Shah  waives service of notice of Rule<br \/>\n\tfor the respondent &#8211; State.\n<\/p>\n<p>This<br \/>\n\tapplication is filed under Section 439 of the Code of Criminal<br \/>\n\tProcedure in connection with the first information report registered<br \/>\n\tas Prohibition C.R. No.III-282\/2009, registered with Vapi<br \/>\n\tUdhyognagar Police Station, Valsad for the offences punishable under<br \/>\n\tSections-66(1)(b), 65(a)(e), 81, 83 and 116(B) of the Bombay<br \/>\n\tProhibition Act.\n<\/p>\n<p>\tHeard<br \/>\n\tlearned Counsels for the parties and perused the record.\n<\/p>\n<p>Considering<br \/>\n\tthe facts and circumstances of the case, the nature of allegations,<br \/>\n\trole attributed to the accused and the punishment prescribed for the<br \/>\n\talleged offences and the Court in which it is triable, I am inclined<br \/>\n\tto enlarge the applicant on bail, by imposing suitable conditions.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicant is ordered to be released on bail in connection<br \/>\n\twith Prohibition C.R. No.III-282\/2009, registered with Vapi<br \/>\n\tUdhyognagar Police Station, Valsad, on executing a bond of<br \/>\n\tRs.5,000\/- (Rupees Five Thousand only) with one surety of the like<br \/>\n\tamount to the satisfaction of the trial Court and subject to the<br \/>\n\tconditions that he shall;\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of liberty or misuse liberty;\n<\/p>\n<p>(b)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>(c)\tsurrender<br \/>\npassport, if any, to the lower court within a week;\n<\/p>\n<p>(d)\tnot<br \/>\nleave the State of Gujarat without prior permission of the Sessions<br \/>\nJudge concerned;\n<\/p>\n<p>(e)\tmark<br \/>\npresence at the concerned police station on the first Sunday of every<br \/>\nmonth between 10.00 a.m. and 3.00 p.m., till the trial commences;\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt, at the time of execution of the bond, and shall not change the<br \/>\nsame without prior permission of this Court;\n<\/p>\n<p>The<br \/>\n\tAuthorities will release the applicant only if not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbond to be executed before the lower court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p>At<br \/>\n\tthe trial, the trial court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extent.
