The petitioner challenges an<br \/>\n\torder dated 16.5.2000 passed by the Controlling Authority under the<br \/>\n\tPayment of Gratuity Act directing the petitioner to pay an amount of<br \/>\n\t29,954\/- to respondent No.3 who was employed as a primary school<br \/>\n\tteacher by the petitioner. Said order of the Controlling Authority<br \/>\n\twas challenged in appeal unsuccessfully. Appellate order dated<br \/>\n\t21.6.2001 is also under challenge.\n<\/p>\n<p>\tIt<br \/>\n\tis not in dispute that respondent No.3 was engaged as a primary<br \/>\n\tschool teacher by the petitioner. She continued to discharge her<br \/>\n\tduties for nearly 21 years. She crossed the age of superannuation on<br \/>\n\t26.3.1997. However as per her averments, according to Government<br \/>\n\tregulations she was permitted to continue in service till 30.4.1997<br \/>\n\ti.e. till the end of academic term. It is also not in dispute that<br \/>\n\tpreviously teachers of primary schools were not covered under the<br \/>\n\tterm  employee  under the Payment of Gratuity Act. However, by<br \/>\n\tvirtue of amendment made by the Payment of Gratuity(Amendment) Act<br \/>\n\t2009, term  employee  has been amended to include such teachers<br \/>\n\talso. This amendment was given retrospective effect from 3.4.1997.\n<\/p>\n<p>It<br \/>\n\tis the case of the petitioner that respondent no.3 having crossed<br \/>\n\tthe age of superannuation on 26.3.1997, cannot get the benefit of<br \/>\n\tsuch amended definition.\n<\/p>\n<p>On<br \/>\n\tthe other hand, learned counsel for respondent no.3 submitted that<br \/>\n\trespondent no.3 having continued in service, cannot be denied the<br \/>\n\tbenefit of said amended definition.\n<\/p>\n<p>Having<br \/>\n\theard learned advocates for the parties and having perused the<br \/>\n\tmaterial on record and in view of the admitted position, I find that<br \/>\n\tthe order passed by the appellate authority below need not be<br \/>\n\tinterfered with. At the relevant time may be term  employee<br \/>\n\tcontained in the Payment of Gratuity Act would not cover respondent<br \/>\n\tno.3 as primary school teacher. However, by virtue of amendment in<br \/>\n\tthe Payment of Gratuity (Amendment) Act, 2009, brought with effect<br \/>\n\tfrom 3.4.1997, all such teachers are now covered under the term<br \/>\n\t employee . Though respondent no.3 crossed the age of<br \/>\n\tsuperannuation on 26.3.1997, concededly continued in service till<br \/>\n\t30.4.1997. This was also in consonance with Government policy to<br \/>\n\tretire the teachers only at the end of academic term regardless of<br \/>\n\tthe exact age when they cross retirement age. In that view of the<br \/>\n\tmatter, when respondent no.3 was in service till 30.4.1997, she<br \/>\n\tcannot be denied the benefits of amendment which is introduced with<br \/>\n\teffect from 3.4.1997.\n<\/p>\n<p>Counsel<br \/>\n\tfor the petitioner however, drew my attention to the Government<br \/>\n\tResolution dated 24.4.1990 wherein it is provided that any service<br \/>\n\trendered by a teacher till the end of academic term but after<br \/>\n\tcrossing the age of superannuation, shall not count towards<br \/>\n\tincrement, pension and other retirement benefits. Meaning of the<br \/>\n\tsaid circular however, is entirely different and would deny the<br \/>\n\tteacher any benefit of increment falling during the said period and<br \/>\n\tweightage of the additional service subsequent to his\/her crossing<br \/>\n\tthe age of retirement for the purpose of counting pensionary<br \/>\n\tbenefits and other retirement benefits.\n<\/p>\n<p>Since<br \/>\n\tI find that respondent no.3 was actually in service when the<br \/>\n\tamendment in the Payment of Gratuity Act was made with effect from<br \/>\n\t3.4.1997, she cannot be denied her rightful gratuity.\n<\/p>\n<p>In<br \/>\n\tthe result, no interference is called for. Petition is therefore,<br \/>\n\tdismissed. Rule is discharged. Interim relief if any stands vacated.\n<\/p>\n<p>Respondent<br \/>\n\tNo.2 shall resultantly release the amount of gratuity deposited with<br \/>\n\tit with accumulated interest expeditiously and in any case not later<br \/>\n\tthan 30.4.2010.\n<\/p>\n<p>Direct<br \/>\n\tservice to respondent no.3 is permitted.\n<\/p>\n<p> \tIn<br \/>\n\tview of above order, civil application does not survive.
