This appeal is filed by the State challenging’thgl\ufb01rd\u00e9r <\/p>\n

S.C.No.8~<\u00a3\/1997 acquitting ,,;~esponderit_uof: "offences" V<\/p>\n
U\/s.307 of IPC.\n<\/p>\n
2. A charge-s’h\\ee.t  } heei1.l>l’ifi1ed against the<\/p>\n
respondent. 0610,1996 at 1.00 a.m., the
\nresponlder\ufb01, in Kasharkoppal village assaulted<\/p>\n
his wife wrtth a blade with such intention or<\/p>\n
 andl”‘under such circumstances that if such<\/p>\n
‘ assa.ult__he;’had–.caused the death of said Lakshrnanima, he<\/p>\n
would  guilty of murder and therefore, he is held<\/p>\n
 liahleuforr offence U\/s.307 of IPC.\n<\/p>\n
00   After framing the charge the prosecution in<\/p>\n
order to prove its case has examined in all 9 witnesses and<\/p>\n
00 h\ufb02lgot marked Exss.Pl to P8 and produced M.Os.l to 5. The<\/p>\n
defence of the accused was one of the total denial.<\/p>\n
4. After hearing the prosecution and th..e=de.fence<\/p>\n
the learned Sessions Judge was pleased to  <\/p>\n
prosecution has not been able t_o.t.,prove_–‘the” of t1<1e\u00b0<\/p>\n
accused beyond reasonable
\nrespondent. The State has \ufb011ed"–thisappeal,  A' V l I it<\/p>\n
5. PW1 — La1:_shmamrna’~h_as__vstatedl:that\ufb02vaiccused is
\nher husband. He  about 10 years<\/p>\n
prior to the incident inVv~Ami’L1thammla_  The accused<\/p>\n
was Iintro’du\u00a5{:edVll::f:’by  Nathaiah and Kenchaiah of
\nMoleko’ppla_lul village.to-he:j:parents. Thereafter, the marriage<\/p>\n
Was _arranged;v On._tl*;e: date of incident since there was no<\/p>\n
  the hous-.e.’ she had prepared Ambali with ragi<\/p>\n
‘ \ufb02ourg  her mother and she requested the accused to<\/p>\n
‘take  that time, the accused picked up quarrel<\/p>\n
 “her stating that she could have brought money and<\/p>\n
it  prepared rice for him. The said incident took place at 8.00<\/p>\n
 She has stated that she could prepare the same only<\/p>\n
it “after providing materials required for preparation of such<\/p>\n
food. The accused become angry and went to bed and did not<\/p>\n
take food given by her. He was abusing her. She relqrleosted<\/p>\n
him not to raise Voice since it will cause nuis”an’Ce_’<\/p>\n
neighbourers. At about 1.00 a.m. in  .. <\/p>\n
respondent suddenly picked up a:=__b1adeand_ <\/p>\n
her neck. She started crying.  laccusedlrlcaused ‘tout?’<\/p>\n
injuries on her chest and onllher  onziher right
\nindex \ufb01nger. She tried:ta_ resist_  the accused
\nand in the process, he also minor injuries.<\/p>\n
On hearing the”-zries nieighbolurerslcameifthere and thereafter<\/p>\n
draggedlltlhe.   She has been shifted to
\nKM.  lit:-ctor has treated her. She came<\/p>\n
to know  the  has already married his first vc\ufb01fe<\/p>\n
   another \\}il1age..only after two months of her marriage<\/p>\n
‘  the hospital, the police took the statement from<\/p>\n
lhelrsasl   The bloodstained pillow and mat are<\/p>\n
marl;ed,aslll\\\/1.0.1 and ]\\\/1.0.2 and the blade used by the<\/p>\n
 naccused is marked as l\\\/1.0.3. In the cross-examination it is<\/p>\n
AA”sugAgested by the accused that he has not married her at all<\/p>\n
it “and that she is telling falsehood before the court. However,<\/p>\n
that suggestion has been denied. He has also denied the<\/p>\n
relationship between himself and PW}.<\/p>\n
6. PW2 -~ Mallaiah is the father sf.\n<\/p>\n
stated that accused has married his daughter”:<\/p>\n
accused was not providing: properhddfeod  <\/p>\n
providing food to the accuseV’dz_:.and his~.dau–ghter. lie has
\nfurther stated that  that had caused
\ninjuries ‘his daughter by cutting he1*\u00ab._n’er::i:.__ On hearing cries<\/p>\n
of his daughter”h_e’ ‘carne  her”h_ous_e:fand other witnesses<\/p>\n
like  -and others gathered there and
\nbroke open.the’e.door :.and”dragged the accused out of the<\/p>\n
roojIn;’ His daughter has sustained injuries on her neck.<\/p>\n
  —- Channamrna is the mother–in~1aw of the<\/p>\n
  stated that on the date of incident, she has<\/p>\n
giifen ragiv ‘flour to her daughter. She had heard noise from<\/p>\n
 ~he__r daughters house. Her self and her husband reached the<\/p>\n
d  and door was locked. The accused and PW1 were inside<\/p>\n
-“lithe house. PW1 had sustained injuries. Thereafter, the<\/p>\n
daughter was taken to K.M.Doddi Hospital.<\/p>\n
8. PW-4 -~ Siddaiah is another eyewiiriess’  <\/p>\n
injuries caused on PW} and hewaaiso \u00a7spea’}.{‘_’tah0ut.V the <\/p>\n
presence of the accused and the ‘\u00bb.jnj1:ir’ies cr1_’th:e’ <\/p>\n
PW1 on the date of incident.’ _V<\/p>\n
9. PWS -~ Manjsiddaiahe  ancthertennltness to
\ncorroborate the Version’  PW6 ~ Raju is
\nsignatory to EX.P2—-_-  V”\n<\/p>\n

