He has<br \/>\ncontended that co-accused are released on bail by this Court. He has<br \/>\ncontended that nothing is recovered from the present applicant. He<br \/>\nhas contended that even during the T.I.Parade present applicant is<br \/>\nnot identified by the victim. He has, therefore, prayed to grant bail<br \/>\nto the present applicant.\n<\/p>\n<p>4.\tHeard<br \/>\nMs.Chetna Shah, learned APP for the respondent State. Ms.Shah has<br \/>\nvehemently opposed the present application and read order passed by<br \/>\nthe trial Court.\n<\/p>\n<p>5.\tHaving<br \/>\nheard the learned Counsel for both the sides and looking to the facts<br \/>\nand circumstances of the case, statement of the witnesses, gravity of<br \/>\nthe offence and quantum of punishment and the fact there is no<br \/>\ndefinite allegation made against the applicant, I am inclined to<br \/>\ngrant bail to the applicant.\n<\/p>\n<p>6.\tConsidering<br \/>\nthe above, this Application is allowed. The applicant is ordered to<br \/>\nbe released on bail in connection with CR No.I-86 of 2010 registered<br \/>\nwith Sayla Police Station, Surendranagar for the offence alleged<br \/>\nagainst him in this Application on his executing a Bond of<br \/>\nRs.10,000\/- (Rupees ten thousand only) with one solvent surety of the<br \/>\nlike amount to the satisfaction of the trial Court and subject to the<br \/>\nconditions that he shall-\n<\/p>\n<p>a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>b)\tnot<br \/>\nto try to tamper or pressurise the prosecution witnesses or<br \/>\ncomplainant in any manner;\n<\/p>\n<p>c)\tmaintain<br \/>\nlaw and order and should cooperate the Investigating Officer;\n<\/p>\n<p>d)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>e)\tmark<br \/>\npresence before the concerned Police Station on every 15th<br \/>\nof the month between 9:00 a.m. to 2:00 p.m.<\/p>\n<p>f)\tnot<br \/>\nleave the country without the prior permission of the concerned<br \/>\nSessions Judge;\n<\/p>\n<p>g)\tfurnish<br \/>\nthe address of his residence to the I.O. and also to the Court at the<br \/>\ntime of execution of the bond and shall not change the residence<br \/>\nwithout prior permission of this Court;\n<\/p>\n<p>h)\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week.\n<\/p>\n<p>7.\tIf<br \/>\nthe breach of any of the above conditions is committed, the concerned<br \/>\nSessions Judge will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>8.\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case. It would<br \/>\nbe open to the trial Court concerned to give time to furnish the<br \/>\nsolvency certificate if prayed for.\n<\/p>\n<p>9.\tRule<br \/>\nis made absolute.
