Justice ANTONY DOMINIC\n\n Dated :29\/09\/2010\n\n O R D E R\n                       ANTONY DOMINIC, J.\n              --------------------------------------------------\n                  W.P.(C) NO.29937 OF 2010(N)\n              --------------------------------------------------\n        Dated this the 29th day of September, 2010\n\n                           J U D G M E N T\n<\/pre>\n<p>      Petitioner passed Plus two from a school affiliated to the<\/p>\n<p>respondents in the year 2010. Ext.P1 is the mark list. According<\/p>\n<p>to the petitioner, she wanted to appear again in the examination<\/p>\n<p>for improving her marks in some of the subjects including<\/p>\n<p>Mathematics. Although she obtained an application form from the<\/p>\n<p>respondents, having regard to the provisions in clause 44(1) of<\/p>\n<p>the Examination Bye Laws, petitioner submits that she is ineligible<\/p>\n<p>to appear for improvement for the reason that she is pursuing her<\/p>\n<p>higher studies. It is in this background that this writ petition is<\/p>\n<p>filed challenging clause 44(1) of the Examination Bye Laws.<\/p>\n<p>      2. Clause 44(i) of the Examination Bye Laws reads as under.<\/p>\n<p>             (i) A candidate who has passed an examination of the<br \/>\n             Board may reappear for improvement of performance<br \/>\n             in one or more subjects in the main examination in<br \/>\n             the succeeding year only; however, a candidate who<br \/>\n             has passed an examination of the Board under<br \/>\n             Vocational Scheme may reappear for improvement of<br \/>\n             performance in one or more subject in the main<br \/>\n             examination in the succeeding year and the following<br \/>\n             year provided they have not pursued higher studies in<br \/>\n             the meantime. They will appear as private candidates.<br \/>\n             Those reappearing for the whole examination may<br \/>\n             however appear as regular school candidates also if<br \/>\n             admitted by the school as regular student.&#8221;<\/p>\n<p>WPC.No. 29937\/2010<br \/>\n<span class=\"hidden_text\">                                :2 :<\/span><\/p>\n<p>      3. This provision shows that only those candidates who are<\/p>\n<p>not perusing higher studies are eligible to appear in an<\/p>\n<p>examination, for improving their     marks. Obviously, since the<\/p>\n<p>petitioner is perusing her higher studies, she is ineligible. Such a<\/p>\n<p>provision has       been incorporated in the Regulation      for the<\/p>\n<p>reason that, if a student who is pursuing higher studies is allowed<\/p>\n<p>to appear for improvement of the subject of the lower classes, the<\/p>\n<p>student having undergone courses of higher level, the knowledge<\/p>\n<p>and capacity of the student cannot be same or equivalent as<\/p>\n<p>compared to the students of the concerned class, who are not<\/p>\n<p>pursing their higher studies and appearing for the examination<\/p>\n<p>along with him. What is to be assessed in the understanding<\/p>\n<p>capacity and knowledge of the student. This will not be possible<\/p>\n<p>if the student concerned in undergoing higher courses. This is to<\/p>\n<p>avoid    this disparity,   above provision is incorporated in the<\/p>\n<p>Examination Bye Laws. Such a restrictive provision, cannot be<\/p>\n<p>said to be arbitrary for any reason and therefore I am not<\/p>\n<p>persuaded to agree with the learned Counsel for the petitioner<\/p>\n<p>that the provision is illegal.\n<\/p>\n<p>WPC.No. 29937\/2010<br \/>\n<span class=\"hidden_text\">                                  :3 :<\/span><\/p>\n<p>      4.
