5. The claimant is seeking enhancement of the said
\ncompensation not being satisfied with what the Tribunal has<\/p>\n

7. Having heard the learned counsel for iparitieis aiigdiwhaving
\nconsidered the evidence placedby theiclaimaiitbeforeiithe’Tribunal<\/p>\n
and scrutiny of Trial Court records,’the?’po.i_n*t.x_’thia_t arises for our<\/p>\n
considerationivin  is iasiunderzw V
\n“Whether thevgeoiii1g_aehsatio’n awarded by the MACT
\nis just anici=._Vreasor_taiblehand if not, does it require<\/p>\n
 enhrthcement ahdif so? to what extent?”<\/p>\n
    facts are that, claimant on 12 \/ 10\/ 2002<\/p>\n
T’ v.__iii”\\”riv*l;ile proceeding  Bilagi on motor cycle met with an accident viz.,<\/p>\n
 bevarting Reg. No. \u00a7<.A–22\/6482 driven in a negligent<\/p>\n
 dashed from back against the vehicle of claimant, which<\/p>\n
7re'sul_ted in injuries being sustained by the claimant and<\/p>\n

immediately thereaftervvards he was shifted to the District Hospital<\/p>\n
and on being given the first aid treatment was shiftcd'r._to<\/p>\n
Vivekananda Hospital, I-Iubli, on the advise of the Doctors<\/p>\n
unconscious state due to the head injury. The  an'  <\/p>\n
inpatient at Vivekananda Hospital ihfromplp j. <\/p>\n
28\/10\/2002. The Tribunal on con'siderati'onl"of fjtti 5"gh'asV"g<\/p>\n
arrived at a conclusion that the accide'n'_ti'in_ quelstion' haslzioccurred
\non account of the rash andA..4_neg1igl;Aen:ttAvdrivingpof the truck and
\nproceeded to assess the quantum of on the basis of<\/p>\n
the medical evidence  15;! theclaiinanit; <\/p>\n
9. We on record, perused
\nexhibits marked ‘which:’:-gitiaslvl’produced by the claimant viz., the
\nmedical prescriptions;  V. reports, disability certi\ufb01cate,
\nwound certificate  evidence of Dr. Sanjeev Kalasoor,
\nvvho P.W.2 in extenso. It is seen from Ex.P~9,<\/p>\n
which~.Ali’h_tal”   Report (Plain Study) carried out on<\/p>\n

 *on._the ‘body of the claimant.\n<\/p>\n
  Posteriorfossa structure are normal.<\/p>\n
._f9 l7S\u00e9rial axial sectiona of brain obtained with out IV contrast.<\/p>\n
0 Evidence of multiple contusions noted in right cerebral
\nhemisphere 8:; left temporal lobe with diffuse cerebral edema<\/p>\n
in right cerebral hemisphere.\n<\/p>\n
a Right lateral ventricle is effaced with mid line shift  _<\/p>\n
o Focal subarachnoid hemorrhagic noted   <\/p>\n
\ufb01ssure. I V
\na Small bleed noted in left temperal horn.  A it
\no Sellar, parasellar region are normal. it _
\na Evidence of linear fracture of leftVi’terriperallb’o.n:enoted.

\n* Diffuse cerebral edema   bleed in right
\ncerebral hemispherevffi left:temp:eral–  subarachnoid<\/p>\n
hemorrhage in  \ufb01ssiire .85  ‘left. ternperal horn bleed.<\/p>\n
* Linear fracture “left tempe.frall”b.or:ge\u00a7”.1  ‘\n<\/p>\n

 and the said report has been produced<\/p>\n

0 Thin subdural bleed seen in the right temporal and<\/p>\n
fronto-parietaregion.\n<\/p>\n
o Haemorrhagic contusions seen in the left frontallla\ufb01-i.,. :_. <\/p>\n
temporal region show mild increase in su_r_rou.nd_ing<<\/p>\n
edema.\n<\/p>\n
o Extra~dural haematoma seen  the posterior foss.a.lA.in thei
\nmild line. ” ‘” ”  ”\n<\/p>\n
o Signs of diffuse cerebraledemafselen,
\nc There is mild shift of midliries the left.
\na Longitudinal fracture in volviiig  temporal<\/p>\n
bone extending   “cavity.\n<\/p>\n

