Having heard Shri<br \/>\nVimal Patel, learned advocate for the applicants and Shri Jinesh<br \/>\nKapadia, learned advocate for the respondent Bank and in the facts<br \/>\nand circumstances of the case and considering the controversy, this<br \/>\nCourt is of the opinion that let Special Civil Application No.14386<br \/>\nof 2004 be restored to file and be considered in accordance with law<br \/>\nand on its merits. Learned advocate for the respondent Bank has not<br \/>\nseriously opposed the prayer to restore the main Special Civil<br \/>\nApplication and consider the same on merits. Hence, present<br \/>\napplication is allowed and Special Civil Application No.14386 of 2004<br \/>\nis ordered to be restored to file. Rule is made absolute<br \/>\nto the aforesaid extent. No costs.
