They seek quashing of complaint<br \/>\nAnnexure-A filed by respondent No.2 herein. Complaint pertains to<br \/>\ndishonor of cheque issued by the petitioners in favour of respondent<br \/>\nNo.2. It is the case of the petitioners that these cheques were<br \/>\nissued as part of compromise between the parties during the pendency<br \/>\nof cheque bouncing cases and civil suits filed by the complainant. My<br \/>\nattention is drawn to communication Annexure-C wherein it is stated<br \/>\nthat series of cheques have been issued by the petitioners as part of<br \/>\nthe compromise upon payment of all cheques. Complainant was to<br \/>\nwithdraw the civil suits.\n<\/p>\n<p>\tIt<br \/>\nis the case of petitioners that Criminal Case No. 257\/1999 is still<br \/>\npending during which by virtue of compromise, cheques came to be<br \/>\nissued. Second complaint for the same sets of liabilities would not<br \/>\nbe maintainable. My attention was drawn to decision in case of Lalit<br \/>\nKumar Sharma and another v. State of Uttar Pradesh and another<br \/>\nreported in (2008) Supreme Court Cases 638.\n<\/p>\n<p>\tThough<br \/>\nserved no one appears for the complainant. I have heard learned<br \/>\nadvocate for the petitioners and learned APP for the State.\n<\/p>\n<p>\tFrom<br \/>\nthe impugned complaint itself, it can be seen that previous complaint<br \/>\nof cheque bouncing is still pending. Complainant has stated in the<br \/>\ncomplaint, that criminal case No. 257\/1999 is admitted which is still<br \/>\npending. In view of the admitted fact that said cheques having been<br \/>\nissued by way of compromise during pendency of the first complaint of<br \/>\ncheque bouncing and in view of decision of Apex  Court in case of<br \/>\nLalit Kumar Sharma and another(supra),<br \/>\nfresh complaint would not be maintainable. In case of Lalit<br \/>\nKumar Sharma and another(supra),<br \/>\nthe Apex Court in similar circumstances, held and observed as under :\n<\/p>\n<p> 17.<br \/>\nThus the second cheque was issued by Manish Arora for the purpose of<br \/>\narriving at a settlement. The said cheque was not issued in discharge<br \/>\nof the debt or liability of the Company for which the  appellants<br \/>\nwere said to be the Directors. There was only one transaction between<br \/>\nShri Ashis Narula, Shri Manish Arora, Directors of the Company and<br \/>\nthe complaint. They have already been punished. Thus, the question of<br \/>\nentertaining the second complaint did not arise. It was, in our<br \/>\nopinion, wholly misconceived. The appeal, therefore, in our opinion,<br \/>\nmust be allowed. It is directed accordingly. The respondent shall<br \/>\nbear the cost of the appellants. Counsel&#8217;s fee assessed at Rs<br \/>\n25,000\/-.\n<\/p>\n<p>\tIn<br \/>\nview of the admitted factual background and settled legal position,<br \/>\nthe petition is required to be allowed. Complaint at Annexure-A is<br \/>\nquashed.\n<\/p>\n<p>\tPetition<br \/>\nis disposed of.
