THAKKER\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<\/p>\n<p>(Arising out of SLP(CRL) No. 5006\/2003)<\/p>\n<p>ARIJIT PASAYAT, J<\/p>\n<p>\tLeave granted.\n<\/p>\n<p>\tThe appellant was convicted for offence punishable under Section 307 of<br \/>\nthe Indian Penal Code, 1860 (in short the &#8216;IPC&#8217;)  and sentenced  to undergo<br \/>\nrigorous imprisonment for ten years and to pay a fine of Rs.5,000\/- with default<br \/>\nstipulation.  It was further directed that in case the fine was deposited, an amount<br \/>\nof Rs. 2,000\/- was to be paid to the injured person as compensation.  One Rao<br \/>\nSaheb Nagorao Khose also faced trial under Section 307 read with Section 109<br \/>\nIPC.  He was acquitted by the Trial Court. But appellant&#8217;s appeal before the<br \/>\nBombay High Court, Aurangabad Bench did not bring any relief to the appellant.\n<\/p>\n<p>\tProsecution version as unfolded during trial is as follows:\n<\/p>\n<p>Accused Bappa alias  Bapu (A-1) alongwith  Bibhishan (PW-10) had gone<br \/>\nto cinema to witness a movie and were coming back by bicycle. Suddenly the<br \/>\nappellant got down from the bicycle and stabbed Bibhishan on his stomach and<br \/>\nback and started to press his neck.  Hearing his cries for help some villagers came<br \/>\nrunning. The accused tried to run away from the spot but was caught by the<br \/>\nvillagers and handed over to the police.  Victim was taken to the hospital.  Two<br \/>\nother persons, one of whom, namely, Rajabhau, as noted above, was charged for<br \/>\ncommission of offence punishable under Section 307 read with Section 109 IPC.<br \/>\nOn the basis of the first information report lodged, investigation was undertaken<br \/>\nand charge-sheet was placed.  On consideration of the evidence on record, more<br \/>\nparticularly that of the victim, learned Assistant Sessions Judge found the<br \/>\nappellant guilty of offence punishable under Section 307 IPC, and sentenced him<br \/>\nto undergo rigorous imprisonment for 10 years and to pay a fine of Rs.5,000\/-<br \/>\nwith default stipulation.  The accused preferred an appeal before the Bombay<br \/>\nHigh Court, Aurangabad Bench. The same was dismissed by the impugned<br \/>\njudgment.\n<\/p>\n<p>\tAccording to the learned counsel for the appellant, keeping in view the<br \/>\nnature of the injuries sustained, the offence cannot be said to be one covered by<br \/>\nSection 307 IPC but one relatable to Section 324 or Section 326 IPC.<br \/>\nAlternatively it was submitted that the custodial sentence of 10 years as has been<br \/>\nimposed is harsh.\n<\/p>\n<p>\tLearned counsel for the State on the other hand submitted that the trial<br \/>\nCourt and the High Court have analysed the factual position in detail, and the<br \/>\naccused has been rightly convicted for offence punishable under Section 307 IPC.<br \/>\nKeeping in view the nature of the injuries sustained, it cannot be said that the<br \/>\nsentence is excessive.\n<\/p>\n<p>\tSection 307 IPC reads:\n<\/p>\n<p>&#8220;Attempt to murder &#8211; Whoever does any act with such<br \/>\nintention or knowledge, and under such circumstances<br \/>\nthat, if he by that act caused death, he would be guilty of<br \/>\nmurder, shall be punished with imprisonment of either<br \/>\ndescription for a term which may extend to ten years, and<br \/>\nshall also be liable to fine; and if hurt is caused to any<br \/>\nperson by such act, the offender shall be liable either to<br \/>\nimprisonment for life, or to such punishment as is<br \/>\nhereinbefore mentioned.&#8221;\n<\/p>\n<p>\tIt is sufficient to justify a conviction under Section 307 if there is present<br \/>\nan intent coupled with some overtact in execution thereof.  It is not essential that<br \/>\nbodily injury capable of causing death should have been inflicted.  Although the<br \/>\nnature of injury actually caused may often give considerable assistance in coming<br \/>\nto a finding as to the intention of the accused, such intention may also be deduced<br \/>\nfrom other circumstances, and may even, in some cases, be ascertained without<br \/>\nany reference at all to actual wounds. The Sections makes a distinction between<br \/>\nthe act of the accused and its result, if any.  The Court has to see whether the act,<br \/>\nirrespective of its result, was done with the intention or knowledge and under<br \/>\ncircumstances mentioned in the Section.  An attempt in order to be criminal need<br \/>\nnot be the penultimate act. It is sufficient in law, if there is present an intent<br \/>\ncoupled with some overt act in execution thereof.\n<\/p>\n<p>\t<a href=\"\/doc\/1308077\/\">In Sarju Prasad v. State of Bihar (AIR<\/a> 1965 SC 843)  it was observed that<br \/>\nthe mere fact that the injury actually inflicted by the accused did not cut any vital<br \/>\norgan of the victim, is not itself sufficient to take the act out of the purview of<br \/>\nSection 307 IPC.\n<\/p>\n<p>The above position was highlighted in <a href=\"\/doc\/384160\/\">State of Maharashtra v. Balram<br \/>\nBama Patil and Ors.<\/a> (1983 (2) SCC 28), <a href=\"\/doc\/1224357\/\">Girija Shankar v. State of U.P. (JT<\/a> 2004<br \/>\n(2) SC 140) and <a href=\"\/doc\/1930505\/\">Vasant Vithu Jadhav  v. State of Maharashtra<\/a>  (2004 AIR SCW<br \/>\n1523).\n<\/p>\n<p>\tIn view of the aforesaid analysis the accused appellant has been rightly<br \/>\nconvicted for offence punishable under Section 307 IPC.\n<\/p>\n<p>The residual question is whether a sentence of 10 years rigorous<br \/>\nimprisonment is justified.  No doubt, as noticed by the trial court and the High<br \/>\nCourt, injuries inflicted on the victim were of serious nature.