11. S’ub.seq1i.ientu1y’\u00e91fteVr discharge the MRI Brain Screening
\n1\u00a7la_siVbeen”   19V\u20acll)ll3\/T2004 and the \ufb01ndings of the said<\/p>\n
screening reads.. as follows-\n<\/p>\n
 0 T?”-weigvhtedimages reveal ill de\ufb01ned hyperintense areas<\/p>\n
 involving; the right fronto–temporo–parietal and left
\nA  temporal regions. These appear hypointense on T1<\/p>\n
weighted images and represent encephalomalacic areas.<\/p>\n
0 Rest of the brain parenchyma shows normal signal
\nintensity. ”\n<\/p>\n
0 There is no evidence of intracranial haemorrhage.
\nI Lateral ventricles are mildly dilated.
\n0 No midline shift is seen.\n<\/p>\n
u Both 7*” — 8″‘ nerve complexes appearinolavnial.
\no Craniovertebral junction is <\/p>\n
0 Orbits and calvarium are~Llnrenlarital;le1’\u00bb
\no Encephalomalacic areas’  right fronta-
\ntemporo–parietal__ and ‘left   ll<\/p>\n
12.    treated claimant and
\nexamined   19\/O3\/2004 has issued
\na Certi\ufb01cate laz;;,\u00bb,.’, the=.lZ\u00a7ilsahil1iy”‘Certi\ufb01cate, which is at Ex.P~11,<\/p>\n
concluding’ theeretirider’rthatl-the: physical disability of the claimant<\/p>\n
:i=s_vto”thVe’ dmjso,\/0  the claimant would not be in a position<\/p>\n
to  as the injury has caused in claimant getting<\/p>\n
liwgiddiness_ q_ui~tej..– often which is called as “Alaxia”. These<\/p>\n
it'”:3’ldoci1rnentary__lmedical evidence has been reiterated in the oral<\/p>\n
 evidence the Doctor and though a feeble attempt has been made<\/p>\n
ll  the cross–examination to disprove that the disability was not to<\/p>\n
a\/<\/p>\n
10<\/span><\/p>\n
the extent of 75%, no admission has been extracted to disprove<\/p>\n
this fact of 75% disability having been suffered by claimant.<\/p>\n
Hence, we are of the considered opinion that Docto.r~~\u00abeviden’ce” <\/p>\n
placed before the Tribunal entirely supports the  the <\/p>\n
appellant that the Tribunal committed; a  error’–.isnV:l’noyt\ufb01’<\/p>\n
considering the appellants claim for loss ift1t1.Er6y:e\u00a7’1I7l.;1lf1l3S.l3’4ili\ufb01lli<\/p>\n
these circumstances, we are of the  that
\nby the Tribunal requires to  reappreciation of
\nevidence. at T V V  ii at<\/p>\n
13. Admittedly;  cerebral edema
\nand on account of disability to the entire
\nbody to an extent   1j,.’1o”lspitalisation, taking of the
\nmedicines as presc.ribedlby.lth_e’ ibglcctor P.W.2, not being in dispute,
\nthe,Vamountgtovvards llimvedvicalpiexpenses awarded by the Tribunal<\/p>\n
alsorequires a__ relook. As such considering the nature of<\/p>\n
7″\u00bb.xinjuIy,l’  days of hospitalisation, the treatment<\/p>\n
Vobtained duririgtiie course of hospital thereafterwards and also<\/p>\n
 the Doctor to have future medical treatment is to be<\/p>\n
 note of by us and the compensation requires to be awarded.<\/p>\n
  (ll)nll_pe1’usal of the evidence of the Doctor (P.V\\\/.2) it is found that<\/p>\n
\ufb01f<\/p>\n
ll<\/p>\n
doctor has opined that on clinical examination of claimant it was<\/p>\n
found that he was suffering from “Alaxia” (suffering from givddiness<\/p>\n
while walking) which in effect mean that claimant w’ill’L1’1l(isii:fferir1\u00e9\u00bb  if   Rs. 30,000 \/_
\nTowards7n1edical’ ie;tpe’nses.ppiil”-,V__ . _’ Rs. 60,000 \/ ~<\/p>\n
Towards  pg xrluring the
\nhospitalisati’on,i food and nourishment, diet
\nand travelling expenses.  Rs. 30,000 \/ —<\/p>\n
 .A   .far..Vas loss of future earning, the Tribunal has<\/p>\n
procee-ded_ton’aii._e1″roneous footing and come to a conclusion that<\/p>\n
 the claiIriantv–..’:is’vnlot completely incapable ‘of doing any work in<\/p>\n
 ._’0n”eican1ination of Doctor’s evidence, we find that the<\/p>\n
   categorically opined the disability to the whole body is<\/p>\n
T  “He has also stated that the claimant would be unable to do<\/p>\n
12<\/span><\/p>\n
any heavy work. Keeping this evidence in the background and the<\/p>\n
nature of work, the claimant was carrying on, viz., being a_ mason<\/p>\n
he would be unable to do any other work than the avoc’ati’onV—he.   _<\/p>\n
conversant with. As such the Tribunal was in error’ in ..coming.to   <\/p>\n
conclusion that claimant was not prevented .fI’QI\u00a7;1 idoingangi<\/p>\n
work. Taking this aspect into consideration, we that during <\/p>\n
the relevant period viz., during 2OO2ViVi4i’a_xrnason”  drawing
\natleast Rs. 100\/ — per day,   and the
\nannual income would be Rs.3\u20ac2_;Q:iC_)O\/  as opined by
\nthe Doctor being   of future income
\nto the claimant    p.a. According to the
\nmedical   Tribunal, we find that
\nthe age of the”‘injured  and as held in Sarala Verma’s
\ncase, the relevant would be applicable being 17, the
\n f’utui’e&incioim’e”wou1d be Rs.-4,59,000\/– (27,000 X 17).<\/p>\n
Thtis,theVc1aimant.._would be entitled for a total compensation of<\/p>\n
Rs. 5,79\u00bb,.\u00a7C)0 under the following heads;<\/p>\n
1′.’:=’l’owardsiithe pain and suffering Rs. 30,000 \/~<\/p>\n
  . Towards” medical expenses including future Rs. 60,000\/~
\nV’  .__ ‘ ‘ ‘ medical expenses<\/p>\n

