RTI \u00a0 request \u00a0 dated \u00a0 5.10.2009 \u00a0 was \u00a0 preferred \u00a0 by \u00a0 the \u00a0 appellant \u00a0 Shri \u00a0 M.\u00a0<br \/>\nPadmanabhan\u00a0vide\u00a0which\u00a0he\u00a0sought\u00a0information\u00a0from\u00a0the\u00a0CPIO,\u00a0Kendriya\u00a0Vidyalaya\u00a0<br \/>\nSangthan,\u00a0New\u00a0Delhi\u00a0regarding\u00a0 \u00a0the\u00a0sub\u00adpara\u00a0of\u00a0Para.8\u00a0of\u00a0KVS\u00a0Transfer\u00a0Guidelines\u00a0<br \/>\nunder\u00a0which\u00a0he\u00a0had\u00a0been\u00a0transferred\u00a0along\u00a0with\u00a0copies\u00a0of\u00a0documents\u00a0pertaining\u00a0\u00a0to\u00a0the\u00a0<br \/>\nsaid\u00a0transfer.\u00a0\u00a0\n<\/p>\n<p>2.     The \u00a0 CPIO \u00a0 vide \u00a0 his \u00a0 order \u00a0 dated \u00a0 5.11.2009 \u00a0 informed \u00a0 the \u00a0 appellant \u00a0 that \u00a0 the\u00a0<br \/>\ntransfer\u00a0had\u00a0been\u00a0ordered\u00a0under\u00a0provision\u00a0of\u00a0para.8\u00a0of\u00a0the\u00a0KVS\u00a0Transfer\u00a0Guidelines\u00a0<br \/>\nwith\u00a0the\u00a0approval\u00a0of\u00a0Commissioner,\u00a0KVS\u00a0and\u00a0also\u00a0provided\u00a0him\u00a0with\u00a0a\u00a0copy\u00a0of\u00a0the\u00a0note\u00a0<br \/>\nsheet\u00a0wherein\u00a0approval\u00a0of\u00a0the\u00a0Competent\u00a0Authority\u00a0was\u00a0obtained.\n<\/p>\n<p>3.     Not\u00a0being\u00a0satisfied,\u00a0the\u00a0appellant\u00a0\u00a0preferred\u00a0appeal\u00a0before\u00a0the\u00a0FAA\u00a0and\u00a0stated\u00a0<br \/>\nonce\u00a0again\u00a0that\u00a0he\u00a0wishes\u00a0to\u00a0have\u00a0information\u00a0regarding\u00a0the\u00a0sub\u00adpara\u00a0of\u00a0para.8\u00a0under\u00a0<br \/>\nwhich\u00a0his\u00a0transfer\u00a0\u00a0had\u00a0been\u00a0ordered\u00a0since\u00a0there\u00a0are\u00a06\u00a0sub\u00adparas\u00a0to\u00a0para.8.\u00a0\n<\/p>\n<p> 4.      The\u00a0FAA\u00a0vide\u00a0order\u00a0dated\u00a021.1.2010\u00a0reiterated\u00a0the\u00a0information\u00a0provided\u00a0by\u00a0the\u00a0<br \/>\nCPIO\u00a0and\u00a0stated\u00a0that\u00a0competent\u00a0authority\u00a0had\u00a0not\u00a0specified\u00a0any\u00a0sub\u00adpara\u00a0of\u00a0Para\u00a0.8\u00a0of\u00a0<br \/>\nKVS\u00a0Transfer\u00a0Guidelines\u00a0\u00a0while\u00a0approving\u00a0the\u00a0transfer.\u00a0\n<\/p>\n<p>5.      Being\u00a0 aggrieved\u00a0 and\u00a0 not\u00a0 being\u00a0 satisfied,\u00a0 the\u00a0 appellant\u00a0 has\u00a0 challenged\u00a0 \u00a0 the\u00a0<br \/>\nabove\u00a0decision\u00a0before\u00a0the\u00a0Commission.\u00a0\n<\/p>\n<p>6.      The\u00a0matter\u00a0was\u00a0heard\u00a0today.\u00a0\u00a0Respondents\u00a0were\u00a0present\u00a0as\u00a0above\u00a0in\u00a0person.\u00a0<br \/>\nAppellant\u00a0was\u00a0heard\u00a0through\u00a0video\u00a0conferencing.\u00a0\n<\/p>\n<p>7.      Respondents \u00a0 once \u00a0 again \u00a0 restated \u00a0 \u00a0 their \u00a0 position \u00a0 that \u00a0 no \u00a0 sub \u00a0 section \u00a0 were\u00a0<br \/>\nmentioned\u00a0in\u00a0the\u00a0file\u00a0\u00a0which\u00a0only\u00a0ordered\u00a0\u00a0transfers\u00a0as\u00a0per\u00a0&#8220;discussion&#8221;.\u00a0\u00a0As\u00a0per\u00a0their\u00a0<br \/>\naverment,\u00a0the\u00a0summary\u00a0of\u00a0the\u00a0discussion\u00a0between\u00a0the\u00a0Dy.