Justice M.SASIDHARAN NAMBIAR\n\n Dated :28\/07\/2005\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n            ===========================\n           W.P.(C) NO. 31168    OF 2005\n            ===========================\n\n       Dated this the 28th day of July, 2008\n\n                     JUDGMENT\n<\/pre>\n<p>    Petitioner is the plaintiff and respondents the<\/p>\n<p>defendants in O.S.220\/1997 on the file of Munsiff<\/p>\n<p>Court,  Manjeri.    Suit  was  originally  one  for<\/p>\n<p>permanent  prohibitory  injunction.    Subsequently<\/p>\n<p>plaint was amended for mandatory injunction also. A<\/p>\n<p>Commission was appointed.  Commissioner submitted a<\/p>\n<p>report.   Petitioner then filed I.A.831\/2005 to<\/p>\n<p>remit the report.  Under Ext.P2 order petition was<\/p>\n<p>dismissed granting opportunity to the petitioner to<\/p>\n<p>adduce  evidence  in  support  of  the  objections.<\/p>\n<p>Subsequently suit was dismissed. Thereafter it was<\/p>\n<p>restored  to   file.      Petitioner   then   filed<\/p>\n<p>I.A.1742\/2005, an application to remit the report<\/p>\n<p>and plan  to the Commissioner.  Under Ext.P6 order,<\/p>\n<p>learned Munsiff dismissed the application holding<\/p>\n<p>that the same prayer was rejected as per Ext.P2<\/p>\n<p>order  earlier.    This  petition  is  filed  under<\/p>\n<p><span class=\"hidden_text\">W.P.(C)31168\/2005             2<\/span><\/p>\n<p>Article       227   of   the   Constitution  of   India<\/p>\n<p>challenging Exts.P2 and P6 orders.<\/p>\n<p>     2.      Learned counsel appearing for petitioner<\/p>\n<p>was heard.\n<\/p>\n<p>     3.    The argument of the learned counsel is that<\/p>\n<p>Commissioner submitted Ext.P3 report only in 2005<\/p>\n<p>and therefore petitioner cannot be found fault for<\/p>\n<p>protracting       the   trial   and   I.A.831\/2005  was<\/p>\n<p>dismissed under Ext.P2 for the reason that suit is<\/p>\n<p>included in the special list and as the suit was<\/p>\n<p>subsequently dismissed for default and restored,<\/p>\n<p>I.A.1742\/2005 should not have been dismissed on the<\/p>\n<p>ground that        petition was earlier dismissed.   It<\/p>\n<p>was    argued     that   learned  Munsiff  should  have<\/p>\n<p>remitted the report to the Commissioner to file a<\/p>\n<p>correct report and      Exts.P2 and P6 orders are to be<\/p>\n<p>quashed.\n<\/p>\n<p>     4.      On hearing the learned counsel, I do not<\/p>\n<p>find    any     illegality  or  irregularity warranting<\/p>\n<p>interference.\n<\/p>\n<p>     5.     Under Ext.P2 order,   petition to remit the<\/p>\n<p>report to the Commissioner was rejected granting<\/p>\n<p>opportunity to the petitioner to adduce evidence in<\/p>\n<p><span class=\"hidden_text\">W.P.(C)31168\/2005            3<\/span><\/p>\n<p>support of the objections.         Though one of the<\/p>\n<p>reasons shown in Ext.P2 order is that         suit was<\/p>\n<p>included in the special list, it does not mean that<\/p>\n<p>when the suit was dismissed for default and later<\/p>\n<p>restored,       Ext.P2 order  passed earlier    to  be<\/p>\n<p>ignored and         report is to be remitted to the<\/p>\n<p>Commissioner.\n<\/p>\n<p>     6. On the facts and materials, I do not find<\/p>\n<p>any reason to interfere with Exts.P2 and P6 orders.<\/p>\n<p>Petitioner       is  entitled to  adduce  evidence   in<\/p>\n<p>support       of   the    objections  including   cross<\/p>\n<p>examining the Commissioner.       If by adducing such<\/p>\n<p>evidence, petitioner can satisfy the court and<\/p>\n<p>court finds that there is defect in the report or<\/p>\n<p>the report cannot be relied on, court is competent<\/p>\n<p>either     to set aside the report or remit the report<\/p>\n<p>to the Commissioner.
