Case No. 7 of 2010<br \/>\nregistered with Bhadarva police station, Vadodara for the offences<br \/>\npunishable under Sections 465, 467, 468, 471, 120B  read with section<br \/>\n114 of Indian Penal Code.\n<\/p>\n<p>\tI<br \/>\nhave heard the learned advocates for the parties at length and in<br \/>\ngreat detail. The parties do not press for reasoned order.\n<\/p>\n<p>\tHaving<br \/>\nregard to the rival contentions of the respective counsel and having<br \/>\nconsidered the case of the prosecution and the allegations against<br \/>\nthe accused-applicant, I am inclined to exercise my discretion in<br \/>\nfavour of the applicant considering the following aspects:\n<\/p>\n<p>[a]\tDispute<br \/>\npertains to land.\n<\/p>\n<p>[b]\tThe<br \/>\naccused-applicant is the purchaser of the land in question.\n<\/p>\n<p>[c]\tOffences<br \/>\nare Magistrate triable.\n<\/p>\n<p>[d]\tThis<br \/>\nCourt has ordered release of eight co-accused involved in the<br \/>\npresent offence on regular bail vide order dated 25th<br \/>\nApril, 2011 passed in Criminal Misc. Application No. 5167 of 2011.<br \/>\nSimilarly, another co-accused has also been ordered to be released<br \/>\nvide order dated 9th May, 2011 passed by this Court in<br \/>\nCriminal Misc. Application No. 5897 of 2011.\n<\/p>\n<p>[e]\tNo<br \/>\novert act is attrubuted to the accused-applicant except the fact that<br \/>\nhe is purchaser of the disputed land.\n<\/p>\n<p>[f]\tNo<br \/>\nallegation of forgery.\n<\/p>\n<p>[g]\tNo<br \/>\npast criminal antecedents.\n<\/p>\n<p>[h]\tInvestigation<br \/>\nis practically over and  the entire prosecution is based on<br \/>\ndocumentary evidence.\n<\/p>\n<p>\tHaving<br \/>\nregard to the facts and circumstances of the case, the applicant is<br \/>\nordered<br \/>\nto be released on bail, in connection with M. Case No. 7 of 2010<br \/>\nregistered with Bhadarva police station, Vadodara on his executing a<br \/>\nbond in the sum of Rs.15,000\/- (Rupees fifteen thousand only) with<br \/>\none solvent surety of the like amount to the satisfaction of the<br \/>\nlower Court and subject to the conditions that he shall,<\/p>\n<p>not<br \/>\n\ttake undue advantage of his liberty or misuse his liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>maintain<br \/>\n\tlaw and order;\n<\/p>\n<p>mark<br \/>\n\this presence before the concerned Police Station on every 2nd<br \/>\n\tand 4th Sunday of every month between 10:00 am to 2:00<br \/>\n\tpm:\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>furnish<br \/>\n\tthe address of his residence at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of  this<br \/>\n\tCourt;\n<\/p>\n<p>surrender<br \/>\n\this passport, if any, to the Lower Court immediately.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>\tBail<br \/>\nbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>\tRule<br \/>\nis made absolute.
