M. SAHAI)<\/a><\/p>\n<p>1.\t\tWe<br \/>\nhave heard Mr I. S. Supehia, learned counsel for the appellant and Mr<br \/>\nD.G. Chauhan, learned counsel for respondent No.1.  Mr Supehia,<br \/>\nlearned counsel for the appellant admits that he did argue the matter<br \/>\non 12.8.2010. But the Court was not convinced so far as the<br \/>\ntermination of the appellant is concerned and, therefore, issued<br \/>\nNotice  only to ascertain if the  post-retiral dues of the petitioner<br \/>\nhave been paid or not.  On 16.9.2010, Mr Supehia, learned counsel<br \/>\nappeared before the Court and argued the question of post-retiral<br \/>\ndues.  Learned Single has passed order on 16.9.2010<br \/>\ndirecting that the post-retiral dues to be paid to the appellant.<br \/>\nNow it is not open to the learned counsel for the appellant to take<br \/>\nsomersault  and challenge the termination order which was  though<br \/>\nchallenged in the writ petition before the learned  Single Judge but<br \/>\nwas given up.\n<\/p>\n<p>2.<br \/>\nIn case the appellant has not yet  made application for releasing his<br \/>\npost-retiral benefits by 30.9.2010, he shall move such an application<br \/>\nwithin one month from today which shall be considered by the<br \/>\nrespondent authorities as directed by the learned single Judge within<br \/>\na further period of three months.\n<\/p>\n<p>3.\t\tSubject<br \/>\nto the aforesaid observations, this appeal fails and  is dismissed<br \/>\naccordingly.\n<\/p>\n<p>\t\t\t\t\t\t\t\t[V<br \/>\n M SAHAI, J.]<\/p>\n<p>\t\t\t\t\t\t\t\t[G<br \/>\nB  SHAH, J.]<\/p>\n<p>msp<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court P vs Junagadh on 16 March, 2011 Author: V.
