GOVERNMENT\nPLEADER for Respondent(s) :\n1, \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE K.A.PUJ\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 12\/01\/2010 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE K.A.PUJ)<\/p>\n<p>\tRULE.\n<\/p>\n<p> Learned AGP Ms. M.D. Mehta waives service of rule on behalf of the<br \/>\nopponent.\n<\/p>\n<p>2.\tThe<br \/>\napplicant has filed this application praying for stay against<br \/>\nrecovery of the penalty amount retained by the Tribunal.\n<\/p>\n<p>3.\tThe<br \/>\napplicant\t has preferred Tax Appeal No. 2119 of 2009. The said Tax<br \/>\nAppeal was admitted by this court on 17.11.2009 and notice was issued<br \/>\nin the present civil application.  Thereafter, by an order dated<br \/>\n10.12.2009, this court has passed an order on the basis of the<br \/>\nstatement made by the learned AGP that no coercive measures would be<br \/>\ntaken for recovery of the penalty amount till the next date of<br \/>\nhearing.\n<\/p>\n<p>4.\tHeard<br \/>\nlearned Sr. Counsel Mr. K.H. Kaji appearing with Mr. Manish K. Kaji,<br \/>\nlearned advocate for the applicant and Ms. M.D. Mehta, learned AGP<br \/>\nappearing for the opponent.\n<\/p>\n<p>5.\tThe<br \/>\nmain contention of learned Sr. Counsel Mr. Kaji is that the penalty<br \/>\norder is passed after 6 years from the date of assessment order and<br \/>\nthat too under the dictate of the Dy. Commissioner of Sales Tax.<br \/>\nThis is contrary to the settled legal position and the penalty order<br \/>\nitself is not sustainable.  He has therefore submitted that till the<br \/>\nappeal is decided by this court, the amount of penalty levied under<br \/>\nsec. 45(6) of the Gujarat Sales Tax Act by the Sales Tax Officer to<br \/>\nthe extent of 90% of the tax assessed which was reduced by the<br \/>\nTribunal to the extent of 50%, which comes to Rs. 3,46,223.50,  be<br \/>\nstayed.\n<\/p>\n<p>6.\tWe<br \/>\nfind sufficient force in the submission of Mr. Kaji and hence this<br \/>\napplication is allowed staying the recovery of the penalty amount<br \/>\ntill the disposal of Tax Appeal No. 2119 of 2009.\n<\/p>\n<p>7.\tThe<br \/>\napplication is accordingly allowed.
