Singh, J.\n<\/p>\n<p>\tThis appeal by Special Leave is preferred by the<br \/>\npetitioners impugning the judgment and order of the High<br \/>\nCourt of Karnataka, Bangalore of April 10, 2000 in HRRP<br \/>\nNo.668 of 1999.  The aforesaid Revision Petition was<br \/>\npreferred by the petitioners against the order of eviction<br \/>\npassed by the XVI Additional Small Causes Judge,<br \/>\nBangalore city dated 16th March, 1999 in HRC No.2800 of<br \/>\n1992 on the grounds specified in Clauses (f) and (h) under<br \/>\nthe proviso to sub-section (1) of Section 21 of the Karnataka<br \/>\nRent Control Act, 1961, namely on the grounds of subletting<br \/>\nof premises and bona fide personal need of the landlord.\n<\/p>\n<p>\tThe Revision Petition was presented on June 25, 1999<br \/>\nand was taken back to remove certain defects, whereafter it<br \/>\nwas presented on July 9, 1999.  Only a day earlier, on July<br \/>\n8, 1999, the petitioners sent to the landlord a sum of<br \/>\nRs.2400\/- by money order representing the arrears of rent<br \/>\ndue and payable to the landlord on the day of presentation of<br \/>\nthe Revision Petition.  The High Court held that since on the<br \/>\ndate of presentation of Revision Petition namely on June 25,<br \/>\n1999, the arrears of rent had not been paid to the landlord,<br \/>\nor deposited in Court, the Revision Petition was liable to be<br \/>\nrejected for non-compliance with the provision of Section<br \/>\n29(1) of the Act.  Section 29(1) of the Act provides as under:-\n<\/p>\n<p>&#8220;29. Deposit and payment of rent during<br \/>\nthe pendency of proceedings for eviction.<br \/>\n (1) No tenant against whom an application<br \/>\nfor eviction has been made by a landlord<br \/>\nunder Section 21, shall be entitled to contest<br \/>\nthe application before the Court under that<br \/>\nSection or to prefer or prosecute (a revision<br \/>\npetition under Section 50 against an order<br \/>\nmade by the Court on application under<br \/>\nSection 21) unless he has paid or pays to the<br \/>\nlandlord or deposits with the Court or the<br \/>\nDistrict Judge or the High Court, as the case<br \/>\nmay be, all arrears of rent due in respect of<br \/>\nthe premises upto the date of payment or<br \/>\ndeposits and continues to pay or to deposit<br \/>\nany rent which may subsequently become due<br \/>\nin respect of the premises at the rate at which<br \/>\nit was last paid or agreed to be paid, until the<br \/>\ntermination of the proceedings before the<br \/>\nCourt or the District Judge or the High Court,<br \/>\nas the case may be&#8221;.\n<\/p>\n<p>\tThis appeal alongwith Civil Appeal No.4533 of 2001<br \/>\n(K. Raghunath Vs. Chandrasekhar and another) came up for<br \/>\nhearing before this Bench earlier.  Civil Appeal No.4533 of<br \/>\n2001 was allowed and the case was remitted to the High<br \/>\nCourt for disposal of the revision petition on merit.  The<br \/>\naforesaid judgment is reported in JT 2004 (10) SC 404.  We<br \/>\nhave in the aforesaid judgment noted the legal provisions<br \/>\nand the decisions having a bearing on the question involved.<br \/>\nThe instant appeal was not disposed of since it was<br \/>\nmentioned before us that the parties were negotiating a<br \/>\nsettlement out of Court.  We gave some time to the parties<br \/>\nfor this purpose, but ultimately they informed us that the<br \/>\nparties have not been able to work out a settlement.\n<\/p>\n<p>\tWe have noticed in K. Raghunath (supra) that though<br \/>\nSection 29(2) provides that the tenant ought to deposit the<br \/>\nrent during the pendency of proceedings for eviction within<br \/>\nthe time and in the manner prescribed, Rule 9 which<br \/>\nprescribed the manner and time within which the deposit<br \/>\ncontemplated by Section 29 shall be made only lays down<br \/>\nthat such deposit may be made within 15 days of the last<br \/>\ndate fixed in the agreement of tenancy with the landlord for<br \/>\npayment of the rent, or in the absence of such agreement,<br \/>\n15 days from the last date of the month next following that<br \/>\nfor which the rent is payable.