Public Prosecutor waives service of<br \/>\n\tnotice of rule on behalf of the respondent &#8211; State of Gujarat.\n<\/p>\n<p>2.\tHaving<br \/>\n\tregard to the facts of the case, the application is taken up for<br \/>\n\thearing today.\n<\/p>\n<p>3.\tThe<br \/>\n\tapplicant &#8211; convict prisoner, who by judgment and order dated<br \/>\n\t12.8.2009 rendered in Sessions Case No.1 of 2008 by the learned<br \/>\n\tAdditional Sessions Judge, Mehsana camp at Visnagar, has been<br \/>\n\tconvicted for the offence punishable under Section 20(b) of the NDPS<br \/>\n\tAct and sentenced to RI for 10 years, has filed this application<br \/>\n\tpraying to enlarge him on temporary bail for a period of two weeks,<br \/>\n\tto enable him to perform the marriage ceremony of his daughter which<br \/>\n\tis to be scheduled from 27.1.2011 to 30.1.2011.\n<\/p>\n<p>4.\tWe<br \/>\n\thave considered the submissions advanced by Ms. KU Mishra, learned<br \/>\n\tadvocate for the applicant and Mr. LB Dabhi, learned Addl. Public<br \/>\n\tProsecutor for the respondent &#8211; State of Gujarat. We have also<br \/>\n\tgone through the application and the supporting document i.e.<br \/>\n\tmarriage invitation card of the daughter of the applicant that form<br \/>\n\tpart of the application so also the jail remarks sheet forwarded by<br \/>\n\tthe jail authority.\n<\/p>\n<p>5.\tIn<br \/>\n\t Dadu alias Tulsidas v. State of Maharashtra (2000) 8 SCC 437,<br \/>\n\tthe Supreme Court has ruled that section<br \/>\n\t32-A of the NDPS Act is unconstitutional to the extent it takes away<br \/>\n\tright of the Court to suspend the sentence of a person convicted<br \/>\n\tunder  the Act.  However, what is emphasized by the Supreme Court<br \/>\n\tin the said decision is that the appellate Court can suspend the<br \/>\n\tsentence imposed under the Act and  that  too  strictly  subject  to<br \/>\n\t the conditions set out in section 37 of the Act.  After the<br \/>\n\tconviction of the appellant under section 22 of the NDPS Act, it is<br \/>\n\tdifficult to conclude at this stage that there are reasonable<br \/>\n\tgrounds for believing that the appellant is not guilty of the<br \/>\n\toffence punishable under the NDPS Act.  Further, there is no<br \/>\n\tmaterial before the Court on the basis of which the Court can<br \/>\n\tsatisfy itself that the appellant is not likely to commit any<br \/>\n\toffence while on temporary bail.  Having regard to the principles<br \/>\n\tlaid down by the Supreme Court in the above quoted decision, we are<br \/>\n\tof the opinion that the appellant cannot be enlarged on temporary<br \/>\n\tbail during the pendency and final hearing of the appeal.<br \/>\n\tTherefore, prayer for temporary bail deserves to be rejected.\n<\/p>\n<p>6.\tAt<br \/>\n\tthis stage, Ms. KU Mishra, learned advocate for the applicant<br \/>\n\tsubmits that the applicant may be permitted to attend the marriage<br \/>\n\tceremony of his daughter for two days i.e. on 29.1.2011 and<br \/>\n\t30.1.2011  with police surveillance at his expenses.\n<\/p>\n<p>7.\tIn<br \/>\n\tview of submission of Ms. KU Mishra, learned advocate for the<br \/>\n\tapplicant, on humanitarian ground, since marriage of the daughter of<br \/>\n\tthe applicant is going to be solemnized from 27.1.2011 to 30.1.2011,<br \/>\n\twe deem it expedient to release the applicant for two days i.e.<br \/>\n\ton 29.1.2011 and 30.1.2011 with police surveillance at<br \/>\n\this expenses.\n<\/p>\n<p>8.\tFor<br \/>\n\tthe foregoing reasons, the application fails and accordingly stands<br \/>\n\trejected.
