Giri, Sr. Advocate &amp;<br \/>\n                                  Raju Giri, Advocate<\/p>\n<p>              For the Board   :M\/s Vinay Kirti Singh &amp; Akhileshwar Singh,<br \/>\n                               Advocates<br \/>\n08\/   07.12.2010               Heard learned counsel for the petitioner<\/p>\n<p>                     and the counsel for the Bihar State Electricity Board,<\/p>\n<p>                     Patna (hereinafter referred to as &#8220;the Board&#8221;).<\/p>\n<p>                               With consent of the parties, the writ<\/p>\n<p>                     petition is disposed of modifying the interim orders<\/p>\n<p>                     passed in the instant case dated 15.7.2008 and<\/p>\n<p>                     14.8.2008 directing the petitioner to deposit further<\/p>\n<p>                     amount of ` 73,00,000\/- (seventy three lacs) in the<\/p>\n<p>                     light of the punitive bill dated 21.6.2008 amounting<\/p>\n<p>                     to ` 3,08,65,882\/- . Aforesaid deposit be made within<br \/>\n<span class=\"hidden_text\">                  2<\/span><\/p>\n<p>three weeks from today, subject to any order of<\/p>\n<p>instalment(s) fixed by the Financial controller,<\/p>\n<p>Revenue of the Board. Aforesaid interim orders are<\/p>\n<p>further modified directing the Board to send the<\/p>\n<p>Meter of the petitioner installed in the business<\/p>\n<p>premises of the petitioner on 15.1.2008 to C.P.R.I.,<\/p>\n<p>Bhopal for fresh test. The cost of the fresh test shall<\/p>\n<p>be borne by the petitioner, who shall deposit such<\/p>\n<p>cost before the authorities of the Board along with a<\/p>\n<p>copy of this order. Payment of ` 73,00,000\/- (seventy<\/p>\n<p>three lacs) shall be subject to final assessment made<\/p>\n<p>by the Assessing Authority in terms of Section 126 of<\/p>\n<p>the Electricity Act, 2003. The Meter testing report<\/p>\n<p>received in compliance of this order shall also be<\/p>\n<p>considered by the Assessing Authority as a piece of<\/p>\n<p>evidence in support of the case of the petitioner. The<\/p>\n<p>assessment proceeding must be completed within one<\/p>\n<p>month from the date of receipt of the report from the<\/p>\n<p>C.P.R.I., Bhopal and the Meter be also sent to the<\/p>\n<p>C.P.R.I., Bhopal, as early as possible, in any case<\/p>\n<p>within two weeks of the receipt of the amount<\/p>\n<p>required for meeting the testing expenses. If the<br \/>\n<span class=\"hidden_text\">                          3<\/span><\/p>\n<p>         payments are made in compliance of this order,<\/p>\n<p>         electric connection of the petitioner shall not be<\/p>\n<p>         disconnected for non-payment of the punitive bill.<\/p>\n<pre>Arjun\/                                    ( V.
