JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 23\/06\/2011  \nORAL ORDER<\/pre>\n<p>1.\tThis<br \/>\npetition under Article 226 of the Constitution of India has been<br \/>\nfiled, with the following prayers :\n<\/p>\n<p>&#8220;(A)\tYour<br \/>\nLordships may kindly be pleased to admit and allow this petition.\n<\/p>\n<p>(B)\tYour<br \/>\nLordships may kindly be pleased to issue a Writ of Mandamus and\/or<br \/>\nany other appropriate writ, order or<br \/>\ndirection to direct the respondents to grant the benefits of<br \/>\nregularization, pay scales, increments, benefits of pay commissions<br \/>\nto employees shown at Annexure-A to this petition from their initial<br \/>\nappointments.\n<\/p>\n<p>(C)\tYour<br \/>\nLordships may kindly be pleased to issue a Writ of Mandamus and\/or<br \/>\nany other writ, order or direction<br \/>\nto direct the respondent No.1 to grant sanction\/approval for<br \/>\nextending the benefits to the employees of respondent No.2 and 3 at<br \/>\nannexure A from the date of their initial appointment.\n<\/p>\n<p>(D)\tDuring<br \/>\nthe pendancy of this petition Your Lordships may kindly be pleased to<br \/>\ndirect the respondents to extend the benefits of regularization to<br \/>\nthe employees shown at annexure A to this petition.&#8221;\n<\/p>\n<p>2.\tHeard<br \/>\nMr.N.D.Songara, learned counsel for the petitioner, Mr.Maulik G.<br \/>\nNanavati, learned Assistant Government Pleader for respondent No.1<br \/>\nand Mr.Deepak Sanchela, learned advocate for respondent No.2 and<br \/>\nperused the averments made in the petition and the material on<br \/>\nrecord.\n<\/p>\n<p>3.\tAt<br \/>\nthis stage, Mr.N.D.Songara, learned counsel for the petitioner states<br \/>\nthat the petitioner may be permitted to make a representation to<br \/>\nrespondent No.2 and the said respondent may be directed to consider<br \/>\nand decide the same.\n<\/p>\n<p>4.\tUpon<br \/>\nthe above statement being made by the learned counsel for the<br \/>\npetitioner, the following order is passed :\n<\/p>\n<p>\tThe<br \/>\npetitioner is permitted to make a representation to respondent No.2.<br \/>\nIf such a representation is made, respondent No.2 may consider and<br \/>\ndecide the same, in accordance with law, as expeditiously as<br \/>\npossible.\n<\/p>\n<p>\tIt<br \/>\nis made clear that while passing this order, the Court has not<br \/>\nentered into the merits of the case.\n<\/p>\n<p>\tThe<br \/>\npetition is disposed of, in the above terms.\n<\/p>\n<p>\tNotice<br \/>\nis discharged.
