4 - Respondent(s)\n \n\n=========================================================\nAppearance : \nMR\nZUBIN F BHARDA for\nPetitioner(s) : 1, \nMS MINI NAIR, AGP for Respondent(s) : 1, \nMR\nHS MUNSHAW for Respondent(s) : 2, \nMR YM THAKKAR for Respondent(s)\n: 3, \nRULE SERVED BY DS for Respondent(s) : 4 - 5. \nMR GM JOSHI\nfor Respondent(s) : 4 - 5. \nMR PR NANAVATI for Respondent(s) :\n4, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE JAYANT PATEL\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE S.R.BRAHMBHATT\n\t\t\n\t\n\n \n\nDate\n: 20\/12\/2010 \n\n \n\n \n \n\n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE JAYANT PATEL)<\/p>\n<p>We<br \/>\n\thave heard both the sides for final disposal.\n<\/p>\n<p>The<br \/>\n\tpetitioner by this petition has challenged the action on the part of<br \/>\n\trespondent No.4 Gram Panchayat for issuing tender vide advertisement<br \/>\n\tdated 16.09.2010, whereby the offers were invited of the parties for<br \/>\n\texcavation of the soil over the area which is marked for lake.\n<\/p>\n<p>After<br \/>\n\tthe matter was argued for sometime by both the sides, the learned<br \/>\n\tadvocate appearing for both the sides are in agreement on the<br \/>\n\tfollowing aspects:\n<\/p>\n<p>The<br \/>\n\twork for inviting of the tender and finalisation thereof may be<br \/>\n\tassigned to the officer not below the rank of Deputy DDO who may be<br \/>\n\tmarked by DDO for such purpose instead of respondent No.4 Gram<br \/>\n\tPanchayat.\n<\/p>\n<p>The<br \/>\n\tterms and conditions of the tender\/offer may be finalised by the<br \/>\n\tsaid officer, but he shall not include the condition of surety who<br \/>\n\tis residing in a particular area, but the said officer may be at the<br \/>\n\tliberty to substitute the condition by providing deposit or security<br \/>\n\tor bank guarantee, etc. without restricting the residence of the<br \/>\n\tpersons concerned.\n<\/p>\n<p>The<br \/>\n\tupset price may be Rs.351\/- per truck plus royalty to be paid to the<br \/>\n\tGovernment.\n<\/p>\n<p>It<br \/>\n\tmay be kept open for the Officer to undertake the process of<br \/>\n\tnegotiation inter se amongst first four highest offerers so as to<br \/>\n\trealise the maximum value of the contract.\n<\/p>\n<p>The<br \/>\n\taforesaid process may be completed on or before 28.02.2011.\n<\/p>\n<p>We<br \/>\n\tmay record that there are basic infirmities in certain conditions of<br \/>\n\tthe contract and also in fixation of upset price if the earlier<br \/>\n\tlitigation is taken into consideration and orders passed by this<br \/>\n\tCourt are considered. Therefore, the aforesaid agreement as declared<br \/>\n\tbefore us appears to be reasonable and if such is allowed to be<br \/>\n\timplemented, the same would be in larger interest of the revenue of<br \/>\n\tthe Gram Panchayat, that too under the supervision of the higher<br \/>\n\tofficer of the rank of Dy. D.D.O.\n<\/p>\n<p>Hence,<br \/>\n\tthe following order:\n<\/p>\n<p>The<br \/>\n\twork for inviting of the tender and finalisation thereof shall be<br \/>\n\tassigned to the officer not below the rank of Deputy DDO who shall<br \/>\n\tbe marked by DDO for such purpose instead of respondent No.4 Gram<br \/>\n\tPanchayat.\n<\/p>\n<p>The<br \/>\n\tterms and conditions of the tender\/offer shall be finalised by the<br \/>\n\tsaid officer, but he shall not include the condition of surety who<br \/>\n\tis residing in a particular area, but the said officer would be at<br \/>\n\tthe liberty to substitute the condition by providing deposit or<br \/>\n\tsecurity or bank guarantee, etc. without restricting the residence<br \/>\n\tof the persons concerned.\n<\/p>\n<p>The<br \/>\n\tupset price shall be Rs.351\/- per truck plus royalty to be paid to<br \/>\n\tthe Government.\n<\/p>\n<p>It<br \/>\n\twill be open for the Officer to undertake the process of negotiation<br \/>\n\tinter se amongst first four highest offerer so as to realise the<br \/>\n\tmaximum value of the contract.\n<\/p>\n<p>The<br \/>\n\taforesaid process shall be completed on or before 28.02.2011.\n<\/p>\n<p>In<br \/>\n\tview of the aforesaid, the present advertisement for inviting offer<br \/>\n\tas well as tender documents submitted would not survive and the<br \/>\n\tprocess shall be undertaken afresh as directed hereinabove.\n<\/p>\n<p>It<br \/>\n\twill be open to the Gram Panchayat to return the deposit of the<br \/>\n\tofferer, if any with it pursuant to the present order.\n<\/p>\n<p>The<br \/>\n\tpetition is disposed of in terms of the aforesaid direction.  Rule<br \/>\n\tis made absolute accordingly.  No order as to costs.
