Justice P.S.GOPINATHAN\n\n Dated :06\/10\/2009\n\n O R D E R\n                P.S.Gopinathan, J.\n    ==========================================\n               Crl.R.P.3385 of 2004\n    ==========================================\n      Dated this the 6th day of October, 2009.\n\n\n                       ORDER\n<\/pre>\n<p>1.The revision petitioner, who is the accused in<\/p>\n<p> C.C.No.550 of 1996 on the file of the Judicial<\/p>\n<p> Magistrate of the First Class, Thiruvalla was<\/p>\n<p> prosecuted  by  the   first   respondent  alleging<\/p>\n<p> offence  under  Section   138  of  the  Negotiable<\/p>\n<p> Instruments Act.    The trial court found him<\/p>\n<p> guilty.    Accordingly,   he   was  convicted  and<\/p>\n<p> sentenced to rigorous imprisonment for six months<\/p>\n<p> under Section 138 of the Negotiable Instruments<\/p>\n<p> Act.  In  appeal,  the   learned  Sessions  Judge,<\/p>\n<p> Adhoc,   Fast  Track    Court-II,   Pathanamthitta<\/p>\n<p> confirmed the conviction but reduced the sentence<\/p>\n<p> to a  fine of Rs.70,000\/- with   default clause to<\/p>\n<p> undergo simple imprisonment for two months.    Out<\/p>\n<p> of the fine amount, if realised, Rs.65,000\/- was<\/p>\n<p> ordered to be given to the first respondent as<\/p>\n<p><span class=\"hidden_text\"> CRRP3385\/09             -:2:-<\/span><\/p>\n<p> compensation under Section 357(1) of the Cr.P.C.<\/p>\n<p> Now this revision, assailing the legality and<\/p>\n<p> correctness of the above conviction and sentence<\/p>\n<p> as modified in appeal.\n<\/p>\n<\/p>\n<p>2.Revision   petitioner  along   with   the   first<\/p>\n<p> respondent now filed a petition as Crl.M.A.9394<\/p>\n<p> of  2009    seeking permission  to  compound   the<\/p>\n<p> offence.    Having heard either side, I find no<\/p>\n<p> reason    to reject  the  petition.    Hence,  the<\/p>\n<p> petition is recorded and the revision petitioner<\/p>\n<p> is acquitted under Section 147 of the Negotiable<\/p>\n<p> Instruments Act read with Section 320(8) of the<\/p>\n<p> Code of Criminal Procedure.\n<\/p>\n<p> Crl.R.P. is disposed of as above.\n<\/p>\n<\/p>\n<p>                         P.S.Gopinathan, Judge.\n<\/p>\n<p>sl.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court M.M.