3. Towards food and nourishment, diet etc. Rs. 30,000 \/ —<\/p>\n
4. Towards loss of future earning Rs. 4,S9,0xOrQ:\/i\u00e9._V<\/p>\n
Total Rs.   _<\/p>\n
Thus, the claimant would be Zyentitle\u00e9i  ._’a–. lsunfi <\/p>\n
Rs.5,79,000\/– together with future.int.erest 6\u00b0\/o  dateuof <\/p>\n
petition till the date of deposit.\n<\/p>\n
In View of the above, I passtiie  _\n<\/p>\n
(i) The  ‘in M\n<\/p>\n
(ii) jrh\u00e9’co\u00a7%..p\u00a2f{\u00a7Tg:;t:ofziir\u00a7.s’ awarded by the Tribunal is\n<\/p>\n
 — to a sum of

\n  l  from date of petition till the entire
\n3  paid.\n<\/p>\n
 (iiijl ~.  the said amount (Rs. 5, 79, 000\/ –), a sum of
\nit   53,68,250\/– shall be kept in \ufb01xed deposit in
\nany Nationalised Bank for a period of 5 years<\/p>\n

and balance amount shall be released in favour<\/p>\n
of claimant.\n<\/p>\n
(iv) The claimant would be entitled to draw   ;. b <\/p>\n