4. An incised wound over right side of neck
\nmeasuring 4 inch x 1 inch with bieeding.
\nTenderness present.\n<\/p>\n
5. Sterno mastoid muscie cut.\n<\/p>\n
An incised wound over front of neck measuriiig<\/p>\n
4 inch x 1\/2 inch. Bleeding seen~;Tendei’–ne’ssl <\/p>\n

He has opined that  and 5 to 7 are<\/p>\n
simple injuries_:an__d   injury. He has<\/p>\n

\nmeasuring 3\/2 inch X 1\/:2 inch. Tendernests<\/p>\n
present.\n<\/p>\n
He has issued wound certi\ufb01cate as  in it<\/p>\n
respect of the accused and opineqgthatdthve  <\/p>\n
simple in nature.\n<\/p>\n
11. PW8 — Kernpaiaht_isV:’the”..1?olice”‘Constable who
\nhas sent biade and” Egbert  FSL. PW9 m–<\/p>\n
Shivashankar Micarthy  who registered<\/p>\n
the case in’_'(3rfi;iie  and recorded the statement
\nof the injured  hospital as per EXP}. I-Ie visited<\/p>\n
the scene hr ._:Vocct1rre’nce: and recorded the statement of<\/p>\n
‘t it  -. witnesses  after'”receiv’ing the reievant documents, he has<\/p>\n
  fi1e_d’ch:ar:ge\u00a7shee:t in this case.<\/p>\n
   is from the evidence of these witnesses, the<\/p>\n
  1earned”‘Sessions Judge has found that the prosecution case<\/p>\n
‘i_s”fuiI of concoctions and inconsistencies. Hence, it has not<\/p>\n
   proved its case beyond reasonabie doubt and has acquitted<\/p>\n
the respondent for the offences alleged against him.<\/p>\n

PW2, PW3 and PW4. and pws’ stated .tiiatj’v:h\u00e9-,\u00a7\u00a3cu’\u00a7ed is<\/p>\n
the husband of PW1. VTi1oughA.Ait”is  by ath’e~ae’cused that
\nhe has married her the \u00e9s._rid\u00e91\u00ab..c7\u00a2:jor clinchingly<\/p>\n
establish that   liyiing as husband and<\/p>\n
wife  the 1\u00a7Vlace’tVysfrl’1eret._tl*ie_ incident had taken place on the
\nnight oi\u00b0”tO4’ES;t10.’i–996VA\u00a7 ‘the materials on record in the<\/p>\n
forrii “o\u00a3.eyeWitn_esVses and also complaint as per Ex.P1 and<\/p>\n
   evidence of WV? — Dr. Shivalingaiah stating that<\/p>\n
   and PW1 had sustained injuries on<\/p>\n
 we hold that on the date of offence, PWI and<\/p>\n
 accused’ were living together and accused has caused<\/p>\n
it ~..vVinjLi’ries on the neck of PW1 by means of blade — M.O.3. As<\/p>\n
_;%against the clear and cogent evidence of PW1 and PW’? on<\/p>\n
one hand and the evidence of eyewitnesses PW2 to PW5 on<\/p>\n
the other, the discrepancies and contradictions elicited by<\/p>\n

the defence are minor in nature and do not go to the very<\/p>\n
root of the prosecution case, in order to rendervitcitotally<\/p>\n
unreliable. Under the circumstances, we hogidvthat<\/p>\n
prosecution has proved that accused has.caiused’r–.gn.evous–.iV <\/p>\n
injuries by means of blade on the neck; <\/p>\n
liable to be convicted for said offence Ali\/s.326\u00bbof   \u00a5’<\/p>\n
we convict him for the said offence;\n<\/p>\n
15. It is seen “t1:at.t’h_<: in the custody<\/p>\n
for almost two mo;1ths;"We~ \u00a75';~opege  the said period<\/p>\n
as ser__1tenceVVo'f -for the offence committed by
\nhim. It isisubmi'tted.VA'by:\ufb01S3\u00bbri'iimashankar that the accused is<\/p>\n
a pcgoolie, However, for the injuries caused by the accused,<\/p>\n
   _b"e,compensated.\n<\/p>\n
  result, the appeal filed by the State is<\/p>\n
allowed. Tire respondentwaccused is convicted for the offence<\/p>\n
f “U,{4s.3l2’6 of EPC and sentenced to R1. for 2 months and to<\/p>\n
‘pay’ a \ufb01ne of Rs.20,00()\/– in default to undergo S.l. for a<\/p>\n
“period of 6 months. The accused was in custody for 2<\/p>\n
months as under trial prisoner and the said period is given<\/p>\n
