Mr.K.M.Vijaya Kumar,\n\t\t     Special Government Pleader\n For R2\t\t  ...Mr.D.Sasikumar,\n\t\t      Government Advocate\n\n:ORDER\n<\/pre>\n<p>\tThe petitioner has stated that she had purchased the property situated in<br \/>\nSurvey No.248\/3, Plot No.20, T.S.No.19\/2A1, along with the building bearing Door<br \/>\nNo.1\/75F20 and 1\/75F21, in Emaneswaram Village, Paramakudi Taluk, Ramanathapuram<br \/>\nDistrict, from the third respondent. However, on 30.08.2010, the first<br \/>\nrespondent had proposed to conduct an auction to sell the property, purchased by<br \/>\nthe petitioner, due to the non-payment of the dues relating to the housing loan<br \/>\navailed by the third respondent, from the N.N.11, Paramakudi Co-operative<br \/>\nBuilding Society Limited, Paramakudi, Ramanathapuram District, the second<br \/>\nrespondent herein.\n<\/p>\n<p>\t2. The main contention of the learned counsel for the petitioner is that<br \/>\nthe third respondent had sold the property in question to the petitioner,<br \/>\nsuppressing the fact that the said property was being brought to public auction<br \/>\nfor the non-payment of the dues relating to the housing loan availed by the<br \/>\nthird respondent. Therefore, the first respondent is to be restrained from<br \/>\nbringing the property in question for sale by public auction.\n<\/p>\n<p>\t3. In view of the averments made in the affidavit filed in support of the<br \/>\nwrit petition and in view of the submissions made by the learned counsel<br \/>\nappearing for the petitioner, this Court is of the considered view that the<br \/>\npetitioner has not shown sufficient cause or reason to grant the relief, as<br \/>\nprayed for by the petitioner, in the present writ petition. The property in<br \/>\nquestion had been brought to sale by public auction, by the first respondent,<br \/>\ndue to the fact that the third respondent had not discharged his liability of<br \/>\nrepaying the housing loan availed by him from the N.N.11, Paramakudi Co-<br \/>\noperative Building Society Limited, Paramakudi, Ramanathapuram District, the<br \/>\nsecond respondent herein. Even if the petitioner has purchased the said<br \/>\nproperty, without having the knowledge that the third respondent had mortgaged<br \/>\nthe property for availing the housing loan, it would not be open to him to<br \/>\nchallenge the auction to be conducted by the first respondent. However, it goes<br \/>\nwithout saying that it would be open to the petitioner to initiate appropriate<br \/>\naction against the third respondent, if so advised, before the appropriate<br \/>\nforum, in the manner known to law, to recover the amount, said to have been paid<br \/>\nby the petitioner to the third respondent, in purchasing the property in<br \/>\nquestion. As such, the writ petition is devoid of merits. Hence, it is<br \/>\ndismissed. No costs.  Consequently, the connected Miscellaneous Petition is<br \/>\nclosed.\n<\/p>\n<p>To<\/p>\n<p>1.
