Suit No. 1511\/2010 filed in the Small Cause Court at<br \/>\n\tAhmedabad granting application for amendment filed under Order 6<br \/>\n\tRule 17 of the Civil Procedure Code.\n<\/p>\n<p>The<br \/>\n\trespondent tenant filed H.R.P. Civil Suit No. 1511\/2010 in the Small<br \/>\n\tCause Court at Ahmedabad for permanent injunction restraining the<br \/>\n\tpetitioners landloard from taking forcible possession of the suit<br \/>\n\tpremises occupied by him as tenant.  The respondent also filed<br \/>\n\tInjunction application for temporary injunction under Order 39 Rule<br \/>\n\t1 read with Section 151 of the Civil Procedure Code and also filed<br \/>\n\tan application for appointment of Court Commissioner.  After<br \/>\n\tissuance of notice to both the parties, the Court Commissioner made<br \/>\n\treport in respect of the suit premises.  The respondent preferred<br \/>\n\tthe application exh 19 for amendment of plaint and injunction<br \/>\n\tapplication under Order 6 Rule 17 of the Civil Procedure Code<br \/>\n\tcontending that he is a tenant of premises situated at 5, Dhanvanti<br \/>\n\tSociety behind Water Tank, Near Sardar Nagar, Naroda, Ahmedabad but<br \/>\n\tthrough over sight the suit premises was mentioned in the pleading<br \/>\n\tas number 2.  Therefore, it is necessary to amend Plaint and<br \/>\n\tInjunction application by amending No. 2 in place of No. 5 shown as<br \/>\n\tsuit premises.  The Trial Court after hearing learned advocates for<br \/>\n\tthe parties allowed the application.  Being aggrieved by the said<br \/>\n\tdecision, the petitioners landlord  original defendants have<br \/>\n\tapproached this Court by filing this petition.\n<\/p>\n<p>I<br \/>\n\thave heard learned advocate Ms. Lopa Bhatt for learned advocate Mr.<br \/>\n\tMM Trivedi for the petitioners and learned advocate Mr. Bhargav<br \/>\n\tHasurkar for respondent at length and in great detail.  I have also<br \/>\n\tperused the impugned order.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Ms. Bhatt submitted that the Court has allowed the<br \/>\n\tapplication, which has changed nature of suit.  Therefore, the Trial<br \/>\n\tCourt committed error in allowing the application.  She also<br \/>\n\tsubmitted that the documentary evidence produced on record indicates<br \/>\n\tthat the suit premises indicate premises as No. 5.  Therefore, the<br \/>\n\tTrial Court committed error in passing the impugned order.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Mr. Hasurkar submitted that amendment sought in the<br \/>\n\tpleading was only a typographical error and it does not change<br \/>\n\tnature of the suit.  Therefore, no error is committed by the Trial<br \/>\n\tCourt in granting permission to amend the pleadings. Therefore, the<br \/>\n\timpugned order is required to be confirmed and present petition is<br \/>\n\trequired to be dismissed.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Ms. Bhatt admitted that the respondent is their tenant<br \/>\n\toccupying suit premises bearing No. 5 at Dhanvanti Society in Naroda<br \/>\n\tarea of Ahmedabad. Therefore, it is not in dispute that respondent<br \/>\n\tis tenant of the petitioners but there is error in description of<br \/>\n\tthe suit premises.  The averments made in the application indicate<br \/>\n\tthat on account of typographical error the suit premises was<br \/>\n\tdescribed as no. 2 in place of no. 5 and hence amendment was sought.<br \/>\n\t Learned advocate Ms.  Bhatt submitted that on account of the<br \/>\n\tamendment the nature of the suit has changed, however, it is not in<br \/>\n\tdispute that the respondent is tenant of the petitioners.  It<br \/>\n\tappears that on account of typographical error in pleadings, error<br \/>\n\tin describing the suit premise has cropped up.    It is well settled<br \/>\n\tthat normally amendment in pleading is required to be allowed unless<br \/>\n\tsuch amendment is malafide or changes nature of the suit.  The<br \/>\n\tamendment granted by the trial court does not change nature of the<br \/>\n\tsuit. The petitions have not alleged malafide.  Therefore, the Trial<br \/>\n\tCourt was justified in granting the amendment in the interest of<br \/>\n\tjustice.  Looking to the nature of the amendment allowed, in my<br \/>\n\tview, this Court is not required to exercise its extra ordinary<br \/>\n\tjurisdiction under Articles 227 of the Constitution of India.\n<\/p>\n<p>In<br \/>\n\tthe result, the petition fails and stands dismissed.  Notice<br \/>\n\tdischarged.
