SHAH\n\t\t\n\t\n\n \n\nDate\n: 06\/07\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tThe<br \/>\npresent Criminal Revision Application has been preferred by the<br \/>\npetitioner herein challenging the impugned order dated 15\/04\/2011<br \/>\npassed by learned Additional Judge, Family Court, Vadodara in<br \/>\nCriminal Misc.Application No.2980\/2010, by which, the petitioner was<br \/>\ndirected to pay Rs.2,000\/- per month to respondent No.2 and<br \/>\nRs.1,000\/- per month to the minor &#8211; respondent No.3 by way of<br \/>\ninterim maintenance.\n<\/p>\n<p>2.\t\tHaving<br \/>\nheard Mr.Harshad Patel, learned advocate appearing on behalf of the<br \/>\npetitioner and considering the impugned order of interim maintenance<br \/>\nawarding total a sum of Rs.3,000\/-, it cannot be said that the<br \/>\nlearned Judge has committed any error and\/or illegality in awarding<br \/>\ntotal a sum of Rs.3,000\/- to respondent Nos.2 &amp; 3 by way of<br \/>\ninterim maintenance.\n<\/p>\n<p>3.\t\tMr.Harshad<br \/>\nPatel, learned advocate appearing on behalf of the petitioner has<br \/>\nrelied upon the appointment letter of the petitioner dated 08\/12\/2010<br \/>\nin support of his submission that his salary is Rs.5,000\/- per month.<br \/>\nHowever, it appears that nothing is on record that such document was<br \/>\nproduced before the learned Trial Court or not.
