.\t\tThis<br \/>\nIntra-Court Letters Patent Appeal has been filed challenging the<br \/>\njudgment and order dated 29.06.2011 passed by the learned single<br \/>\nJudge in Special Civil Application No.7918 of 2011 and the award of<br \/>\nthe Labour Court, Bhavnagar dated 15.11.2010 passed in Reference<br \/>\n(LCB) No.606 of 1989 by which the Labour Court has directed<br \/>\nreinstatement of the respondent workman with continuity of service<br \/>\nwith all consequential benefits.  The learned Single Judge has found<br \/>\nthat the award of the Labour Court was justified in the facts and<br \/>\ncircumstances of the case.\n<\/p>\n<p>3.\t\tLearned<br \/>\ncounsel Mr. H.S. Munshaw has vehemently urged that the Learned Single<br \/>\nJudge has failed to properly read and appreciate the appointment<br \/>\norders as the same were time bound.   Furthermore, the respondent had<br \/>\nworked only for 63 days and hence, there was no question of producing<br \/>\nany Muster Roll.  He further urged that the observations made by the<br \/>\nLearned Single Judge in paragraph 6 of the impugned order are<br \/>\nuncalled for and the same may be expunged.\n<\/p>\n<p>4.\t\tWe<br \/>\nare of the view that earlier the Labour Court allowed the reference<br \/>\nby award dated 18.10.2003.  The said award was challenged by the<br \/>\nappellant by preferring Special Civil Application No.3290 of 2004.<br \/>\nThe Learned Single Judge allowed the said writ petition and remanded<br \/>\nthe matter back to the Labour Court for fresh decision.  Thereafter,<br \/>\nthe Officer of the appellant Corporation did not produce any relevant<br \/>\nadditional evidence.  Hence, this Court does not find any justifiable<br \/>\nground to interfere with the impugned judgment and order passed by<br \/>\nthe Learned Single Judge as well as the award passed by the Labour<br \/>\nCourt.  This appeal is devoid of any merits and is accordingly<br \/>\ndismissed.\n<\/p>\n<p>5.\t\tIn<br \/>\nview of disposal of appeal, Civil Application also does not survive<br \/>\nand is accordingly dismissed.\n<\/p>\n<p>\t\t\t\t\t\t\t\tSd\/-\n<\/p>\n<p>\t\t\t\t\t\t\t[V.