\u00a0Commissioner,(Personnel)\u00a0<br \/>\nand\u00a0the\u00a0Commissioner\u00a0is\u00a0no\u00a0where\u00a0recorded\u00a0in\u00a0the\u00a0file\u00a0and\u00a0therefore\u00a0could\u00a0not\u00a0be\u00a0<br \/>\nprovided\u00a0to\u00a0the\u00a0appellant.\n<\/p>\n<p>8.      The\u00a0appellant\u00a0drew\u00a0\u00a0attention\u00a0to\u00a0sub\u00a0section\u00a0(d)\u00a0of\u00a0section\u00a04(1)\u00a0of\u00a0the\u00a0Act\u00a0which\u00a0<br \/>\nstates \u00a0 &#8220;every \u00a0 public \u00a0 authority \u00a0 shall \u00a0 provide \u00a0 reasons \u00a0 for \u00a0 its \u00a0 administrative \u00a0 or \u00a0 quasi\u00a0<br \/>\njudicial\u00a0decision\u00a0\u00a0to\u00a0affected\u00a0person&#8221;.\u00a0\u00a0He\u00a0also\u00a0quoted\u00a0sub\u00a0section\u00a0(5)\u00a0of\u00a0Section\u00a025\u00a0of\u00a0<br \/>\nthe \u00a0 act \u00a0 and \u00a0 appealed \u00a0 to \u00a0 the \u00a0 Commission \u00a0 to \u00a0 give \u00a0 recommendation \u00a0 to \u00a0 the \u00a0 public\u00a0<br \/>\nauthority\u00a0regarding\u00a0steps\u00a0which\u00a0ought\u00a0to\u00a0be\u00a0taken\u00a0by\u00a0them\u00a0for\u00a0conforming\u00a0with\u00a0the\u00a0<br \/>\nprovision\u00a0and\u00a0spirit\u00a0of\u00a0the\u00a0Act.\u00a0\n<\/p>\n<p>                                               Decision<\/p>\n<p>\u00a09.     The\u00a0Commission\u00a0appreciates\u00a0the\u00a0points\u00a0made\u00a0by\u00a0the\u00a0appellant\u00a0and\u00a0is\u00a0of\u00a0the\u00a0<br \/>\nview\u00a0that\u00a0the\u00a0public\u00a0authority\u00a0should\u00a0have\u00a0maintained\u00a0the\u00a0record\u00a0of\u00a0discussion\u00a0held\u00a0<br \/>\nprior\u00a0to\u00a0issue\u00a0of\u00a0the\u00a0transfer\u00a0orders\u00a0in\u00a0the\u00a0true\u00a0spirit\u00a0of\u00a0transparency\u00a0in\u00a0the\u00a0actions\u00a0of\u00a0<br \/>\nthe\u00a0public\u00a0authority.\u00a0 \u00a0In\u00a0the\u00a0absence\u00a0of\u00a0such\u00a0transparency\u00a0through\u00a0maintenance\u00a0of\u00a0<br \/>\nproper\u00a0records\u00a0the\u00a0public\u00a0authority\u00a0attracts\u00a0allegations\u00a0of\u00a0arbitrariness\u00a0when\u00a0it\u00a0fact\u00a0<br \/>\nthere \u00a0 would \u00a0 have \u00a0 been \u00a0 no \u00a0 mala\u00adfide \u00a0 in \u00a0 their \u00a0 actions. \u00a0 \u00a0 The \u00a0 attention \u00a0 of \u00a0 the\u00a0<br \/>\nCommissioner, \u00a0 Kendriya \u00a0 Vidyalaya \u00a0 Sangathan \u00a0 is \u00a0 invited \u00a0 to \u00a0 this \u00a0 order \u00a0 along \u00a0 with\u00a0<br \/>\nsuggestion\u00a0that\u00a0he\u00a0may\u00a0like\u00a0to\u00a0revisit\u00a0this\u00a0issue\u00a0and\u00a0order\u00a0a\u00a0systemic\u00a0change\u00a0in\u00a0the\u00a0<br \/>\nmaintenance\u00a0of\u00a0records\u00a0following\u00a0discussions\u00a0on\u00a0administrative\u00a0matters\u00a0that\u00a0impact\u00a0<br \/>\ntheir\u00a0\u00a0personnel.\u00a0This\u00a0will\u00a0be\u00a0in\u00a0harmony\u00a0with\u00a0spirit\u00a0and\u00a0the\u00a0letter\u00a0of\u00a0the\u00a0RTI\u00a0Act.\u00a0\n<\/p>\n<p> 10.    However,\u00a0in\u00a0this\u00a0case\u00a0since\u00a0no\u00a0other\u00a0information\u00a0is\u00a0available\u00a0on\u00a0record\u00a0it\u00a0may\u00a0<br \/>\nnot\u00a0be\u00a0possible\u00a0for\u00a0the\u00a0respondent\u00a0to\u00a0provide\u00a0additional\u00a0information\u00a0to\u00a0the\u00a0appellant.\u00a0\u00a0\n<\/p>\n<p>11.
