    This  appeal      is      preferred       against  the<\/p>\n
judgment  and   decree      passed      by   the   District<\/p>\n
Judge, Lakshadweep in O.S.17\/97.              The suit is<\/p>\n
one for settlement of boundaries and injunction.<\/p>\n
It  is  the  case     of    the     plaintiff     that the<\/p>\n
property comprised in Sy.No.161\/24 where house<\/p>\n
named Devanigothi Boduge is situated belonged to<\/p>\n
the mother of the plaintiff namely Kaddha and<\/p>\n
defendant’s mother Pathumma jointly.              According<\/p>\n
to her they divided the property orally and<\/p>\n
plaint schedule portion was allotted to the<\/p>\n
plaintiff’s mother and the other portion was<\/p>\n
allotted to Pathumma. The plaintiff’s mother by<\/p>\n
virtue of the document No.21\/72 had assigned her<\/p>\n
right  which    was     obtained        under    the  oral<\/p>\n

partition       in favour  of   the  plaintiff   and<\/p>\n
therefore the plaintiff is claiming right over<\/p>\n
that property.      It is also contended that as per<\/p>\n
the proceedings in S.C.172\/77 the settlement<\/p>\n
officer had found that the ownership of the<\/p>\n
house in Sy.No.161\/24 has to be confirmed in the<\/p>\n
name of the plaintiff as well as the defendant’s<\/p>\n
mother. Therefore the suit is filed.<\/p>\n
     2.    The defendant on the other hand would<\/p>\n
submit that the plaintiff is not entitled to any<\/p>\n
relief.       The property described in the plaint<\/p>\n
schedule      property belonged  to   the  defendant<\/p>\n
exclusively and therefore the plaintiff is not<\/p>\n
entitled to any fixation of boundaries.       It is<\/p>\n
admitted that there had been an oral partition<\/p>\n
between the mother of the plaintiff and the<\/p>\n
mother of the defendant. The property described<\/p>\n
in the plaint schedule property was set apart to<\/p>\n

the share of the mother of the defendant and<\/p>\n
therefore      the defendant    is entitled  to  the<\/p>\n
property and the plaintiff with her family are<\/p>\n
residing in a neighbouring plot and so the suit<\/p>\n
is liable to be dismissed.\n<\/p>\n
     3.    In the trial court PW1 and DW1 were<\/p>\n
examined.      Exts.A1 to A3, B1 to B3 and C1 to C3<\/p>\n
were marked.      On an analysis of the evidence the<\/p>\n
trial court has dismissed the suit.           It is<\/p>\n
against that decision the plaintiff has come up<\/p>\n
in appeal.\n<\/p>\n
     4.    Heard   the  learned    counsel  for  the<\/p>\n
appellant       and the   young   counsel  for   the<\/p>\n
respondent. At the out set it has to be stated<\/p>\n
the suit is one for settlement of boundaries.<\/p>\n
So unless there is possession attached it may<\/p>\n
not be possible to fix the boundaries and title<\/p>\n
also becomes relevant.         Now even according to<\/p>\n

the document Ext.A2 which is relied upon by the<\/p>\n
plaintiff to declare the joint entitlement over<\/p>\n
the property in Sy.No.161\/24 there is a finding<\/p>\n
recorded by the settlement officer that the<\/p>\n
plaintiff’s       mother  had  been  put   out   of<\/p>\n
possession.      Now the crux of the matter is that<\/p>\n
what was the properties that were allotted to<\/p>\n
the mother of the plaintiff and the mother of<\/p>\n
the defendant in a oral partition which is said<\/p>\n
to be taken between those two sisters.      If the<\/p>\n
plaint schedule property forms part and parcel<\/p>\n
of the property allotted to the mother of the<\/p>\n
plaintiff       under  the  oral  partition,   then<\/p>\n
necessarily the mother will get the right to<\/p>\n
assign that property or gift that property in<\/p>\n
favour of her daughter which will also entitle<\/p>\n
her to get right over the property.        Now the<\/p>\n
contention of the defendant is that there had<\/p>\n

been an oral partition between the sisters but<\/p>\n
it   is     specifically stated  that  the  plaint<\/p>\n
schedule property was set apart to her share of<\/p>\n
the mother of the defendant and therefore the<\/p>\n
plaintiff’s mother did not have any title to the<\/p>\n
property and so a subsequent gift or assignment<\/p>\n
in favour of the plaintiff will not confer on<\/p>\n
her any title.      The Court below had also found<\/p>\n
that there is no positive evidence adduced by<\/p>\n
both the sides to the effect that which are the<\/p>\n
properties that are set apart to these sisters.<\/p>\n
Only on a finding on that there would be a<\/p>\n
proper resolution of the dispute between the<\/p>\n
parties.\n<\/p>\n
     5.    Now as I held earlier the whole question<\/p>\n
is in a liquid state and with these materials it<\/p>\n
may   not     be possible to  settle  the  dispute<\/p>\n
between the parties by fixing the boundaries of<\/p>\n

the property.       The very important question of<\/p>\n
entitlement of the plaintiff over the property<\/p>\n
is the larger question to be decided.      Only when<\/p>\n
that larger question is decided a relief can be<\/p>\n
granted.       Therefore the plaintiff may have to<\/p>\n
institute a proper suit for declaration of her<\/p>\n
title and for recovery of possession, if so<\/p>\n
advised.      Leaving open that to the plaintiff I<\/p>\n
dismiss this appeal for the reason that the<\/p>\n
relief sought for cannot be granted in this<\/p>\n
suit.       Parties   are directed   to bear   their<\/p>\n
respective costs.\n<\/p>\n<\/p>\n