\n<\/p>\n<p>\tSection 50 which provides for a revision does not lay<br \/>\ndown the period within which a revision may be preferred by<br \/>\nthe aggrieved party.  Section 50 begins with the words &#8220;The<br \/>\nHigh Court may, at any time call for and examine&#8221;.\n<\/p>\n<p>\tHaving regard to the fact that the position in law was<br \/>\nnot very clear, the High Court of Karnataka in two judgments<br \/>\nlaid down that such a revision must be preferred within 90<br \/>\ndays, though the said period of 90 days was not the period<br \/>\nof limitation prescribed by law, and the period prescribed by<br \/>\nthe judgments was only by way of guidance for the exercise<br \/>\nof discretion in such matters.\n<\/p>\n<p>\tKeeping in view the above position, we find that the<br \/>\norder of eviction was passed on March 16, 1999 and a<br \/>\nrevision was preferred on June 25, 1999.  It was re-<br \/>\npresented on July 9, 1999.  It is not in dispute that the<br \/>\narrears of rent had not been paid when the Revision Petition<br \/>\nwas initially presented on June 25, 1999, but before its re-<br \/>\npresentation on  July 9, 1999 the amount representing the<br \/>\narrears of rent had been sent to the landlord by money order<br \/>\non  July 8, 1999.  The question is whether in such<br \/>\ncircumstance the Revision Petition ought to be dismissed as<br \/>\nnot maintainable on the ground that when it was presented<br \/>\nfirst the arrears of rent had not been either paid to the<br \/>\nlandlord or deposited in Court as required, though that was<br \/>\ndone before it was re-presented on July 9, 1999.\n<\/p>\n<p>\tIn K. Raghunath&#8217;s (supra) we have followed the<br \/>\nprinciple laid down by this Court in The Commissioner of<br \/>\nIncome Tax, Bombay Vs. M\/s. Filmistan Ltd. : 1961 3 SCR<br \/>\n893 which in effect lays down the principle that where a<br \/>\nperiod of limitation is prescribed by law for preferring an<br \/>\nappeal, and the law requires the tax to be paid before<br \/>\npresentation of memorandum of appeal, the appellant is<br \/>\nentitled to pay the tax till the last date of limitation prescribed<br \/>\nby law.  Thus even if the appellant had earlier presented the<br \/>\nappeal without payment of tax, the appeal could only be held<br \/>\nto be not properly filed until the tax is paid.\n<\/p>\n<p>\tAs we have noticed, the provisions of the Karnataka<br \/>\nAct in question are not happily worded.  In fact, there is no<br \/>\nlimitation prescribed for preferring a Revision Petition.  In<br \/>\nany event, in view of the guidelines laid down by the High<br \/>\nCourt,  if there was a delay of about 15 days in making the<br \/>\ndeposit or presenting the Revision Petition, the same ought<br \/>\nto have been condoned and the revision decided on merit.<br \/>\nWe do not, therefore, consider it necessary to discuss the<br \/>\nvarious legal submissions urged before us, and which were<br \/>\nalso urged before the High Court, on the question as to<br \/>\nwhether the Revision Petition shall be deemed to have been<br \/>\npreferred on June 25, 1999, when it was initially presented,<br \/>\nor on July 9, 1999, when it was re-presented after payment<br \/>\nof arrears of rent.  We, therefore, allow this appeal and remit<br \/>\nthe matter to the High Court for disposal of the Revision<br \/>\nPetition in accordance with law.\n<\/p>\n<p>\tWe may only observe that the Karnataka Rent Control<br \/>\nAct, 1961 has been repealed by the Karnataka Rent Act,<br \/>\n1999.  Though, the parties urged before us submissions<br \/>\nbased on the Karnataka Rent Act, 1999, having regard to the<br \/>\nchanges brought about by the Act of 1999, we have<br \/>\nadvisedly not expressed any opinion on those questions,<br \/>\nand we leave it to the High Court to consider those questions<br \/>\nif raised before it.
